SEVERANCE TAX BONDS--AUTHORIZATIONS-- | 0021| APPROPRIATION OF PROCEEDS.-- | 0022| A. The state board of finance may issue and sell | 0023| severance tax bonds in compliance with the Severance Tax | 0024| Bonding Act in an amount not to exceed the total of the | 0025| amounts authorized for purposes specified in this act. The |

0001| state board of finance shall schedule the issuance and sale of | 0002| the bonds in the most expeditious and economical manner | 0003| possible upon a finding by the board that the project has been | 0004| developed sufficiently to justify the issuance and that the | 0005| project can proceed to contract within a reasonable time. The | 0006| state board of finance shall further take the appropriate | 0007| steps necessary to comply with the Internal Revenue Code of | 0008| 1986, as amended. Proceeds from the sale of the bonds are | 0009| appropriated for the purposes specified in this act. | 0010| B. The agencies named in this act shall certify to | 0011| the state board of finance when the money from the proceeds of | 0012| the severance tax bonds authorized in this section is needed | 0013| for the purposes specified in the applicable section of this | 0014| act. | 0015| C. If the specified agency has not certified the | 0016| need for the issuance of the bonds by the end of fiscal year | 0017| 2000, the authorization provided in this act shall be void. | 0018| D. Unless otherwise specified in this act, any | 0019| unexpended or unencumbered balance remaining from the proceeds | 0020| of severance tax bonds issued pursuant to this act at the end | 0021| of fiscal year 2002 shall revert to the severance tax bonding | 0022| fund. | 0023| Section 2. STATE AGENCY ON AGING--PURPOSES.--Pursuant to | 0024| the provisions of Section 1 of this act, upon certification by | 0025| the state agency on aging that the need exists for the |

SEVERANCE TAX BONDS--NEW MEXICO OFFICE OF | 0007| INDIAN AFFAIRS--EXPANSION IN PURPOSE--APPROPRIATION.--The balance | 0008| of severance tax bonds authorized pursuant to Subsection B of | 0009| Section 9 of Chapter 4 of Laws 1996 (S.S.) for a group home for | 0010| disabled senior citizens at Tohatchi shall not be expended for | 0011| its original purpose but is reauthorized and appropriated to the | 0012| New Mexico office of Indian affairs to plan, design or construct | 0013| a group home for disabled citizens at Tohatchi located in | 0014| McKinley county. | 0015| Section 45. SEVERANCE TAX BONDS--NEW MEXICO OFFICE OF | 0016| INDIAN AFFAIRS--CLARIFYING PURPOSES AND EXTENDING EXPENDITURE | 0017| PERIODS.--Notwithstanding the provisions of Subsections F through | 0018| N of Section 16 of Chapter 148 of Laws 1994, the appropriations | 0019| in those subsections from severance tax bond proceeds to the New | 0020| Mexico office of Indian affairs for various capital outlay | 0021| purposes for each of the head start programs in the communities | 0022| of Coal Mine, Navajo, Rock Springs, Tsa-Ya-Toh, Crystal, | 0023| Manuelito, Mexican Springs, Tohatchi and Twin Lakes located in | 0024| McKinley and San Juan counties may be expended by each community | 0025| for any or all of the purposes stated in the subsection |

SEVERANCE TAX BONDS--STATE DEPARTMENT OF | 0007| PUBLIC EDUCATION--CHANGE IN PURPOSE--APPROPRIATION.--The balance | 0008| of severance tax bond proceeds appropriated pursuant to | 0009| Subsection R of Section 11 of Chapter 113 of Laws 1992 for a | 0010| pedestrian overpass across Isleta boulevard shall not be expended | 0011| for that original purpose but is reauthorized and appropriated to | 0012| the state department of public education for improvements to | 0013| Harrison middle school athletic fields in southwest Albuquerque | 0014| in Bernalillo county. | 0015| Section 47. SEVERANCE TAX BONDS--NEW MEXICO STATE | 0016| UNIVERSITY--CHANGE IN PURPOSE--APPROPRIATION.--The proceeds from | 0017| the sale of severance tax bonds to the board of regents of New | 0018| Mexico state university pursuant to Subsection A of Section 24 of | 0019| Chapter 7 of Laws 1998 for infrastructure or renovations of aging | 0020| facilities on the main campus of New Mexico state university in | 0021| Dona Ana county shall not be expended for that purpose but shall | 0022| be expended for renovation and improvements to Goddard hall. | 0023| Section 48. SEVERANCE TAX BONDS--CHANGE IN PURPOSE--CHANGE | 0024| IN AGENCY--APPROPRIATION.--The proceeds from the sale of | 0025| severance tax bonds appropriated to the local government division |

0001| of the department of finance and administration to acquire land | 0002| and construct a parking lot at the Roswell convention and civic | 0003| center in Chaves county pursuant to Subsection KK of Section 9 of | 0004| Chapter 7 of Laws 1998 shall not be expended for that purpose but | 0005| are appropriated to the state highway and transportation | 0006| department for street and drainage improvements on Atkinson | 0007| avenue between Mescalero road and Berrendo road in Roswell in | 0008| Chaves county. | 0009| Section 49. GENERAL FUND--OFFICE OF CULTURAL AFFAIRS-- | 0010| EXTENDING EXPENDITURE PERIOD.--The period of time in which the | 0011| general fund appropriation made pursuant to Subsection B of | 0012| Section 24 of Chapter 4 of Laws 1996 (S.S.) to the office of | 0013| cultural affairs for designing, constructing or equipping a | 0014| living traditions education center at the museum of Indian arts | 0015| and culture in Santa Fe county may be expended shall be extended | 0016| through fiscal year 2000. The period of time for | 0009| expenditure shall be extended through fiscal year 1999. GENERAL FUND--STATE HIGHWAY AND TRANSPORTATION | 0015| DEPARTMENT--CHANGING PURPOSE AND EXTENDING EXPENDITURE PERIOD-- | 0016| APPROPRIATION.--The general fund appropriation made pursuant to | 0017| Subsection Q of Section 34 of Chapter 4 of Laws 1996 (S.S.) for a | 0018| new road or a railroad crossing in Otero county shall not be | 0019| expended for its original purpose but is appropriated to the | 0020| state highway and transportation department for the purpose of | 0021| installing lights, gates, belts and making other improvements to | 0022| an existing crossing named Riata railroad crossing on Riata road | 0023| located one mile south of Tularosa in Otero county. GENERAL FUND--NEW MEXICO OFFICE OF INDIAN | 0004| AFFAIRS--CHANGE IN PURPOSE--APPROPRIATION.--The balance of the | 0005| general fund appropriation made pursuant to Subsection V of | 0006| Section 28 of Chapter 222 of Laws 1995 for a preschool building | 0007| in Chichiltah shall not be expended for its original purpose but | 0008| is appropriated to the New Mexico office of Indian affairs for a | 0009| power line extension project or house wiring for the community of | 0010| Chichiltah in McKinley county. | 0011| Section 57. GENERAL FUND--MESA TECHNICAL COLLEGE--CHANGE | 0012| IN PURPOSE--APPROPRIATION.--The balance of the general fund | 0013| appropriation made to Mesa technical college pursuant to Laws | 0014| 1995, Chapter 222, Section 42 to plan and design a child | 0015| development facility at the college in Tucumcari in Quay county | 0016| shall not be expended for its original purpose but is | 0017| appropriated to the governing board of Mesa technical college for | 0018| facility improvements at the college to comply with federal | 0019| Americans with Disabilities Act of 1990 requirements. | 0020| Section 58. PROJECT SCOPE--EXPENDITURES.--If an | 0021| appropriation for a project authorized in this act is not | 0022| sufficient to complete all the purposes specified, the | 0023| appropriation may be expended for any portion of the purposes | 0024| specified in the appropriation. Expenditures shall not be made | 0025| for purposes other than those specified in the appropriation. |
