0012| RELATING TO CAPITAL EXPENDITURES; AUTHORIZING THE ISSUANCE OF
|
0013| SEVERANCE TAX BONDS; REAUTHORIZING UNEXPENDED OR UNENCUMBERED
|
0014| BALANCES; CHANGING AGENCIES AND PURPOSES OF CERTAIN BOND
|
0015| AUTHORIZATIONS AND FUND APPROPRIATIONS; EXTENDING EXPENDITURE
|
0016| PERIODS; AUTHORIZING EXPENDITURES; MAKING APPROPRIATIONS;
|
0017| DECLARING AN EMERGENCY.
|
0018|
|
0019| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0020| Section 1. SEVERANCE TAX BONDS--AUTHORIZATIONS--
|
0021| APPROPRIATION OF PROCEEDS.--
|
0022| A. The state board of finance may issue and sell
|
0023| severance tax bonds in compliance with the Severance Tax
|
0024| Bonding Act in an amount not to exceed the total of the
|
0025| amounts authorized for purposes specified in this act. The
|
- 1 -0001| state board of finance shall schedule the issuance and sale of
|
0002| the bonds in the most expeditious and economical manner
|
0003| possible upon a finding by the board that the project has been
|
0004| developed sufficiently to justify the issuance and that the
|
0005| project can proceed to contract within a reasonable time. The
|
0006| state board of finance shall further take the appropriate
|
0007| steps necessary to comply with the Internal Revenue Code of
|
0008| 1986, as amended. Proceeds from the sale of the bonds are
|
0009| appropriated for the purposes specified in this act.
|
0010| B. The agencies named in this act shall certify to
|
0011| the state board of finance when the money from the proceeds of
|
0012| the severance tax bonds authorized in this section is needed
|
0013| for the purposes specified in the applicable section of this
|
0014| act.
|
0015| C. If the specified agency has not certified the
|
0016| need for the issuance of the bonds by the end of fiscal year
|
0017| 2000, the authorization provided in this act shall be void.
|
0018| D. Unless otherwise specified in this act, any
|
0019| unexpended or unencumbered balance remaining from the proceeds
|
0020| of severance tax bonds issued pursuant to this act at the end
|
0021| of fiscal year 2002 shall revert to the severance tax bonding
|
0022| fund.
|
0023| Section 2. STATE AGENCY ON AGING--PURPOSES.--Pursuant to
|
0024| the provisions of Section 1 of this act, upon certification by
|
0025| the state agency on aging that the need exists for the
|
- 2 -0001| issuance of the bonds, the following amounts are appropriated
|
0002| to the state agency on aging for the following purposes:
|
0003| A. one hundred seventy-five thousand dollars
|
0004| ($175,000) to construct new activity rooms at the Deming-Luna
|
0005| senior citizen center in Luna county;
|
0006| B. two hundred twenty-five thousand dollars
|
0007| ($225,000) to plan, design or construct a senior citizen center
|
0008| in Mexican Springs in McKinley county;
|
0009| C. eighty-four thousand dollars ($84,000) for an
|
0010| addition at the Nageezi senior center in McKinley county;
|
0011| D. fifty thousand dollars ($50,000) to plan, design,
|
0012| construct and equip a senior citizen center in the community of
|
0013| Truchas in Rio Arriba county;
|
0014| E. eight thousand eight hundred dollars ($8,800) to
|
0015| renovate and make improvements to the Floyd senior citizen center
|
0016| in Roosevelt county;
|
0017| F. twenty-five thousand dollars ($25,000) to complete
|
0018| the addition at the senior citizen center and for purchase of
|
0019| equipment and furnishings in Two Grey Hills in San Juan county;
|
0020| G. fifty thousand dollars ($50,000) for phase one
|
0021| construction of the Jemez pueblo elderly center in Sandoval
|
0022| county; and
|
0023| H. one hundred seventy-five thousand dollars
|
0024| ($175,000) to repair, renovate or remodel the senior citizen
|
0025| center in Truth or Consequences in Sierra county.

- 3 -0001| Section 3. OFFICE OF CULTURAL AFFAIRS--PURPOSES.--Pursuant
|
0002| to the provisions of Section 1 of this act, upon certification by
|
0003| the office of cultural affairs that the need exists for the
|
0004| issuance of the bonds, the following amounts are appropriated to
|
0005| the office of cultural affairs for the following purposes:
|
0006| A. five hundred thousand dollars ($500,000) for
|
0007| additions to and remodeling of the museum of natural history,
|
0008| including relocation and expansion of the theater, a new
|
0009| ticketing pavilion, exterior improvements and completion of
|
0010| permanent exhibition halls, in Albuquerque in Bernalillo county;
|
0011| B. one million dollars ($1,000,000) for installation
|
0012| of permanent exhibits and an automated ticketing system at the
|
0013| New Mexico farm and ranch heritage museum in Dona Ana county;
|
0014| C. five hundred thousand dollars ($500,000) for
|
0015| renovation and improvements at the New Mexico museum of natural
|
0016| history and science and the museum annex located in Bernalillo
|
0017| county;
|
0018| D. one hundred thirty-five thousand dollars
|
0019| ($135,000) to purchase a bookmobile to be based in Tucumcari
|
0020| located in Quay county;
|
0021| E. one hundred thousand dollars ($100,000) to plan an
|
0022| addition to and provide for the preservation of the Fort Selden
|
0023| ruins and to procure exhibits honoring the Buffalo soldiers in
|
0024| Dona Ana county;
|
0025| F. one hundred fifty thousand dollars ($150,000) for
|
- 4 -0001| reroofing the Clyde Tombaugh space theater and planetarium in
|
0002| Alamogordo in Otero county;
|
0003| G. four hundred thousand dollars ($400,000) for the
|
0004| planning phase for a history museum in Santa Fe county; and
|
0005| H. fifty thousand dollars ($50,000) to plan, design
|
0006| and renovate the museo cultural in Santa Fe in Santa Fe county.
|
0007| Section 4. CUMBRES AND TOLTEC SCENIC RAILROAD COMMISSION--
|
0008| PURPOSES.--Pursuant to the provisions of Section 1 of this act,
|
0009| upon certification by the Cumbres and Toltec scenic railroad
|
0010| commission that the need exists for the issuance of the bonds,
|
0011| the following amounts are appropriated to the Cumbres and Toltec
|
0012| scenic railroad commission for the following purposes:
|
0013| A. eight thousand one hundred dollars ($8,100) to
|
0014| renovate, in order to comply with the requirements of the
|
0015| Americans with Disabilities Act of 1990, the Antonito depot of
|
0016| the Cumbres and Toltec scenic railroad;
|
0017| B. forty-eight thousand six hundred dollars ($48,600)
|
0018| to renovate, in order to comply with the requirements of the
|
0019| Americans with Disabilities Act of 1990, the Chama engine house
|
0020| at the Cumbres and Toltec scenic railroad in Rio Arriba county;
|
0021| C. eleven thousand six hundred dollars ($11,600) to
|
0022| renovate, in order to comply with the requirements of the
|
0023| Americans with Disabilities Act of 1990, the Osier facility at
|
0024| the Cumbres and Toltec scenic railroad;
|
0025| D. fifty-six thousand dollars ($56,000) to construct
|
- 5 -0001| an addition and other improvements to the car shop and engine
|
0002| house at the Cumbres and Toltec scenic railroad in Rio Arriba
|
0003| county in order to comply with the Americans with Disabilities
|
0004| Act of 1990; and
|
0005| E. fifteen thousand four hundred dollars ($15,400) to
|
0006| renovate, in order to comply with the requirements of the
|
0007| Americans with Disabilities Act of 1990, the commission office of
|
0008| the Cumbres and Toltec scenic railroad in Rio Arriba county.
|
0009| Section 5. OFFICE OF THE STATE ENGINEER--PURPOSES.--
|
0010| Pursuant to the provisions of Section 1 of this act, upon
|
0011| certification by the office of the state engineer that the need
|
0012| exists for the issuance of the bonds, the following amounts are
|
0013| appropriated to the office of the state engineer for the
|
0014| following purposes:
|
0015| A. one hundred thousand dollars ($100,000) for a
|
0016| water modeling project for the Eldorado water and sanitation
|
0017| district in Santa Fe county;
|
0018| B. fifty thousand dollars ($50,000) for repairs and
|
0019| improvements in the Antelope Valley irrigation district in Colfax
|
0020| county; and
|
0021| C. one million seven hundred fifty thousand dollars
|
0022| ($1,750,000) to develop a state water plan and provide regional
|
0023| planning grants throughout the state.
|
0024| Section 6. ENERGY, MINERALS AND NATURAL RESOURCES
|
0025| DEPARTMENT--PURPOSE.--Pursuant to the provisions of Section 1 of
|
- 6 -0001| this act, upon certification by the energy, minerals and natural
|
0002| resources department that the need exists for the issuance of the
|
0003| bonds, five hundred thousand dollars ($500,000) is appropriated
|
0004| to the energy, minerals and natural resources department to
|
0005| renovate and provide storage facilities at forestry headquarters
|
0006| and other facilities located throughout the state.
|
0007| Section 7. DEPARTMENT OF ENVIRONMENT--PURPOSES.--Pursuant
|
0008| to the provisions of Section 1 of this act, upon certification by
|
0009| the department of environment that the need exists for the
|
0010| issuance of the bonds, the following amounts are appropriated to
|
0011| the department of environment for the following purposes:
|
0012| A. forty-three thousand dollars ($43,000) for water
|
0013| system improvements in Los Ranchos de Albuquerque in Bernalillo
|
0014| county;
|
0015| B. three hundred thousand dollars ($300,000) to
|
0016| continue construction of sewer projects in the north valley area
|
0017| of Bernalillo county. The certification and issuance of bonds is
|
0018| contingent upon the city of Albuquerque, Bernalillo county and
|
0019| the village of Los Ranchos de Albuquerque entering into an
|
0020| agreement regarding planning, designing and constructing sewer
|
0021| collection and treatment facilities in the north valley area of
|
0022| Bernalillo county;
|
0023| C. fifty thousand dollars ($50,000) for phase two of
|
0024| a water and wastewater improvement, expansion and replacement
|
0025| project in Angel Fire in Colfax county;
|
- 7 -0001| D. fifty thousand dollars ($50,000) for water and
|
0002| sewer infrastructure improvement projects in Maxwell in Colfax
|
0003| county;
|
0004| E. sixty thousand dollars ($60,000) to design,
|
0005| inspect and construct water system improvements in the Mountain
|
0006| View community of southern Dona Ana county;
|
0007| F. forty thousand dollars ($40,000) to construct an
|
0008| extension of a water line to serve residents of Watson lane in
|
0009| Dona Ana county;
|
0010| G. one hundred thousand dollars ($100,000) to plan,
|
0011| design, construct and equip the phase two wastewater effluent
|
0012| reuse facility in Carlsbad in Eddy county;
|
0013| H. twenty-five thousand dollars ($25,000) to complete
|
0014| phases two and three improvements to the Malaga community
|
0015| domestic water system in Eddy county;
|
0016| I. one hundred thousand dollars ($100,000) to improve
|
0017| the Lone Mountain and Twin Sisters wellfields in Santa Clara in
|
0018| Grant county;
|
0019| J. one hundred thousand dollars ($100,000) for an
|
0020| eastside wastewater facility replacement and improvement project
|
0021| in Santa Rosa in Guadalupe county;
|
0022| K. one hundred thousand dollars ($100,000) to expand
|
0023| the Milan sewer system in Cibola county;
|
0024| L. one hundred thousand dollars ($100,000) to improve
|
0025| the water and sanitation sewer disposal system in Thoreau in
|

|
0002| M. twenty-five thousand dollars ($25,000) for water
|
0003| line extensions, meters, a well house and an office and storage
|
0004| building for the Buena Vista mutual water consumers association
|
0005| in Mora county;
|
0006| N. twenty-five thousand dollars ($25,000) to plan,
|
0007| design and construct lagoons and install sewer extensions in
|
0008| Abiquiu in Rio Arriba county;
|
0009| O. twenty-five thousand dollars ($25,000) for
|
0010| renovating, expanding and upgrading the Velarde mutual domestic
|
0011| water users association water system in Rio Arriba county;
|
0012| P. twenty-five thousand dollars ($25,000) for phase
|
0013| three of the construction and improvement of the Agua Sana
|
0014| regional water system in Rio Arriba county;
|
0015| Q. twenty-five thousand dollars ($25,000) for
|
0016| improvements to the Canjilon water system in Rio Arriba county;
|
0017| R. twenty-five thousand dollars ($25,000) to extend
|
0018| and replace water lines and to design, construct, install and
|
0019| equip improvements to the water system of the Cebolla mutual
|
0020| domestic water consumers association in Rio Arriba county;
|
0021| S. twenty-five thousand dollars ($25,000) to upgrade
|
0022| the water system in Regina located in Sandoval county, including
|
0023| expanding the storage and distribution system;
|
0024| T. twenty-five thousand dollars ($25,000) to upgrade
|
0025| and repair the Ensenada community water system in Rio Arriba
|

|
0002| U. twenty-five thousand dollars ($25,000) to complete
|
0003| community water system repairs in Gallina in Rio Arriba county;
|
0004| V. one hundred thousand dollars ($100,000) for the
|
0005| planning, designing and installing of a wastewater treatment
|
0006| facility in Jemez Springs in Sandoval county;
|
0007| W. fifty thousand dollars ($50,000) to design,
|
0008| construct and equip improvements to, and purchase water rights
|
0009| for, the water system of the Ponderosa mutual domestic water
|
0010| consumers association in Sandoval county;
|
0011| X. one hundred seventy-five thousand dollars
|
0012| ($175,000) for planning, designing and constructing of
|
0013| replacement and improvements to the water distribution system,
|
0014| including individual home metering, in the Rancho West mobile
|
0015| home association in Rio Rancho in Sandoval county;
|
0016| Y. twenty-five thousand dollars ($25,000) to plan and
|
0017| design a sewer system for San Ysidro in Sandoval county;
|
0018| Z. fifty thousand dollars ($50,000) to purchase and
|
0019| install a water storage tank and appurtenances in the El Prado
|
0020| water and sanitation district in Taos county;
|
0021| AA. twenty-five thousand dollars ($25,000) to plan,
|
0022| design and install a community water system in El Rito in Taos
|
0023| county;
|
0024| BB. two hundred thousand dollars ($200,000) for land
|
0025| acquisition, well development, a water delivery system and a
|

|
0002| CC. one hundred thousand dollars ($100,000) to
|
0003| design, construct and inspect water system improvements in
|
0004| Clayton in Union county.

0005| Section 8. STATE FAIR COMMISSION--PURPOSES.--Pursuant to
|
0006| the provisions of Section 1 of this act, upon certification by
|
0007| the state fair commission that the need exists for the issuance
|
0008| of the bonds, the following amounts are appropriated to the state
|
0009| fair commission for the following purposes:
|
0010| A. one million dollars ($1,000,000) for site drainage
|
0011| improvements at the New Mexico state fairgrounds in Bernalillo
|
0012| county; and
|
0013| B. eight hundred thousand dollars ($800,000) for
|
0014| renovations and improvements to various facilities located at the
|
0015| New Mexico state fairgrounds in Bernalillo county.
|
0016| Section 9. DEPARTMENT OF FINANCE AND ADMINISTRATION--
|
0017| PURPOSES.--Pursuant to the provisions of Section 1 of this act,
|
0018| upon certification by the local government division of the
|
0019| department of finance and administration that the need exists for
|
0020| the issuance of the bonds, the following amounts are appropriated
|
0021| to the local government division of the department of finance and
|
0022| administration for the following purposes:
|
0023| A. ten thousand dollars ($10,000) to purchase
|
0024| computers and other equipment for the county of Bernalillo to use
|
0025| for an organization located in the southeast area of Albuquerque
|

|
0002| for criminal offenders who are making a transition back into
|
0003| society;
|
0004| B. two hundred thousand dollars ($200,000) to design
|
0005| and construct Alamosa center park in Albuquerque in Bernalillo

0007| C. two hundred thousand dollars ($200,000) to
|
0008| renovate the Arroyo del Oso park in Albuquerque in Bernalillo
|
0009| county;
|
0010| D. fifty thousand dollars ($50,000) to design and
|
0011| construct improvements at the Alameda little league complex at
|
0012| the balloon fiesta park in Albuquerque in Bernalillo county;
|
0013| E. three hundred thousand dollars ($300,000) to
|
0014| acquire, develop and construct improvements to a three-acre Bel
|
0015| Air area park on Phoenix in Albuquerque in Bernalillo county;
|
0016| F. seventy-five thousand dollars ($75,000) to
|
0017| continue construction of a preschool at the Dennis Chavez
|
0018| community center in Albuquerque in Bernalillo county;
|
0019| G. one hundred seventy-five thousand dollars
|
0020| ($175,000) to construct storage, restroom, concession and

0021| security observation facilities at the athletic fields in the

0015| one planning, designing and construction of a multipurpose
|
0016| service center in the Atrisco-Five Points area of the south
|
0017| valley in Bernalillo county;
|
0018| N. one hundred thousand dollars ($100,000) to design
|
0019| and renovate Kiva park in Albuquerque in Bernalillo county;
|
0020| O. fifty thousand dollars ($50,000) to acquire land
|
0021| for baseball fields in or near Paradise Hills in Bernalillo
|
0022| county;
|
0023| P. fifty thousand dollars ($50,000) to plan, design,
|
0024| develop and make improvements, including site preparation, to
|
0025| Parkway park located south of Ladera boulevard and west of Unser
|

0006| R. one hundred fifty thousand dollars ($150,000) to

0007| plan, design, construct and equip a dental clinic that provides
|
0008| dental services to low-income families in Albuquerque in
|
0009| Bernalillo county;

0010| S. fifty thousand dollars ($50,000) to design,
|
0011| construct and purchase equipment for a play area and for
|
0012| landscaping in Los Tomases park in Bernalillo county;
|
0013| T. twenty-five thousand dollars ($25,000) to
|
0014| construct a sidewalk at Westgate little league fields to create a
|
0015| walking space for students of Mary Ann Binford elementary school
|
0016| and to comply with Americans with Disabilities Act of 1990
|
0017| requirements in Albuquerque in Bernalillo county;
|
0018| U. two hundred thousand dollars ($200,000) to
|
0019| develop, design and construct the Mesa Verde community center,
|
0020| gymnasium and park in Albuquerque in Bernalillo county;
|
0021| V. seventy-five thousand dollars ($75,000) to design
|
0022| and construct the Montgomery-Tramway neighborhood center in
|
0023| Albuquerque in Bernalillo county;
|
0024| W. one hundred fifty thousand dollars ($150,000) for
|
0025| repairs, improvements and an addition to the Old North Valley
|

0002| X. thirty-five thousand dollars ($35,000) to plan,

0003| design, renovate, develop and make improvements, including site

0006| Y. twenty-seven thousand dollars ($27,000) to

0007| purchase and equip vans for the transportation of senior citizens

0010| Z. fifty thousand dollars ($50,000) to improve the

0011| facilities of the Roadrunner little league baseball fields in
|
0012| Albuquerque in Bernalillo county;

0013| AA. one hundred fifty thousand dollars ($150,000) to

0014| continue construction of the east San Jose community center and
|
0015| renovate the swimming pool at the center in Albuquerque in
|
0016| Bernalillo county;
|
0017| BB. one hundred fifty thousand dollars ($150,000) to

0018| continue design and construction of improvements at Singing Arrow
|
0019| park and community center in Albuquerque in Bernalillo county;
|
0020| CC. one hundred twenty-five thousand dollars

0021| ($125,000) to improve the south valley little league fields and
|
0022| facilities in Albuquerque in Bernalillo county;

0023| DD. fifty thousand dollars ($50,000) for improvements
|
0024| and equipment for the Taylor Ranch community center in Bernalillo
|
0025| county;

0014| design, construct, equip or furnish an addition to the volunteer
|
0015| fire department and community center facility at Midway in Chaves
|
0016| county;
|
0017| RR. two hundred thousand dollars ($200,000) to
|
0018| demolish old buildings and construct a new central park plaza
|
0019| area with landscaping and parking in Roswell in Chaves county;
|
0020| SS. two hundred thousand dollars ($200,000) for phase
|

0013| ($2,000,000) is appropriated to the department of game and fish

0014| to plan, design, construct, furnish and equip a new headquarters

0016| Section 12. CAPITAL PROGRAM FUND--PURPOSES.--Pursuant to

0017| the provisions of Section 1 of this act, upon certification by

0025| PURPOSE.--Pursuant to the provisions of Section 1 of this act,

0008| Section 21. NEW MEXICO JUNIOR COLLEGE--PURPOSE.--Pursuant

0009| to the provisions of Section 1 of this act, upon certification by

0010| the governing board of New Mexico junior college that the need
|
0011| exists for the issuance of the bonds, four hundred thousand
|
0012| dollars ($400,000) is appropriated to the governing board of New
|
0013| Mexico junior college to plan, design and construct a western
|
0014| museum on the campus of the New Mexico junior college in Hobbs in
|
0015| Lea county.
|
0016| Section 22. NEW MEXICO MILITARY INSTITUTE--PURPOSE.--

0017| Pursuant to the provisions of Section 1 of this act, upon
|
0018| certification by the board of regents of New Mexico military
|
0019| institute that the need exists for the issuance of the bonds, two
|
0020| hundred thousand dollars ($200,000) is appropriated to the board
|
0021| of regents of New Mexico military institute to design and
|
0022| construct renovations to Wilson hall on the main campus of the
|
0023| New Mexico military institute in Chaves county.

0024| Section 23. NEW MEXICO STATE UNIVERSITY--PURPOSES.--

0025| Pursuant to the provisions of Section 1 of this act, upon

0016| Section 24. SAN JUAN COLLEGE--PURPOSE.--Pursuant to the

0017| provisions of Section 1 of this act, upon certification by the
|
0018| governing board of San Juan college that the need exists for the
|
0019| issuance of the bonds, four hundred thousand dollars ($400,000)
|
0020| is appropriated to the governing board of San Juan college to
|
0021| design and construct the health and human performance center at
|
0022| San Juan college in San Juan county.
|
0023| Section 25. UNIVERSITY OF NEW MEXICO--PURPOSES.--Pursuant
|
0024| to the provisions of Section 1 of this act, upon certification by
|
0025| the board of regents of the university of New Mexico that the
|

0002| are appropriated to the board of regents of the university of New
|
0003| Mexico for the following purposes:

0010| Section 26. PUBLIC SCHOOL CAPITAL OUTLAY FUND--PURPOSE.--

0011| Pursuant to the provisions of Section 1 of this act, upon
|
0012| certification by the public school capital outlay council that
|
0013| the need exists for the issuance of the bonds, two million
|
0014| dollars ($2,000,000) is appropriated to the public school capital
|
0015| outlay fund to be allocated by the public school capital outlay
|
0016| council to carry out the provisions of the Public School Capital
|
0017| Outlay Act. This appropriation shall not revert.
|
0018| Section 27. EMPLOYMENT SECURITY DEPARTMENT FUND--CAPITAL
|
0019| PROGRAM FUND--PURPOSES.--
|
0020| A. Six hundred six thousand six hundred dollars
|
0021| ($606,600) is appropriated from the employment security
|
0022| department fund to the capital program fund for expenditure in
|
0023| fiscal years 1998 through 2002 for the following purposes at the

0012| Section 28. GAME AND FISH BOND RETIREMENT FUND--DEPARTMENT

0013| OF GAME AND FISH--PURPOSE.--One million five hundred thousand

0014| dollars ($1,500,000) is appropriated from the game and fish bond
|
0015| retirement fund to the department of game and fish for
|
0016| expenditure in fiscal years 1998 through 2002 to plan, design,

0017| construct, furnish and equip a new headquarters facility in Santa

0018| Fe county. Any unexpended or unencumbered balance remaining at
|
0019| the end of fiscal year 2002 shall revert to the game and fish
|
0020| bond retirement fund.

0021| Section 29. GAME PROTECTION FUND--DEPARTMENT OF GAME AND

0022| FISH--PURPOSE.--One million five hundred thousand dollars

0023| ($1,500,000) is appropriated from the game protection fund to the

0024| department of game and fish for expenditure in fiscal years 1998
|
0025| through 2002 to plan, design, construct, furnish and equip a new

0012| appropriated to improve two and two-tenths miles of Torrance
|
0013| county road A049 between the intersection of that road and state

0014| road 41 and the Torrance county detention facility.

0015| Y. The following amounts are appropriated for

0016| expenditure in Valencia county:
|
0017| (1) fifty thousand dollars ($50,000) to surface
|
0018| and improve Maddox loop in Rio communities;
|
0019| (2) seventy-five thousand dollars ($75,000) to
|
0020| surface and improve the Manzano expressway extension;
|
0021| (3) seventy-five thousand dollars ($75,000) to
|
0022| perform drainage master plan projects in the city of Belen; and
|
0023| (4) one hundred fifty thousand dollars
|
0024| ($150,000) to widen and reconstruct Los Lentes road from Coronada
|
0025| street to Taylor road in Los Lunas.

- 63 -0001| Section 32. SEVERANCE TAX BONDS--STATE AGENCY ON AGING--
|
0002| CHANGE IN PURPOSE--APPROPRIATIONS.--The proceeds from the sale of
|
0003| severance tax bonds authorized pursuant to Subsection C of
|
0004| Section 2 of Chapter 4 of Laws 1996 (S.S.) for expanding the
|
0005| daycare area at the Barelas senior center shall not be expended
|
0006| for their original purpose but are reauthorized and appropriated
|
0007| to the state agency on aging in the following amounts for the
|
0008| following purposes:
|
0009| A. seventy-four thousand dollars ($74,000) for
|
0010| expansion and improvements to the Barelas senior multiservice
|
0011| center; and
|
0012| B. twenty-six thousand dollars ($26,000) for
|
0013| purchasing and equipping a fifteen-passenger van for the Atrisco
|
0014| mealsite program in Albuquerque in Bernalillo county.
|
0015| Section 33. SEVERANCE TAX BONDS--STATE AGENCY ON AGING--
|
0016| EXTENDING EXPENDITURE PERIOD.--The period of time in which the
|
0017| severance tax bond appropriation made pursuant to Subsection B of
|
0018| Section 4 of Chapter 148 of Laws 1994 for a senior citizen center
|
0019| at the Alamo chapter of the Navajo Nation in Socorro county may
|
0020| be expended shall be extended through fiscal year 1999. Any
|
0021| unexpended or unencumbered balance remaining at the end of fiscal
|
0022| year 1999 shall revert to the severance tax bonding fund.
|
0023| Section 34. SEVERANCE TAX BONDS--OFFICE OF CULTURAL
|
0024| AFFAIRS--EXPANDING THE PURPOSE--EXTENDING EXPENDITURE PERIOD.--
|
0025| The severance tax bond appropriation made pursuant to Subsection
|
- 64 -0001| A of Section 3 of Chapter 4 of Laws 1996 (S.S.) to construct El
|
0002| Camino Real state monument for the museum of New Mexico in
|
0003| Socorro county may also be expended for planning, designing and
|
0004| constructing El Camino Real state monument for the museum of New
|
0005| Mexico in Socorro county. The period of time in which this
|
0006| appropriation may be expended shall be extended through fiscal
|
0007| year 2002. Any unexpended or unencumbered balance remaining
|
0008| after fiscal year 2002 shall revert to the severance tax bonding
|
0009| fund.
|
0010| Section 35. SEVERANCE TAX BONDS--DEPARTMENT OF
|
0011| ENVIRONMENT--EXTENDING EXPENDITURE PERIOD.--The period of time in
|
0012| which the severance tax bond appropriation made pursuant to
|
0013| Subsection S of Section 10 of Chapter 148 of Laws 1994 to the
|
0014| department of environment for improvements to the wastewater
|
0015| treatment plant in Anthony in Dona Ana county may be expended
|
0016| shall be extended through fiscal year 2002. Any unexpended or
|
0017| unencumbered balance remaining at the end of fiscal year 2002
|
0018| shall revert to the severance tax bonding fund.
|
0019| Section 36. SEVERANCE TAX BONDS--DEPARTMENT OF FINANCE AND
|
0020| ADMINISTRATION--EXTENDING EXPENDITURE PERIOD.--The period of time
|
0021| in which the severance tax bond appropriation made pursuant to
|
0022| Subsection B of Section 12 of Chapter 222 of Laws 1995 for a
|
0023| modular building for court uses in Alamo in Socorro county may be
|
0024| expended shall be extended through fiscal year 2000. Any
|
0025| unexpended or unencumbered balance remaining at the end of fiscal
|
- 65 -0001| year 2000 shall revert to the severance tax bonding fund.
|
0002| Section 37. SEVERANCE TAX BONDS--DEPARTMENT OF FINANCE AND
|
0003| ADMINISTRATION--CHANGE IN PURPOSE--APPROPRIATION.--The
|
0004| appropriation of severance tax bond proceeds pursuant to
|
0005| Subsection JJJ of Section 5 of Chapter 4, Laws 1996 (S.S.) to the
|
0006| local government division of the department of finance and
|
0007| administration for the detoxification project in Taos in Taos
|
0008| county shall not be expended for that purpose but is reauthorized
|
0009| and appropriated for paving for the detoxification center.
|
0010| Section 38. SEVERANCE TAX BONDS--DEPARTMENT OF FINANCE AND
|
0011| ADMINISTRATION--EXTENDING CERTIFICATION PERIOD.--The period of
|
0012| time in which the local government division of the department of
|
0013| finance and administration has to certify the need for the
|
0014| issuance of severance tax bonds to complete the project pursuant
|
0015| to Subsection TT of Section 5 of Chapter 4 of Laws 1996 (S.S.) to
|
0016| design, construct or equip a multipurpose community center at El
|
0017| Cerro mission in Valencia county shall be extended to the end of
|
0018| fiscal year 1999.
|
0019| Section 39. SEVERANCE TAX BONDS--DEPARTMENT OF FINANCE AND
|
0020| ADMINISTRATION--CHANGES IN PURPOSE--APPROPRIATIONS.--
|
0021| A. The balance of the proceeds from severance tax
|
0022| bonds appropriated pursuant to Subsection NNNN of Section 9 of
|
0023| Chapter 148 of Laws 1994 for a primary health care facility in
|
0024| Pecos shall not be expended for its original purpose but is
|
0025| reauthorized and appropriated to the local government division of
|
- 66 -0001| the department of finance and administration to construct a
|
0002| municipal building in Pecos in San Miguel county.
|
0003| B. The balance of the proceeds from severance tax
|
0004| bonds appropriated pursuant to Subsection RRRRR of Section 5 of
|
0005| Chapter 4 of Laws 1996 (S.S.) for a building for the Pecos Valley
|
0006| medical center's ambulance service shall not be expended for its
|
0007| original purpose but is reauthorized and appropriated to the
|
0008| local government division of the department of finance and
|
0009| administration to construct a municipal building in Pecos in San
|
0010| Miguel county.
|
0011| Section 40. SEVERANCE TAX BONDS--DEPARTMENT OF FINANCE AND
|
0012| ADMINISTRATION--CHANGE IN PURPOSE--APPROPRIATION.--The balance of
|
0013| severance tax bonds appropriated to the local government division
|
0014| of the department of finance and administration pursuant to
|
0015| Subsection G of Section 5 of Chapter 4 of Laws 1996 (S.S.) for
|
0016| the purpose of improving or updating equipment for the Moriarty
|
0017| fire department located in Torrance county shall not be expended
|
0018| for its original purpose but is reauthorized and appropriated to
|
0019| the local government division for the purpose of improving or
|
0020| updating equipment for the fire department in northeast Torrance
|
0021| county.
|
0022| Section 41. SEVERANCE TAX BONDS--GENERAL SERVICES
|
0023| DEPARTMENT--EXPANDING PURPOSES AND EXTENDING EXPENDITURE
|
0024| PERIODS.--
|
0025| A. Notwithstanding the provisions of Laws 1996,
|
- 67 -0001| Chapter 14, Section 14, the period of time in which the
|
0002| appropriation from severance tax bond proceeds to the property
|
0003| control division of the general services department made in
|
0004| Subsection S of Section 14 of Chapter 367 of Laws 1993 may be
|
0005| expended shall be extended through fiscal year 2002 and the
|
0006| purpose expanded to repair and renovate buildings at Fort Stanton
|
0007| hospital located in Lincoln county. Any unexpended or
|
0008| unencumbered balance remaining from the proceeds of the bonds at
|
0009| the end of fiscal year 2002 shall revert to the severance tax
|
0010| bonding fund.
|
0011| B. Notwithstanding the provisions of Laws 1996,
|
0012| Chapter 14, Section 15, the period of time in which the
|
0013| appropriation from severance tax bond proceeds to the property
|
0014| control division of the general services department made in
|
0015| Subsection H of Section 13 of Chapter 148 of Laws 1994 may be
|
0016| expended shall be extended through fiscal year 2002 and the
|
0017| purpose expanded to repair and renovate buildings at Fort Stanton
|
0018| hospital located in Lincoln county. Any unexpended or
|
0019| unencumbered balance remaining from the proceeds of the bonds at
|
0020| the end of fiscal year 2002 shall revert to the severance tax
|
0021| bonding fund.
|
0022| C. Notwithstanding the provisions of Subsection D of
|
0023| Section 1 of Chapter 148 of Laws of 1994, the balance of the
|
0024| proceeds from the sale of severance tax bonds to the general
|
0025| services department pursuant to Subsection K of Section 13 of
|
- 68 -0001| Chapter 148 of Laws 1994 to construct, furnish and equip an
|
0002| expansion to the New Mexico law enforcement academy located in
|
0003| Santa Fe county may also be expended to resurface the track at
|
0004| the law enforcement academy. The period of time for expenditure
|
0005| of this appropriation is extended through fiscal year 1999. Any
|
0006| unexpended or unencumbered balance remaining at the end of fiscal
|
0007| year 1999 shall revert to the severance tax bonding fund.
|
0008| Section 42. SEVERANCE TAX BONDS--GENERAL SERVICES
|
0009| DEPARTMENT--CHANGE IN PURPOSE--APPROPRIATION.--Six hundred
|
0010| thirty-three thousand dollars ($633,000) of the balance of the
|
0011| proceeds from the sale of severance tax bonds authorized pursuant
|
0012| to Subsection D of Section 13 of Chapter 148 of Laws 1994 for a
|
0013| visitor, control and administration center and to improve
|
0014| security at the New Mexico boys' school shall not be expended for
|
0015| its original purpose but is reauthorized and appropriated to the
|
0016| general services department to plan, design or construct an
|
0017| animal shelter at the New Mexico boys' school in Springer in
|
0018| Colfax county.
|
0019| Section 43. SEVERANCE TAX BONDS--NEW MEXICO OFFICE OF
|
0020| INDIAN AFFAIRS--CHANGE IN PURPOSE--APPROPRIATION.--The balance of
|
0021| the proceeds from the sale of severance tax bonds appropriated to
|
0022| the New Mexico office of Indian affairs pursuant to Subsection E
|
0023| of Section 6 of Chapter 4 of Laws 1996 (S.S.) for the purpose of
|
0024| constructing infrastructure for a water treatment plant at the
|
0025| Navajo agricultural products industries hall not be expended for
|
- 69 -0001| its original purpose but is reauthorized and appropriated to the
|
0002| New Mexico office of Indian affairs for the purpose of planning,
|
0003| designing or site preparation for a water treatment plant at
|
0004| Navajo agricultural products industries located in San Juan
|
0005| county.
|
0006| Section 44. SEVERANCE TAX BONDS--NEW MEXICO OFFICE OF
|
0007| INDIAN AFFAIRS--EXPANSION IN PURPOSE--APPROPRIATION.--The balance
|
0008| of severance tax bonds authorized pursuant to Subsection B of
|
0009| Section 9 of Chapter 4 of Laws 1996 (S.S.) for a group home for
|
0010| disabled senior citizens at Tohatchi shall not be expended for
|
0011| its original purpose but is reauthorized and appropriated to the
|
0012| New Mexico office of Indian affairs to plan, design or construct
|
0013| a group home for disabled citizens at Tohatchi located in
|
0014| McKinley county.
|
0015| Section 45. SEVERANCE TAX BONDS--NEW MEXICO OFFICE OF
|
0016| INDIAN AFFAIRS--CLARIFYING PURPOSES AND EXTENDING EXPENDITURE
|
0017| PERIODS.--Notwithstanding the provisions of Subsections F through
|
0018| N of Section 16 of Chapter 148 of Laws 1994, the appropriations
|
0019| in those subsections from severance tax bond proceeds to the New
|
0020| Mexico office of Indian affairs for various capital outlay
|
0021| purposes for each of the head start programs in the communities
|
0022| of Coal Mine, Navajo, Rock Springs, Tsa-Ya-Toh, Crystal,
|
0023| Manuelito, Mexican Springs, Tohatchi and Twin Lakes located in
|
0024| McKinley and San Juan counties may be expended by each community
|
0025| for any or all of the purposes stated in the subsection
|
- 70 -0001| appropriating the proceeds to that community. The period of time
|
0002| for expenditure of these appropriations shall be extended through
|
0003| fiscal year 2001. Any unexpended or unencumbered balance
|
0004| remaining at the end of fiscal year 2001 shall revert to the
|
0005| severance tax bonding fund.
|
0006| Section 46. SEVERANCE TAX BONDS--STATE DEPARTMENT OF
|
0007| PUBLIC EDUCATION--CHANGE IN PURPOSE--APPROPRIATION.--The balance
|
0008| of severance tax bond proceeds appropriated pursuant to
|
0009| Subsection R of Section 11 of Chapter 113 of Laws 1992 for a
|
0010| pedestrian overpass across Isleta boulevard shall not be expended
|
0011| for that original purpose but is reauthorized and appropriated to
|
0012| the state department of public education for improvements to
|
0013| Harrison middle school athletic fields in southwest Albuquerque
|
0014| in Bernalillo county.
|
0015| Section 47. SEVERANCE TAX BONDS--NEW MEXICO STATE
|
0016| UNIVERSITY--CHANGE IN PURPOSE--APPROPRIATION.--The proceeds from
|
0017| the sale of severance tax bonds to the board of regents of New
|
0018| Mexico state university pursuant to Subsection A of Section 24 of
|
0019| Chapter 7 of Laws 1998 for infrastructure or renovations of aging
|
0020| facilities on the main campus of New Mexico state university in
|
0021| Dona Ana county shall not be expended for that purpose but shall
|
0022| be expended for renovation and improvements to Goddard hall.
|
0023| Section 48. SEVERANCE TAX BONDS--CHANGE IN PURPOSE--CHANGE
|
0024| IN AGENCY--APPROPRIATION.--The proceeds from the sale of
|
0025| severance tax bonds appropriated to the local government division
|
- 71 -0001| of the department of finance and administration to acquire land
|
0002| and construct a parking lot at the Roswell convention and civic
|
0003| center in Chaves county pursuant to Subsection KK of Section 9 of
|
0004| Chapter 7 of Laws 1998 shall not be expended for that purpose but
|
0005| are appropriated to the state highway and transportation
|
0006| department for street and drainage improvements on Atkinson
|
0007| avenue between Mescalero road and Berrendo road in Roswell in
|
0008| Chaves county.
|
0009| Section 49. GENERAL FUND--OFFICE OF CULTURAL AFFAIRS--
|
0010| EXTENDING EXPENDITURE PERIOD.--The period of time in which the
|
0011| general fund appropriation made pursuant to Subsection B of
|
0012| Section 24 of Chapter 4 of Laws 1996 (S.S.) to the office of
|
0013| cultural affairs for designing, constructing or equipping a
|
0014| living traditions education center at the museum of Indian arts
|
0015| and culture in Santa Fe county may be expended shall be extended
|
0016| through fiscal year 2000. Any unexpended or unencumbered balance
|
0017| remaining at the end of fiscal year 2000 shall revert to the
|
0018| general fund.
|
0019| Section 50. GENERAL FUND--DEPARTMENT OF ENVIRONMENT--
|
0020| EXTENDING EXPENDITURE PERIOD.--The period of time in which the
|
0021| general fund appropriations made pursuant to Subsections B, C, D,
|
0022| H, I and J of Section 33 of Chapter 4 of Laws 1996 (S.S.) to the
|
0023| department of environment for projects in the north valley of
|
0024| Albuquerque in Bernalillo county, Organ in Dona Ana county, Belen
|
0025| in Valencia county, Lake Valley in McKinley county, the south
|
- 72 -0001| valley of Albuquerque in Bernalillo county and Carrizozo in
|
0002| Lincoln county may be expended shall be extended through fiscal
|
0003| year 2002. Any unexpended or unencumbered balance remaining at
|
0004| the end of fiscal year 2002 shall revert to the general fund.
|
0005| Section 51. GENERAL FUND--DEPARTMENT OF FINANCE AND
|
0006| ADMINISTRATION--EXPANSION OF PURPOSE.--The balance of the general
|
0007| fund appropriation made pursuant to Subsection CCC of Section 24
|
0008| of Chapter 222 of Laws 1995 to relocate a historic building at
|
0009| the museum complex in Lovington may be expended for the purpose
|
0010| of site preparation or transportation costs to relocate or
|
0011| renovate historical buildings at the museum complex in Lovington
|
0012| in Lea county.
|
0013| Section 52. GENERAL FUND--DEPARTMENT OF FINANCE AND
|
0014| ADMINISTRATION--CHANGE IN PURPOSE--APPROPRIATION.--The balance of
|
0015| the general fund appropriation of fifty thousand dollars
|
0016| ($50,000) to the state department of public education pursuant to
|
0017| Subsection JJ of Section 33 of Chapter 222 of Laws 1995 for a
|
0018| study or plan of a Polk middle school swimming pool shall not be
|
0019| expended for its original purpose but is appropriated to the
|
0020| local government division of the department of finance and
|
0021| administration for planning and designing a swimming pool for the
|
0022| Los Padillas area in the south valley in Bernalillo county.
|
0023| Section 53. GENERAL FUND--DEPARTMENT OF FINANCE AND
|
0024| ADMINISTRATION--EXPANDING PURPOSE AND EXTENDING EXPENDITURE
|
0025| PERIOD--APPROPRIATION.--The balance of the proceeds from the
|
- 73 -0001| general fund appropriation made pursuant to Subsection LL of
|
0002| Section 21 of Chapter 4 of Laws 1996 (S.S.) for a youth center in
|
0003| Ruidoso is reauthorized and appropriated to the local government
|
0004| division of the department of finance and administration and may
|
0005| be expended to design and construct the youth center complex in
|
0006| Ruidoso, including fields, restrooms, concession stands, a
|
0007| recreation center, an aquatic center and other facilities related
|
0008| to the project in Lincoln county. The period of time for
|
0009| expenditure shall be extended through fiscal year 1999. Any
|
0010| unexpended or unencumbered balance remaining at the end of fiscal
|
0011| year 1999 shall revert to the general fund.
|
0012| Section 54. GENERAL FUND--DEPARTMENT OF FINANCE AND
|
0013| ADMINISTRATION--CHANGE AND EXPANSION IN PURPOSE--
|
0014| APPROPRIATIONS.--
|
0015| A. The balance of the general fund appropriation made
|
0016| pursuant to Subsection MMMM of Section 24 of Chapter 222 of Laws
|
0017| 1995 to the local government division of the department of
|
0018| finance and administration to design, build and equip a new
|
0019| volunteer fire department substation at Melody ranch near Indian
|
0020| Hills in Torrance county shall not be expended for its original
|
0021| purpose but is appropriated to the local government division to
|
0022| design, build and equip new volunteer fire department substations
|
0023| within Torrance county.
|
0024| B. The balance of the general fund appropriation made
|
0025| to the local government division of the department of finance and
|
- 74 -0001| administration pursuant to Subsection J of Section 21 of Chapter
|
0002| 4 of Laws 1996 (S.S.) for the purpose of acquiring new vehicles
|
0003| for the Torrance county sheriff's department shall not be
|
0004| expended for its original purpose but is appropriated to the
|
0005| local government division for the purpose of equipping new and
|
0006| existing vehicles, acquiring new vehicles and repairing existing
|
0007| vehicles for the Torrance county sheriff's department.
|
0008| C. The balance of the general fund appropriation made
|
0009| pursuant to Subsection VVVVV of Section 24 of Chapter 222 of Laws
|
0010| 1995 to renovate and remodel a community health clinic building
|
0011| in Mountainair may be expended for land acquisition,
|
0012| construction, renovation, remodeling and equipping the clinic
|
0013| building in Mountainair in Torrance county.
|
0014| Section 55. GENERAL FUND--STATE HIGHWAY AND TRANSPORTATION
|
0015| DEPARTMENT--CHANGING PURPOSE AND EXTENDING EXPENDITURE PERIOD--
|
0016| APPROPRIATION.--The general fund appropriation made pursuant to
|
0017| Subsection Q of Section 34 of Chapter 4 of Laws 1996 (S.S.) for a
|
0018| new road or a railroad crossing in Otero county shall not be
|
0019| expended for its original purpose but is appropriated to the
|
0020| state highway and transportation department for the purpose of
|
0021| installing lights, gates, belts and making other improvements to
|
0022| an existing crossing named Riata railroad crossing on Riata road
|
0023| located one mile south of Tularosa in Otero county. The period
|
0024| of time for expenditure of this appropriation shall be extended
|
0025| through fiscal year 1999. Any unexpended or unencumbered balance
|
- 75 -0001| remaining at the end of fiscal year 1999 shall revert to the
|
0002| general fund.
|
0003| Section 56. GENERAL FUND--NEW MEXICO OFFICE OF INDIAN
|
0004| AFFAIRS--CHANGE IN PURPOSE--APPROPRIATION.--The balance of the
|
0005| general fund appropriation made pursuant to Subsection V of
|
0006| Section 28 of Chapter 222 of Laws 1995 for a preschool building
|
0007| in Chichiltah shall not be expended for its original purpose but
|
0008| is appropriated to the New Mexico office of Indian affairs for a
|
0009| power line extension project or house wiring for the community of
|
0010| Chichiltah in McKinley county.
|
0011| Section 57. GENERAL FUND--MESA TECHNICAL COLLEGE--CHANGE
|
0012| IN PURPOSE--APPROPRIATION.--The balance of the general fund
|
0013| appropriation made to Mesa technical college pursuant to Laws
|
0014| 1995, Chapter 222, Section 42 to plan and design a child
|
0015| development facility at the college in Tucumcari in Quay county
|
0016| shall not be expended for its original purpose but is
|
0017| appropriated to the governing board of Mesa technical college for
|
0018| facility improvements at the college to comply with federal
|
0019| Americans with Disabilities Act of 1990 requirements.
|
0020| Section 58. PROJECT SCOPE--EXPENDITURES.--If an
|
0021| appropriation for a project authorized in this act is not
|
0022| sufficient to complete all the purposes specified, the
|
0023| appropriation may be expended for any portion of the purposes
|
0024| specified in the appropriation. Expenditures shall not be made
|
0025| for purposes other than those specified in the appropriation.
|
- 76 -0001| Section 59. ART IN PUBLIC PLACES.--Pursuant to Section
|
0002| 13-4A-4 NMSA 1978 and where applicable, the appropriations
|
0003| authorized in this act include one percent for the art in public
|
0004| places fund.
|
0005| Section 60. EMERGENCY.--It is necessary for the public
|
0006| peace, health and safety that this act take effect immediately.
