0011| PROPOSING AN AMENDMENT TO ARTICLE 4 OF THE CONSTITUTION OF NEW

0012| MEXICO TO LIMIT THE TERMS OF STATE LEGISLATORS.

0014| BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. It is proposed to amend Article 4, Section 4
|
0016| of the constitution of New Mexico to read:
|
0017| "Members of the legislature shall be elected as follows:
|
0018| [those senators from Bernalillo, Chaves, Curry, DeBaca, Grant,
|
0019| Lea, Lincoln, Luna, Sandoval, San Juan, San Miguel, Socorro,
|
0020| Taos, Torrance, Union and Valencia counties for a term of six
|
0021| years starting January 1, 1961, and after serving such terms
|
0022| shall be elected for a term of four years thereafter; those
|
0023| senators from all other counties for the terms] senators for
|
0024| terms of four years, and members of the house of
|
0025| representatives for [a term] terms of two years. [They]
|
0001| Excluding service in the legislature prior to the first
|
0002| session of the forty-fourth legislature, or an appointment to a
|
0003| vacant office, no legislator shall serve more than a total of
|
0004| four terms in the senate and eight terms in the house of
|
0005| representatives. Legislators shall be elected on the day
|
0006| provided by law for holding the general election of state
|
0007| officers or representatives in congress. If a vacancy occurs
|
0008| in the office of senator or [member of the house of
|
0009| representatives] representative, for any reason, the county
|
0010| commissioners of the county or counties wherein the vacancy
|
0011| occurs shall fill such vacancy by appointment.
|
0012| Such legislative appointments as provided in this section
|
0013| shall be for a term ending on December 31, subsequent to the
|
0014| next succeeding general election."
|
0015| Section 2. The amendment proposed by this resolution
|
0016| shall be submitted to the people for their approval or
|
0017| rejection at the next general election or at any special
|
0018| election prior to that date which may be called for that
|
0019| purpose.
