0011|     PROPOSING AN AMENDMENT TO THE CONSTITUTION OF NEW MEXICO BY
    |
0012|     ADDING A NEW ARTICLE 25 TO PLACE A LIMITATION ON STATE
    |
0013|     EXPENDITURES.

0015|     BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0016|          Section 1.  It is proposed to amend the constitution of
    |
0017|     New Mexico by adding a new Article 25, Section 1 to read: 
    |
0018|          "The rate of growth of appropriations shall not exceed the
    |
0019|     rate of growth of the United States department of labor bureau
    |
0020|     of labor statistics consumer price index for all-urban
    |
0021|     consumers."
    |
0022|          Section 2.     It is proposed to amend the constitution
    |
0023|     of New Mexico by adding a new Article 25, Section 2 to read:
    |
0024|          "The legislature may override the provisions of Section 1
    |
0025|     of this article by a two-thirds majority vote of those elected
    |
0001|     to the house of representatives and the senate.  In the event
    |
0002|     an override occurs during a regular sixty-day session of the
    |
0003|     legislature, the new rate of expenditure shall be used as the
    |
0004|     baseline in the regular session of the legislature in the
    |
0005|     following year.  Any increase in expenditures exceeding the
    |
0006|     index specified in Section 1 of this article shall expire at
    |
0007|     the end of the fiscal year in which the next general election
    |
0008|     following the increase occurs unless the people of the state
    |
0009|     vote for continuance of the increase in that general election.
    |
0010|          Section 3.  It is proposed to amend the constitution of
    |
0011|     New Mexico by adding a new Article 25, Section 3 to read:
    |
0012|          "Individual citizens of the state have standing to enforce
    |
0013|     the provisions of this article.  Any individual citizen of the
    |
0014|     state bringing suit to enforce this article shall be entitled
    |
0015|     to recover  attorney fees if the citizen bringing the suit
    |
0016|     prevails.  In addition to other remedies, a party enforcing the
    |
0017|     provisions of this article may seek injunctive relief,
    |
0018|     including but not limited to tax reduction."
    |
0019|          Section 4.  The amendment proposed by this resolution
    |
0020|     shall be submitted to the people for their approval or
    |
0021|     rejection at the next general election or at any special
    |
0022|     election prior to that date which may be called for that
    |
0023|     purpose.
