0011| PROPOSING AN AMENDMENT TO ARTICLE 8, SECTION 5 OF THE

0012| CONSTITUTION OF NEW MEXICO TO EXEMPT FROM TAXATION THE PROPERTY
|
0013| OF HONORABLY DISCHARGED VETERANS WITH TOTAL AND PERMANENT
|
0014| SERVICE-CONNECTED DISABILITIES.

0016| BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. It is proposed to amend Article 8, Section 5
|
0018| of the constitution of New Mexico to read:
|
0019| "A. The legislature shall exempt from taxation
|
0020| the property of each head of the family to the amount of two
|
0021| thousand dollars ($2,000) as follows: in 1989, the legislature
|
0022| shall exempt from taxation eight hundred dollars ($800), in
|
0023| 1991, one thousand four hundred dollars ($1,400) and beginning
|
0024| in 1993, two thousand dollars ($2,000).
|
0025| B. The legislature shall also exempt from
|
0001| taxation the property, including the community or joint
|
0002| property of husband and wife, of every honorably discharged
|
0003| member of the armed forces of the United States who served in
|
0004| such armed forces during any period in which they were or are
|
0005| engaged in armed conflict under orders of the president of the
|
0006| United States, and the widow or widower of every such honorably
|
0007| discharged member of the armed forces of the United States, in
|
0008| the sum of two thousand dollars ($2,000). Provided, that in
|
0009| every case where exemption is claimed on the ground of the
|
0010| claimant's having served with the armed forces of the United
|
0011| States as aforesaid, the burden of proving actual and bona fide
|
0012| ownership of such property upon which exemption is claimed,
|
0013| shall be upon the claimant.
|
0014| C. The legislature shall exempt from taxation the
|
0015| property, including the community or joint property of husband
|
0016| and wife, of every honorably discharged member of the armed
|
0017| forces of the United States who is one hundred percent
|
0018| permanently disabled and that disability is service-connected,
|
0019| and the widow or widower of every such person. The burden of
|
0020| proving actual and bona fide ownership of property upon which
|
0021| exemption is claimed under this subsection shall be upon the
|
0022| claimant."
|
0023| Section 2. The amendment proposed by this resolution
|
0024| shall be submitted to the people for their approval or
|
0025| rejection at the next general election or at any special
|
0001| election prior to that date which may be called for that
|
0002| purpose.
