0011| PROPOSING AN AMENDMENT TO ARTICLE 2, SECTION 10 OF THE

0012| CONSTITUTION OF NEW MEXICO TO REQUIRE THAT THE COURTS OF NEW
|
0013| MEXICO INTERPRET ITS PROVISIONS IN A MANNER CONSISTENT WITH THE
|
0014| PROVISIONS OF THE FOURTH AMENDMENT TO THE CONSTITUTION OF THE
|
0015| UNITED STATES.

0017| BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0018| Section 1. It is proposed to amend Article 2, Section 10
|
0019| of the constitution of New Mexico to read:
|
0020| "The people shall be secure in their persons, papers,
|
0021| homes and effects, from unreasonable searches and seizures, and
|
0022| no warrant to search any place, or seize any person or thing,
|
0023| shall issue without describing the place to be searched, or the
|
0024| persons or things to be seized, nor without a written showing
|
0025| of probable cause, supported by oath or affirmation. In
|
0001| criminal cases, the rights of defendants to be free from
|
0002| unreasonable searches and seizures pursuant to the provisions
|
0003| of this section shall be construed by the courts of New Mexico
|
0004| in a manner consistent with the provisions of the fourth
|
0005| amendment to the constitution of the United States. The
|
0006| provisions of this section shall not be construed by the courts
|
0007| of New Mexico to afford greater rights to criminal defendants
|
0008| to be free from unreasonable searches and seizures than the
|
0009| rights afforded to criminal defendants pursuant to the
|
0010| provisions of the fourth amendment to the constitution of the
|
0011| United States. The provisions of this section shall not be
|
0012| construed by the courts of New Mexico to afford greater rights
|
0013| to criminal defendants who are minors to be free from
|
0014| unreasonable searches and seizures than the rights afforded to
|
0015| criminal defendants who are minors pursuant to the provisions
|
0016| of the fourth amendment to the constitution of the United
|
0017| States."

0018| Section 2. The amendment proposed by this resolution
|
0019| shall be submitted to the people for their approval or
|
0020| rejection at the next general election or at any special
|
0021| election prior to that date which may be called for that
|
0022| purpose.
