0011| REQUESTING THE DEPARTMENT OF HEALTH TO CONVENE A WORK GROUP TO
|
0012| DEVELOP PROTOCOLS FOR REPORTING INCIDENTS AND ALLEGATIONS OF
|
0013| RESIDENT ABUSE IN LONG-TERM CARE FACILITIES.
|

0015| WHEREAS, long-term care facilities and employees of long-
|
0016| term care facilities are required to report incidents of abuse,
|
0017| neglect and exploitation of residents; and
|
0018| WHEREAS, reports must be made to local law enforcement
|
0019| offices and three different agencies of state government,
|
0020| including the health facility licensing and certification
|
0021| bureau of the public health division of the department of
|
0022| health, the protective services division of the children, youth
|
0023| and families department and the state agency on aging; and
|
0024| WHEREAS, the reporting obligations in some cases differ
|
0025| from agency to agency, and differ even within the same agency
|
0001| in different counties, and in other cases are duplicative; and
|
0002| WHEREAS, these multiple requirements lead to confusion on
|
0003| the part of the long-term care facility staff and can result in
|
0004| inconsistencies in reporting allegations and incidents; and
|
0005| WHEREAS, the protection of residents of long-term care
|
0006| facilities must be assured and a unified approach to reporting
|
0007| requirements would ensure more appropriate responses to reports
|
0008| of allegations and incidents of abuse;
|
0009| NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE
|
0010| STATE OF NEW MEXICO that the chief of the health facility
|
0011| licensing and certification bureau of the public health
|
0012| division of the department of health be requested to convene a
|
0013| work group that includes representation from the protective
|
0014| services division of the children, youth and families
|
0015| department, the state agency on aging and the New Mexico health
|
0016| care association to develop reporting protocols for incidents
|
0017| and allegations of resident abuse in long-term care facilities,
|
0018| which will:
|
0019| A. ensure that residents of long-term care
|
0020| facilities are protected by appropriate reporting of
|
0021| allegations and incidents of abuse, neglect or exploitation;
|
0022| B. reduce unnecessary or duplicative reporting
|
0023| requirements; and
|
0024| C. achieve consistent statewide application of
|
0025| reporting protocols and requirements; and
|
0001| BE IT FURTHER RESOLVED that copies of this memorial be
|
0002| sent to the secretary of health, the chief of the health
|
0003| facility licensing and certification bureau of the public
|
0004| health division of the department of health, the secretary of
|
0005| children, youth and families, the director of the protective
|
0006| services division of the children, youth and families
|
0007| department, the director of the state agency on aging and the
|
0008| executive director of the New Mexico health care association.
