|
0011| REQUESTING THAT STATE AGENCIES, POLITICAL SUBDIVISIONS OF THE
|
0012| STATE AND OTHER ENTITIES WHOSE AUTHORITY PERMITS THE ADOPTION
|
0013| AND IMPLEMENTATION OF REGULATIONS TO CONSIDER, EVALUATE AND
|
0014| AVOID UNNECESSARY IMPACTS AND EFFECTS ON THE PRIVATE PROPERTY
|
0015| RIGHTS OF NEW MEXICO RESIDENTS.
|

0017| WHEREAS, government regulation may and does invade and
|
0018| restrict the lives and fortunes of the residents of this state
|
0019| by reducing the value and uses of private property; and
|
0020| WHEREAS, rights inherent in and associated with the
|
0021| ownership of private property are constitutionally protected by
|
0022| the fourteenth amendment to the United States constitution as
|
0023| well as by Article 2, Section 20 of the constitution of New
|
0024| Mexico, which reads: "[p]rivate property shall not be taken or
|
0025| damaged for public use without just compensation"; and
|
0001| WHEREAS, agencies of government, state, municipal, county
|
0002| and other special or district agencies as well as governing
|
0003| boards of municipal and county governments have been granted
|
0004| authority by law to enact and implement regulations to govern
|
0005| the procedures, process and substance of their statutory
|
0006| authority; and
|
0007| WHEREAS, government action in enacting and implementing
|
0008| regulations, although intended to be done in the public
|
0009| interest and for the public welfare, often may and does
|
0010| infringe on the rights of private property ownership by
|
0011| reducing the value, limiting the use of or otherwise adversely
|
0012| impacting privately owned property of New Mexico residents; and
|
0013| WHEREAS, regulations should be enacted and implemented to
|
0014| advance only legitimate government interests, without
|
0015| infringing upon private property ownership; and
|
0016| WHEREAS, protection of private property ownership is an
|
0017| appropriate public interest and as a responsibility of
|
0018| government, at all levels, should be considered in any
|
0019| enactment of regulations; and
|
0020| WHEREAS, avoidance of regulations that result in an
|
0021| inadvertent negative impact upon private property is a goal to
|
0022| be achieved by all agencies at all levels of government;
|
0023| NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE
|
0024| STATE OF NEW MEXICO that all agencies of government, including
|
0025| state, municipal, county and other special or district
|
0001| agencies, be encouraged to enact only those regulations that to
|
0002| the most limited extent possible achieve legitimate
|
0003| governmental interests sought by the agency, yet do not
|
0004| unnecessarily reduce the value of private property or otherwise
|
0005| infringe upon its ownership in this state; and
|
0006| BE IT FURTHER RESOLVED that copies of this memorial be
|
0007| transmitted to the governor for distribution to all state
|
0008| government agencies, boards, commissions, committees, task
|
0009| forces and offices; and to all municipal and county governments
|
0010| in the state for distribution to each of their respective
|
0011| agencies.
