0011| REQUESTING THAT THE HUMAN SERVICES DEPARTMENT ENGAGE IN A
|
0012| BROAD- BASED PROCESS OF REVIEW, WITH FULL PUBLIC INVOLVEMENT,
|
0013| OF THE PROPOSED MEDICAID MANAGED CARE PLAN BEFORE IMPLEMENTING
|
0014| THE PLAN.
|

|
0016| WHEREAS, the human services department has submitted a
|
0017| waiver request to the federal government proposing major
|
0018| changes to the New Mexico medicaid program; and
|
0019| WHEREAS, the department has simultaneously released a
|
0020| request for proposal seeking contractors to provide services to
|
0021| the medicaid population under a capitated arrangement and plans
|
0022| implementation of the contract as early as February 1997; and
|
0023| WHEREAS, the proposed changes will entail substantially
|
0024| different management and administration of a very large and
|
0025| complex program and potentially put at risk the care medicaid
|
0001| recipients are currently receiving as well as the fiscal
|
0002| stability of the program; and
|
0003| WHEREAS, the department has reported that serious current
|
0004| and projected shortfalls exist in the funding of medicaid that
|
0005| will require additional legislative appropriations; and
|
0006| WHEREAS, the United States congress is expected to address
|
0007| reform of the medicaid program and reduce the rate of growth,
|
0008| which will limit the amount of federal dollars for New Mexico's
|
0009| medicaid program; and
|
0010| WHEREAS, the legislature and the general public have had
|
0011| inadequate exposure to the details of the medicaid managed care
|
0012| proposal and insufficient opportunity to evaluate the effect of
|
0013| the proposed changes on the beneficiary population or the
|
0014| potential for cost savings; and
|
0015| WHEREAS, the state executive and legislative branches
|
0016| share responsibility for assuring adequate health care coverage
|
0017| for the vulnerable and poor who make up the medicaid population
|
0018| in New Mexico as well as assuring the fiscal viability of the
|
0019| medicaid program; and
|
0020| WHEREAS, a review of the proposal to convert the medicaid
|
0021| program to a capitated, managed care program needs to include a
|
0022| full opportunity for broad public input prior to implementation
|
0023| of the program; and
|
0024| WHEREAS, the legislature should be given the opportunity
|
0025| to review fully significant changes in covered services or
|
0001| eligibility before the human services department implements
|
0002| revisions to the medicaid program;
|
0003| NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE
|
0004| STATE OF NEW MEXICO that the human services department, in
|
0005| consultation with other state agencies using medicaid funds,
|
0006| engage in a full review of the proposed medicaid managed care
|
0007| plan before implementing the plan, including:
|
0008| A. the development, through a broad-based public
|
0009| process of a consensus on values to guide medicaid spending,
|
0010| resource allocation and managed care principles;
|
0011| B. an analysis of the impact on other health
|
0012| services and on the full medicaid program of the proposed
|
0013| changes, including:
|
0014| (1) the costs incurred by the state, county
|
0015| indigent funds and private insurance providers and
|
0016| policyholders;
|
0017| (2) the costs of uncompensated care incurred
|
0018| by providers;
|
0019| (3) the effect on the existing network of
|
0020| providers and the infrastructure of health services in rural
|
0021| New Mexico; and
|
0022| (4) the care received by persons affected by
|
0023| proposed changes, including the care received by special needs
|
0024| populations and persons with terminal or progressive illnesses;
|
0025| C. full consideration of whether the program could
|
0001| reduce costs by entering into contracts for medicaid managed
|
0002| care to cover separate geographic regions in the state, rather
|
0003| than on a complete statewide basis;
|
0004| D. the development and use of a public review
|
0005| process that includes a series of public hearings and seeks
|
0006| testimony and information from a wide range of interested
|
0007| persons, including legislative and executive representatives,
|
0008| advocates for senior citizens, handicapped persons, mental
|
0009| health consumers, low-income individuals and medicaid
|
0010| recipients and providers or potential providers of services for
|
0011| the medicaid program;
|
0012| E. the use of committees or advisory groups as
|
0013| deemed necessary or appropriate to conduct a review of the
|
0014| medicaid managed care proposal for the purpose of responding to
|
0015| proposed changes and making recommendations to the human
|
0016| services department, provided that the membership of any
|
0017| committee reflect the ethnic, economic and geographic diversity
|
0018| of New Mexico; and
|
0019| F. the allowance of additional and sufficient time
|
0020| for full participation of the public to respond to the proposed
|
0021| medicaid managed care plan and increased time prior to
|
0022| implementation of the contract for medicaid managed care; and
|
0023| BE IT FURTHER RESOLVED that the human services department
|
0024| consider and incorporate, where appropriate, the opinions
|
0025| expressed in the public review process, as well as the
|
0001| recommendations of committees and advisory groups prior to
|
0002| implementing the plan; and
|
0003| BE IT FURTHER RESOLVED that the human services department
|
0004| present a progress report to the appropriate interim
|
0005| legislative committees by September 1, 1997 and that the
|
0006| proposed final findings and conclusions of the human services
|
0007| department be reported to the appropriate interim legislative
|
0008| committees before making final revisions and implementing the
|
0009| plan; and
|
0010| BE IT FURTHER RESOLVED that the waiver request to the
|
0011| federal government proposing major changes to the New Mexico
|
0012| medicaid program be withdrawn or denied by the responsible
|
0013| federal authorities until a full public review process is
|
0014| completed; and
|
0015| BE IT FURTHER RESOLVED that a copy of this memorial be
|
0016| sent to the secretary of human services, the governor, the
|
0017| secretary of the United States department of health and human
|
0018| services and the administrator of the federal health care
|
0019| financing administration.
