0011| ENCOURAGING THE NEW MEXICO LIVESTOCK BOARD TO WORK CLOSELY WITH
|
0012| THE NAVAJO NATION TO RESOLVE ISSUES OF LIVESTOCK JURISDICTION
|
0013| AND CONTROL.
|

0015| WHEREAS, the New Mexico livestock board has established
|
0016| methods of inspection and determination of ownership of
|
0017| livestock transported and sold in the state; and
|
0018| WHEREAS, the Navajo nation department of resource
|
0019| enforcement enforces mandates established by the nation to
|
0020| protect and preserve the natural resources and safeguard
|
0021| livestock property of its people; and
|
0022| WHEREAS, the state maintains a brand book that contains
|
0023| all the brands issued in the state and provides laminated brand
|
0024| cards that are used by owners at the time of sale of livestock
|
0025| to prove ownership of brand; and
|
0001| WHEREAS, the Navajo nation has its own brand system in
|
0002| place, with all Navajo livestock being marked with a "bar N"
|
0003| brand; and
|
0004| WHEREAS, the Navajo nation recognizes state brands and a
|
0005| majority of Navajo residents in the checkerboard area use state
|
0006| brands or lease state, United States bureau of land management
|
0007| or Navajo lands, thus contributing revenue to the state through
|
0008| the fees they pay; and
|
0009| WHEREAS, enforcement and jurisdictional problems exist,
|
0010| especially in the checkerboard area, due to confusing land
|
0011| status boundaries, established grazing boundaries and fence
|
0012| maintenance, allowing livestock to inadvertently trespass onto
|
0013| adjoining land; and
|
0014| WHEREAS, owners of livestock in the checkerboard area
|
0015| often transport animals directly to auction without going
|
0016| through Navajo inspection, and New Mexico livestock board
|
0017| inspectors do not have jurisdiction on Navajo lands and do not
|
0018| write up an inspection without a Navajo release; and
|
0019| WHEREAS, the Navajo nation and its department of resource
|
0020| enforcement are faced with the problem of limited manpower; and
|
0021| WHEREAS, although the Navajo nation and the New Mexico
|
0022| livestock board often work together to resolve issues of
|
0023| livestock control and jurisdiction, there is no memorandum of
|
0024| understanding in place between the two; and
|
0025| WHEREAS, it is apparent that there is a definite need for
|
0001| all entities involved, the United States bureau of land
|
0002| management, the Navajo nation and the New Mexico livestock
|
0003| board, to join together to identify and resolve problems;
|
0004| NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE
|
0005| STATE OF NEW MEXICO that the New Mexico livestock board and the
|
0006| Navajo nation be encouraged to develop a strong working
|
0007| relationship in which they exchange their current procedures
|
0008| and discuss ways in which to resolve issues of livestock
|
0009| jurisdiction and control to reduce livestock theft; and
|
0010| BE IT FURTHER RESOLVED that copies of this memorial be
|
0011| sent to the director of the New Mexico livestock board, the
|
0012| director of the Navajo nation department of resource
|
0013| enforcement and the United States bureau of land management.
