Section 1-19-34.5 NMSA 1978 (being Laws 1995, | 0019| Chapter 153, Section 18) is amended to read: | 0020| "1-19-34.5. PRESUMPTIONS--CIVIL ACTION.--[A.] For | 0021| purposes of a civil action, it shall be presumed that a public | 0022| official or a candidate for public office subject to the | 0023| Campaign Reporting Act has authorized and approved each | 0024| solicitation for campaign contributions made by his campaign | 0025| committee or a person authorized by the candidate to solicit | 0001| campaign contributions on his behalf. | 0002| [B. For purposes of a civil action, it shall be | 0003| presumed that a candidate who seeks election to a regulatory | 0004| office, as described in Section 1-19-34.2 NMSA 1978, has | 0005| advised his campaign committee and all persons authorized by | 0006| the candidate to solicit campaign contributions on his behalf | 0007| that it is unlawful to solicit contributions from an entity or | 0008| its officers or employees or a person that is directly | 0009| regulated by the office the candidate seeks.]" | 0010| Section 2.
