    |
0012|     RELATING TO LAW ENFORCEMENT; ESTABLISHING CERTAIN PROCEDURES
    |
0013|     FOR OPERATIONS CONDUCTED BY SPECIAL WEAPONS AND TACTICAL UNITS.

0015|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0016|          Section 1.  SPECIAL WEAPONS AND TACTICAL UNITS--UNIFORMS.-
    |
0017|     -

0018|               A.  A law enforcement officer who participates in
    |
0019|     operations conducted by special weapons and tactical units
    |
0020|     shall wear a standard service uniform with standard
    |
0021|     identification or a special raid uniform that clearly
    |
0022|     identifies the officer's affiliation with a local or state law
    |
0023|     enforcement agency.  A special raid uniform shall identify the
    |
0024|     officer's affiliation on the front outermost layer of the
    |
0025|     uniform in letters that are not smaller than five inches in
    |
0001|     height.   
    |
0002|               B.  A law enforcement officer who participates in
    |
0003|     operations conducted by special weapons and tactical units may
    |
0004|     wear a ski mask, hood or any other apparel that conceals his
    |
0005|     facial features when tear gas, diversion devices or diversion
    |
0006|     tactics might be used during an operation.
    |
0007|               C.  The provisions of this section shall not be
    |
0008|     interpreted to limit a law enforcement officer's discretion to
    |
0009|     use camouflage clothing or any other apparel as a tactic to
    |
0010|     make an entry or make an arrest when there are circumstances
    |
0011|     attendant to the entry or arrest that place the officer's life
    |
0012|     at risk.
    |
0013|               D.  A law enforcement officer who is attached to or
    |
0014|     affiliated with a special weapons and tactical unit shall
    |
0015|     acquire forty hours of tactical training each fiscal year.  A
    |
0016|     law enforcement officer shall not participate in any operations
    |
0017|     conducted by a special weapons or tactical unit if he has not
    |
0018|     acquired the required amount of tactical training in any fiscal
    |
0019|     year.          
    |
0020|          Section 2.  EFFECTIVE DATE.--The effective date of the
    |
0021|     provisions of this act is July 1, 1997.
