0016|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0017|          Section 1.  Section 7-38-81 NMSA 1978 (being Laws 1973,
    |
0018|     Chapter 258, Section 121) is amended to read:
    |
0019|          "7-38-81.  LIMITATION ON ACTIONS FOR COLLECTION OF

0020|     PROPERTY TAXES--PRESUMPTION OF PAYMENT <s>[OF PROPERTY TAXES

<s></s>0021| <s>    AFTER TEN YEARS]</s>.--
    |
0022|               A.  Property may not be sold and proceedings may not
    |
0023|     be initiated for the collection of:
    |
0024|                    <u>(1)</u>  property taxes <u>on real property</u> that
    |
0025|     have been delinquent for more than ten years; <u>or
</u>    |
<u></u>0001| <u>                   (2)  property taxes on personal property that
</u>    |
<u></u>0002| <u>    have been delinquent for more than three years.</u>
    |
0003|               B.  Property that has not been included on a
    |
0004|     property tax schedule may not be subjected to the imposition of
    |
0005|     property taxes: 
    |
0006|                    <u>(1)  in the case of real property</u>, for more
    |
0007|     than ten tax years immediately preceding the date of its entry
    |
0008|     on the property tax schedule; <u>and
</u>    |
<u></u>0009| <u>                   (2)  in the case of personal property, for more
</u>    |
<u></u>0010| <u>    than three tax years immediately preceding the date of its
</u>    |
<u></u>0011| <u>    entry on the property tax schedule</u>.
    |
0012|               C.  Property taxes <u>on real property</u> that have been
    |
0013|     delinquent for more than ten years, together with any penalties
    |
0014|     and interest, are presumed to have been paid. <u>Property taxes
</u>    |
<u></u>0015| <u>    on personal property that have been delinquent for more than
</u>    |
<u></u>0016| <u>    three years, together with any penalties and interest, are
</u>    |
<u></u>0017| <u>    presumed to have been paid</u>.  The county treasurer shall
    |
0018|     indicate on the property tax schedule that all such property
    |
0019|     taxes and any penalties and interest have been "presumed paid
    |
0020|     by act of the legislature"."
