0011| RELATING TO LAW ENFORCEMENT JURISDICTION; CREATING A STATE-
|
0012| TRIBAL LAW ENFORCEMENT TASK FORCE; MAKING AN APPROPRIATION;
|
0013| DECLARING AN EMERGENCY.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. TASK FORCE CREATED--MEMBERSHIP--DUTIES.--
|
0017| A. A "state-tribal law enforcement task force" is
|
0018| created, consisting of the chief of the New Mexico state
|
0019| police, representatives of every tribal law enforcement agency
|
0020| in New Mexico that chooses to participate; representatives of
|
0021| the law enforcement agency of every political subdivision of
|
0022| the state that borders a New Mexico Native American
|
0023| jurisdiction; representatives of any state department or agency
|
0024| that has employees designated as New Mexico peace officers that
|
0025| regularly interact with tribal law enforcement agencies; or
|
0001| designees of any of them; a member of the judiciary or its
|
0002| designee appointed by the chief justice of the New Mexico
|
0003| supreme court; two members of the house of representatives and
|
0004| two members of the senate appointed by the legislative council.
|
0005| The task force shall be co-chaired by a representative chosen
|
0006| from and elected by the New Mexico law enforcement members and
|
0007| a representative of the tribal law enforcement representatives,
|
0008| chosen from and elected by their task force members.
|
0009| Representatives of various federal law enforcement agencies and
|
0010| departments and agencies that regularly interact with tribal
|
0011| officials and law enforcement officers shall be invited to
|
0012| participate in the task force meetings. Staff support shall be
|
0013| provided by the department of public safety.
|
0014| B. The task force, at its organizational meeting,
|
0015| shall hold the elections required in Subsection A of this
|
0016| section, and shall discuss and list all matters of
|
0017| jurisdictional concern of any of those entities represented,
|
0018| including: enforcement of another jurisdiction's laws and
|
0019| regulations; costs of sharing joint or mutual responsibilities
|
0020| and supplies; communications issues; detention and transport
|
0021| issues; and other matters chosen by the task force. The task
|
0022| force shall study these issues and make a preliminary report to
|
0023| the legislative finance committee and any other appropriate
|
0024| interim legislative committee at their respective October 1997
|
0025| meetings and present a full report, together with
|
0001| recommendations for legislation, to the same committees and to
|
0002| the governor in October 1998.
|
0003| Section 2. APPROPRIATION.--Fifty thousand dollars
|
0004| ($50,000) is appropriated from the general fund to the
|
0005| department of public safety for expenditure in fiscal years
|
0006| 1997 and 1998 for the purpose of providing staff support to the
|
0007| state-tribal law enforcement task force. Any unexpended or
|
0008| unencumbered balance remaining at the end of fiscal year 1998
|
0009| shall revert to the general fund.
|
0010| Section 3. EMERGENCY.--It is necessary for the public
|
0011| peace, health and safety that this act take effect immediately.
|
