0011|     RELATING TO HEALTH CARE; REQUIRING MAMMOGRAMS FOR MEDICAID

0012|     RECIPIENTS TO CONFORM TO CERTAIN STANDARDS; ENACTING A NEW

0013|     SECTION OF THE PUBLIC ASSISTANCE ACT.

0015|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0016|          Section 1.  A new section of the Public Assistance Act is
    |
0017|     enacted to read:
    |
0018|          "[<u>NEW MATERIAL</u>]  MAMMOGRAMS FOR MEDICAID RECIPIENTS.--In
    |
0019|     providing coverage for mammograms under the medicaid program,
    |
0020|     the department shall ensure that:
    |
0021|               A.  the solicitation of patients for mammograms
    |
0022|     shall be determined by the department after taking into
    |
0023|     consideration the recommendations of nationally recognized
    |
0024|     medical organizations; and
    |
0025|               B.  the payment that shall be made on behalf of the
    |
0001|     medicaid program for a mammogram of a medicaid recipient shall
    |
0002|     be consistent with and not exceed the usual and customary
    |
0003|     charge that reflects the reasonable fair market value of the
    |
0004|     cost of a mammogram."
