ARAGON | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| AN ACT | 0011| RELATING TO HEALTH; PROVIDING FOR IMPLEMENTATION OF A HEALTH | 0012| CARE DATA SYSTEM; CREATING A BOARD; PROVIDING POWERS AND | 0013| DUTIES; MAKING AN APPROPRIATION. | 0014| | 0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0016| Section 1. HEALTH CARE DATA BOARD--CREATED--POWERS AND | 0017| DUTIES.-- | 0018| A. The "health care data board" is created. The | 0019| board shall be composed of one representative of: | 0020| (1) the New Mexico health policy commission, | 0021| appointed by the chairman of the commission; | 0022| (2) the department of health, appointed by the | 0023| secretary of health; | 0024| (3) the human services department, appointed | 0025| by the secretary of human services; | 0001| (4) the department of insurance, appointed by | 0002| the chairman of the state corporation commission; | 0003| (5) the workers' compensation administration, | 0004| appointed by the director of the administration; | 0005| (6) the children, youth and families | 0006| department, appointed by the secretary of children, youth and | 0007| families; | 0008| (7) the New Mexico hospital association, | 0009| appointed by the director of the association; | 0010| (8) health maintenance organizations, | 0011| appointed by the governor; | 0012| (9) health insurers, appointed by the | 0013| governor; | 0014| (10) the primary care association, appointed | 0015| by the director of the association; | 0016| (11) the New Mexico nursing home association, | 0017| appointed by the director of the association; and | 0018| (12) the chief information officer, who shall | 0019| be the nonvoting chairman. | 0020| B. The board shall begin implementation and | 0021| management of a common health care data system. The board | 0022| shall: | 0023| (1) specify formats for electronic data | 0024| interchange of health data between private and public health | 0025| care organizations in the state using federal standards where | 0001| appropriate; | 0002| (2) develop a high-level data architecture for | 0003| health information in the state; and | 0004| (3) begin development of a data system for | 0005| secure exchange of electronic data among health organizations. | 0006| C. Members of the board who are not state employees | 0007| or otherwise reimbursed for expenses may receive per diem and | 0008| mileage pursuant to the Per Diem and Mileage Act. | 0009| D. Staff for the board shall be furnished by the | 0010| office on information and communication management, the New | 0011| Mexico health policy commission and other state agencies as | 0012| requested. | 0013| E. The board shall report quarterly to the New | 0014| Mexico health policy commission, the appropriate legislative | 0015| committees and the health information alliance. | 0016| F. The board shall function until July 1, 1999. | 0017| Section 2. APPROPRIATION.--Two hundred fifty thousand | 0018| dollars ($250,000) is appropriated from the general fund to the | 0019| office on information and communication management for | 0020| expenditure in fiscal years 1998 and 1999 to implement the | 0021| health care data system. Any unexpended or unencumbered | 0022| balance remaining at the end of fiscal year 1999 shall revert | 0023| to the general fund. | 0024| Section 3. DELAYED REPEAL.--This act is repealed | 0025| effective July 1, 1999. | 0001| Section 4. EFFECTIVE DATE.--The effective date of the | 0002| provisions of this act is July 1, 1997. | 0003|  |
