0011|     RELATING TO RADIO COMMUNICATIONS; PROVIDING FOR LEASE OF EXCESS

0012|     CAPACITY ON THE STATE-OWNED RADIO SYSTEM; ESTABLISHING

0013|     REQUIREMENTS AND LIMITATIONS; DECLARING AN EMERGENCY.

0015|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0016|          Section 1.  A new Section 15-2-2.1 NMSA 1978 is enacted to
    |
0017|     read:
    |
0018|          "15-2-2.1.  [<u>NEW MATERIAL</u>]  LEASE OF RADIO
    |
0019|     COMMUNICATIONS NETWORK--CONDITIONS AND REQUIREMENTS.--In
    |
0020|     exercising supervisory control pursuant to Section 15-2-2 NMSA
    |
0021|     1978, the radio communications bureau of the communications
    |
0022|     division of the general services department may lease to a
    |
0023|     private entity excess capacity on its radio communications
    |
0024|     property, including buildings, towers or antennas, provided
    |
0025|     that:
    |
0001|               A.  the lease conforms with competitive procurement
    |
0002|     requirements of the Procurement Code;
    |
0003|               B.  the lease is for an equal value exchange of
    |
0004|     money or property;
    |
0005|               C.  the secretary of general services certifies that
    |
0006|     the excess capacity will be available for at least the duration
    |
0007|     of the lease; and
    |
0008|               D.  if the lease exceeds ten years, the lease is
    |
0009|     first approved by the state board of finance."
    |
0010|          Section 2.  EMERGENCY.--It is necessary for the public
    |
0011|     peace, health and safety that this act take effect immediately.
