0011| RELATING TO BARBERS AND COSMETOLOGISTS; AMENDING AND REPEALING
|
0012| CERTAIN SECTIONS OF THE NMSA 1978.
|

|
0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. Section 61-17A-2 NMSA 1978 (being Laws 1993,
|
0016| Chapter 171, Section 2) is amended to read:
|
0017| "61-17A-2. DEFINITIONS.--As used in the Barbers and
|
0018| Cosmetologists Act:
|
0019| A. "barber" means a person, other than a student,
|
0020| who for compensation engages in barbering;
|
0021| B. "board" means the board of barbers and
|
0022| cosmetologists;
|
0023| C. "cosmetologist" means a person, other than a
|
0024| student, who for compensation engages in cosmetology;
|
0025| D. "electrologist" means a person, other than a
|
0001| student, who for compensation removes hair from or destroys
|
0002| hair on the human body through the use of an electric current
|
0003| applied to the body with a needle-shaped electrode or probe;
|
0004| E. "enterprise" means a business venture, firm or
|
0005| organization;
|
0006| [E.] F. "establishment" means an immobile
|
0007| beauty shop, barber shop, electrology clinic, salon or similar
|
0008| place of business in which cosmetology, barbering or
|
0009| electrolysis is performed;
|
0010| [F.] G. "esthetician" means a person, other
|
0011| than a student, who for compensation:
|
0012| (1) uses cosmetic preparations, including
|
0013| makeup applications, antiseptics, powders, oils, clays or
|
0014| creams [or massaging, cleansing, stimulating or manipulating]
|
0015| for the purpose of preserving the health and beauty of the
|
0016| skin and body;
|
0017| (2) massages, cleans, stimulates or
|
0018| manipulates the skin for the purpose of preserving the health
|
0019| and beauty of the skin and body; or [performing similar work]
|
0020| (3) performs activities similar to the
|
0021| activities described in Paragraph (1) or (2) of this
|
0022| subsection on any part of the body of a person;
|
0023| [G.] H. "manicurist-pedicurist" means a person,
|
0024| other than a student, who for compensation performs work on
|
0025| the nails of a person and applies nail extensions or products
|
0001| to the nails for the purpose of strengthening or preserving the
|
0002| health and beauty of the hands or feet; [and]
|
0003| I. "sanitation" means the maintenance of sanitary
|
0004| conditions to promote hygiene and the prevention of disease
|
0005| through the use of chemical agents or products;
|
0006| [H.] J. "school" means a public or private
|
0007| instructional facility approved by the board that teaches
|
0008| cosmetology or barbering; and
|
0009| K. "student" means a person enrolled in a school
|
0010| to learn or be trained in cosmetology, barbering or
|
0011| electrolysis."
|
0012| Section 2. Section 61-17A-5 NMSA 1978 (being Laws 1993,
|
0013| Chapter 171, Section 5) is amended to read:
|
0014| "61-17A-5. LICENSE REQUIRED [CERTIFICATION REQUIRED].--
|
0015| A. Unless licensed pursuant to the Barbers and
|
0016| Cosmetologists Act or exempted from the provisions of that act,
|
0017| no person shall practice barbering or cosmetology for
|
0018| compensation either directly or indirectly.
|
0019| B. Unless licensed pursuant to the Barbers and
|
0020| Cosmetologists Act, no person shall operate a school or
|
0021| establishment for compensation.
|
0022| C. Unless licensed pursuant to the Barbers and
|
0023| Cosmetologists Act or exempted from the provisions of that act,
|
0024| no person shall teach barbering, cosmetology or electrology for
|
0025| compensation.
|
0001| D. Unless [certified] licensed by the board
|
0002| pursuant to the Barbers and Cosmetologists Act, no person shall
|
0003| practice as a manicurist-pedicurist, esthetician or
|
0004| electrologist for compensation."
|
0005| Section 3. Section 61-17A-6 NMSA 1978 (being Laws 1993,
|
0006| Chapter 171, Section 6) is amended to read:
|
0007| "61-17A-6. BOARD CREATED--MEMBERSHIP.--
|
0008| A. The "board of barbers and cosmetologists" is
|
0009| created. The board shall be administratively attached to the
|
0010| regulation and licensing department. The board shall consist
|
0011| of nine members appointed by the governor. Members shall serve
|
0012| three-year terms; provided that at the time of initial
|
0013| appointment, the governor shall appoint members to abbreviated
|
0014| terms to allow staggering of subsequent appointments.
|
0015| Vacancies shall be filled in the manner of the original
|
0016| appointment.
|
0017| B. Of the nine members of the board, five shall be
|
0018| licensed pursuant to the Barbers and Cosmetologists Act and
|
0019| shall have at least five years' practical experience in their
|
0020| respective occupations. Of those five, two members shall be
|
0021| licensed barbers, two members shall be licensed cosmetologists
|
0022| and one member shall represent school owners. The remaining
|
0023| four members shall be public members. Neither the public
|
0024| members nor their spouses shall have ever been licensed [or
|
0025| certified] pursuant to the provisions of the Barbers and
|
0001| Cosmetologists Act or similar prior legislation or have a
|
0002| financial interest in a school or establishment.
|
0003| C. Members of the board shall be reimbursed
|
0004| pursuant to the Per Diem and Mileage Act and shall receive no
|
0005| other compensation, perquisite or allowance.
|
0006| D. The board shall elect from among its members a
|
0007| chairman and such other officers as it deems necessary. The
|
0008| board shall meet at the call of the chairman, not less than
|
0009| four times each year. A majority of members currently serving
|
0010| shall constitute a quorum for the conduct of business.
|
0011| E. No board member shall serve more than two full
|
0012| consecutive terms and any member who fails to attend, after
|
0013| proper notice, three meetings shall automatically be
|
0014| recommended for removal unless excused for reasons set forth by
|
0015| board regulation."
|
0016| Section 4. Section 61-17A-7 NMSA 1978 (being Laws 1993,
|
0017| Chapter 171, Section 7) is amended to read:
|
0018| "61-17A-7. BOARD POWERS AND DUTIES.--
|
0019| A. The board shall:
|
0020| (1) adopt and file, in accordance with the
|
0021| State Rules Act, rules and regulations necessary to carry out
|
0022| the provisions of the Barbers and Cosmetologists Act;
|
0023| (2) establish fees;
|
0024| (3) provide for the examination, licensure and
|
0025| license renewal of applicants for licensure;
|
0001| (4) establish standards for and provide for
|
0002| the examination, [certification] licensure and license
|
0003| renewal [of certification] of manicurists-pedicurists,
|
0004| estheticians and electrologists;
|
0005| (5) adopt a seal;
|
0006| (6) furnish copies of rules and regulations
|
0007| and sanitary requirements adopted by the board to each owner or
|
0008| manager of an establishment, enterprise or school;
|
0009| (7) keep a record of its proceedings and a
|
0010| register of applicants for [certification or] licensure;
|
0011| (8) provide for the licensure of barbers,
|
0012| [and] cosmetologists, [the certification of] manicurist-
|
0013| pedicurists, estheticians, [and] electrologists, [and the
|
0014| licensure of] instructors, schools, enterprises and
|
0015| establishments;
|
0016| (9) establish administrative penalties and
|
0017| fines;
|
0018| (10) create and establish standards and
|
0019| fees for special licenses; [and]
|
0020| (11) hire an executive director and such other
|
0021| staff as is necessary to carry out the provisions of the
|
0022| Barbers and Cosmetologists Act; and
|
0023| (12) establish guidelines for schools to
|
0024| calculate tuition refunds for withdrawing students.
|
0025| B. The board may establish continuing education
|
0001| requirements as requirements for licensure.
|
0002| C. Any member of the board, its employees or agents
|
0003| may enter and inspect any school, enterprise or
|
0004| establishment, at any time during regular business hours for
|
0005| the purpose of determining compliance with the Barbers and
|
0006| Cosmetologists Act."
|
0007| Section 5. Section 61-17A-8 NMSA 1978 (being Laws 1993,
|
0008| Chapter 171, Section 8) is amended to read:
|
0009| "61-17A-8. LICENSURE REQUIREMENTS [FOR LICENSURE]--
|
0010| BARBERS.--
|
0011| A. A barber license shall be issued to any person
|
0012| who files a completed application, accompanied by the required
|
0013| fees and documentation, and who [submits satisfactory evidence
|
0014| that he]:
|
0015| (1) has an education equivalent to the
|
0016| completion of the second year of high school;
|
0017| (2) is at least seventeen years of age;
|
0018| (3) has completed a course in barbering of at
|
0019| least [twelve] one thousand two hundred hours in a school
|
0020| approved by the board; and
|
0021| (4) has passed an examination approved by the
|
0022| board.
|
0023| B. The holder of a barber license has the right and
|
0024| privilege to use the title "barber" [and], the initials
|
0025| "R.B." following the holder's surname and to use a barber
|
0001| pole, the traditional striped, vertical emblem of the barbering
|
0002| trade."
|
0003| Section 6. Section 61-17A-9 NMSA 1978 (being Laws 1993,
|
0004| Chapter 171, Section 9) is amended to read:
|
0005| "61-17A-9. LICENSURE REQUIREMENTS--COSMETOLOGISTS.--
|
0006| A. A cosmetologist license shall be issued to any
|
0007| person who files a completed application, accompanied by the
|
0008| required fees and documentation, and who [submits satisfactory
|
0009| evidence that he]:
|
0010| (1) is at least seventeen years of age;
|
0011| (2) has an education equivalent to the
|
0012| completion of the second year of high school;
|
0013| (3) has completed a course in cosmetology of
|
0014| at least [sixteen] one thousand six hundred hours at a
|
0015| school approved by the board; and
|
0016| (4) has passed an examination approved by the
|
0017| board.
|
0018| B. [The holder of a cosmetologist license has the
|
0019| right and privilege to place the initials "R.C." immediately
|
0020| following his name to indicate his licensure as a
|
0021| cosmetologist] The name of a licensed cosmetologist may be
|
0022| immediately followed by the initials "R.C.", as a right and
|
0023| privilege of licensure."

0024| Section 7. Section 61-17A-10 NMSA 1978 (being Laws 1993,
|
0025| Chapter 171, Section 10) is amended to read:
|
0001| "61-17A-10. [CERTIFICATION] LICENSURE REQUIREMENTS OF
|
0002| MANICURISTS-PEDICURISTS, ESTHETICIANS AND ELECTROLOGISTS.--
|
0003| A. The board shall provide for the
|
0004| [certification] licensure of manicurists-pedicurists. The
|
0005| board shall issue a manicurist-pedicurist [certificate]
|
0006| license to any person who files a completed application,
|
0007| accompanied by the required fees and documentation, and who
|
0008| submits satisfactory evidence [that he complies] of
|
0009| compliance with all requirements established by the board.
|
0010| [Any person holding a manicurist-pedicurist certificate has
|
0011| the right and privilege to place the initials "R.M."
|
0012| immediately following his name] The name of a licensed
|
0013| manicurist-pedicurist may be immediately followed by the
|
0014| initials "R.M.", as a right and privilege of licensure.
|
0015| B. The board shall provide for the
|
0016| [certification] licensure of estheticians. The board shall
|
0017| issue [a] an esthetician [certification] license to any
|
0018| person who files a completed application, accompanied by the
|
0019| required fees and documentation, and who submits satisfactory
|
0020| evidence [that he complies] of compliance with all
|
0021| requirements established by the board. [Any person holding an
|
0022| esthetician certificate has the right and privilege to place
|
0023| the initials "R.F." immediately following his name] The name
|
0024| of a licensed esthetician may be immediately followed by the
|
0025| initials "R.F.", as a right and privilege of licensure.
|
0001| C. The board shall provide for the
|
0002| [certification] licensure of electrologists. The board
|
0003| shall issue an electrologist [certificate] license to any
|
0004| person who files a completed application, accompanied by the
|
0005| required fees and documentation, and who submits satisfactory
|
0006| evidence [that he complies] of compliance with all
|
0007| requirements established by the board. [Any person holding an
|
0008| electrologist certificate has the right and privilege to place
|
0009| the initials "R.E." immediately following his name] The name
|
0010| of a licensed electrologist may be immediately followed by the
|
0011| initials "R.E.", as a right and privilege of licensure."
|
0012| Section 8. Section 61-17A-11 NMSA 1978 (being Laws 1993,
|
0013| Chapter 171, Section 11) is amended to read:
|
0014| "61-17A-11. LICENSURE OF INSTRUCTORS.--
|
0015| A. A cosmetologist instructor license shall be
|
0016| issued to any person who files a completed application,
|
0017| accompanied by the required fees and documentation, and who
|
0018| [submits satisfactory evidence that he]:
|
0019| (1) is a licensed cosmetologist;
|
0020| (2) has completed at least a four-year high
|
0021| school course of study or its equivalent as approved by the
|
0022| board;
|
0023| (3) has met all requirements established by
|
0024| the board; and
|
0025| (4) has passed an examination approved by the
|
0001| board.
|
0002| B. A barber instructor license shall be issued to
|
0003| any person who files a completed application, accompanied by
|
0004| the required fees and documentation, and who [submits
|
0005| satisfactory evidence that he]:
|
0006| (1) is a licensed barber;
|
0007| (2) has completed at least a four-year high
|
0008| school course of study or its equivalent as approved by the
|
0009| board;
|
0010| (3) has met all requirements established by
|
0011| the board; and
|
0012| (4) has passed an examination approved by the
|
0013| board.
|
0014| C. An electrologist instructor license shall be
|
0015| issued to any person who files a completed application,
|
0016| accompanied by the required fees and documentation, and who
|
0017| submits satisfactory evidence [that he complies] of
|
0018| compliance with all requirements established by the board.
|
0019| D. [The holder of an instructor license has the
|
0020| right and privilege to place the initials "R.I." immediately
|
0021| following his name to designate that he is a licensed
|
0022| instructor] The name of a licensed instructor may be
|
0023| immediately followed by the initials "R.I.", as a right and
|
0024| privilege of licensure."
|
0025| Section 9. Section 61-17A-12 NMSA 1978 (being Laws 1993,
|
0001| Chapter 171, Section 12) is amended to read:
|
0002| "61-17A-12. LICENSURE OF SCHOOLS.--
|
0003| A. The board shall provide for the licensure of
|
0004| barber schools. The board shall issue a barber school license
|
0005| to any barber school that submits a completed application,
|
0006| accompanied by the required fees and documentation, and that
|
0007| submits satisfactory evidence that it complies with all
|
0008| enrollment, curriculum, instructional and graduation
|
0009| requirements and record-keeping procedures established by the
|
0010| board.
|
0011| B. The board shall provide for the licensure of
|
0012| cosmetology schools. The board shall issue a cosmetology
|
0013| school license to any cosmetology school that submits a
|
0014| completed application, accompanied by the required fees and
|
0015| documentation, and that submits satisfactory evidence that it
|
0016| complies with all enrollment, curriculum, instructional and
|
0017| graduation requirements and record-keeping procedures
|
0018| established by the board.
|
0019| C. The board shall provide for the licensure of
|
0020| electrology schools. The board shall issue an electrology
|
0021| school license to any electrology school that submits a
|
0022| completed application, accompanied by the required fees and
|
0023| documentation, and that submits satisfactory evidence that it
|
0024| complies with all enrollment, curriculum, instructional and
|
0025| graduation requirements and record-keeping procedures
|
0001| established by the board.
|
0002| D. The board shall provide for the licensure of
|
0003| specialty schools. The board shall issue a specialty school
|
0004| license to any specialty school that submits a completed
|
0005| application, accompanied by the required fees and
|
0006| documentation, and that submits satisfactory evidence that it
|
0007| complies with all enrollment, curriculum, instructional and
|
0008| graduation requirements and record-keeping procedures
|
0009| established by the board.
|
0010| E. The board shall establish crossover credit
|
0011| standards for training available at either barber schools or
|
0012| cosmetology schools that may be used in meeting licensure
|
0013| requirements in either profession.
|
0014| F. [In providing for licensure of schools, the
|
0015| board shall establish procedures for alternative teaching
|
0016| agreements, or "teach-out" arrangements in the event a school
|
0017| is unable to meet its contracted teaching obligations] The
|
0018| board shall establish a corporate surety bond requirement for
|
0019| schools to indemnify students for fees and tuition paid to a
|
0020| school if the school ceases operation or terminates a program
|
0021| prior to the completion of a student's contract with the
|
0022| school."
|
0023| Section 10. Section 61-17A-15 NMSA 1978 (being Laws 1993,
|
0024| Chapter 171, Section 15) is amended to read:
|
0025| "61-17A-15. LICENSURE OF ALL ESTABLISHMENTS AND
|
0001| ENTERPRISES.--The board shall provide for the licensure of all
|
0002| establishments and enterprises. The board shall issue a
|
0003| license to establishments, enterprises and clinics that
|
0004| submit a completed application, accompanied by the required
|
0005| fees and documentation, and that submit satisfactory evidence
|
0006| of compliance with all requirements established by the board."

0007| Section 11. Section 61-17A-16 NMSA 1978 (being Laws 1993,
|
0008| Chapter 171, Section 16) is amended to read:

0009| "61-17A-16. FEES.--The board may, by regulation,
|

0010| Section 12. Section 61-17A-17 NMSA 1978 (being Laws 1993,
|
0011| Chapter 171, Section 17, as amended) is amended to read:
|
0012| "61-17A-17. LICENSURE UNDER PRIOR LAW--ENDORSEMENT.--
|
0013| A. Any person licensed [or certified] as a
|
0014| barber, [or] a cosmetologist, an esthetician, an
|
0015| electrologist, an instructor of cosmetology or barbering or an
|
0016| instructor of electrology, a manicurist-pedicurist or any
|
0017| person holding an establishment license, clinic license or
|
0018| school owner's license under any prior laws of this state,
|
0019| which license is valid on the effective date of the Barbers and
|
0020| Cosmetologists Act, shall be held to be licensed [or
|
0021| certified] under the provisions of that act and shall be
|
0022| entitled to the renewal of his license [or certificate] as
|
0023| provided in that act.
|
0024| B. The board may grant a license pursuant to the
|
0025| provisions of the Barbers and Cosmetologists Act without an
|
0001| examination, upon payment of the required fee, provided that
|
0002| the applicant [submits proof that he]:
|
0003| (1) holds a current license [or
|
0004| certification] from another state, territory or possession of
|
0005| the United States, or the District of Columbia, that has
|
0006| training hours and qualifications similar to or exceeding those
|
0007| required for licensure in New Mexico; and
|
0008| (2) meets all other requirements for
|
0009| reciprocity as determined by regulation of the board."
|
0010| Section 13. Section 61-17A-18 NMSA 1978 (being Laws 1993,
|
0011| Chapter 171, Section 18) is amended to read:
|
0012| "61-17A-18. LICENSE [OR CERTIFICATE] TO BE DISPLAYED--
|
0013| NOTICE OF CHANGE OF PLACE OF BUSINESS.--Every holder of a
|
0014| license shall notify the executive director of [his new] any
|
0015| change in place of business [and]. Upon receipt of the
|
0016| notification, the executive director shall make the necessary
|
0017| change in the books. [Every holder of] A license [or
|
0018| certificate] shall [display it in a conspicuous place at his
|
0019| workplace] be displayed conspicuously at the holder's place
|
0020| of business."
|
0021| Section 14. Section 61-17A-20 NMSA 1978 (being Laws 1993,
|
0022| Chapter 171, Section 20) is amended to read:
|
0023| "61-17A-20. DURATION, RESTORATION AND RENEWAL OF LICENSES
|
0024| [AND CERTIFICATES].--
|
0025| A. The original issuance and renewal of licenses to
|
0001| practice as a barber, cosmetologist, [or] instructor, [or
|
0002| the certification as an] esthetician, manicurist-pedicurist or
|
0003| electrologist shall be for a period of one year or less from
|
0004| the date of issuance. If the licensee [or certificate
|
0005| holder] fails to renew the license [or certificate] for the
|
0006| next year, [his] the license [or certificate] is void;
|
0007| provided [he may restore his] the license [or
|
0008| certificate] may be restored at any time during the year
|
0009| following expiration upon [paying] the payment of the
|
0010| appropriate fee and a late charge not to exceed one hundred
|
0011| dollars ($100) as set forth by board rules. If the licensee
|
0012| [or certificate holder] fails to restore [his] the
|
0013| license [or certificate] within one year following its
|
0014| expiration, [his] the license [or certificate] may not be
|
0015| restored. [and, in order for such licensee or certificate
|
0016| holder] To again obtain a license, [or certificate, he shall
|
0017| pay the fees and furnish the proofs and submit to such
|
0018| examinations as are required of applicants] the licensee
|
0019| shall satisfy requirements for original licensure [or
|
0020| certification].
|
0021| B. The original issuance and annual renewal of
|
0022| licenses to operate an establishment or school shall be for a
|
0023| period of twelve months or less following the issuance of the
|
0024| license. If the licensee fails to renew [his] the license
|
0025| within thirty days after [the date his license expires, his]
|
0001| its expiration, the license is void, and, [in order] to
|
0002| again obtain a license, [he shall be required to submit] an
|
0003| application, [any] required documentation, [pay] payment
|
0004| of the renewal fee and a late fee not to exceed one hundred
|
0005| dollars ($100) as [set forth] established by board rules
|
0006| is required.
|
0007| C. The board may establish a staggered system of
|
0008| license expiration [and a procedure for proration of fees for
|
0009| licenses issued for less than a full year]."
|
0010| Section 15. Section 61-17A-21 NMSA 1978 (being Laws 1993,
|
0011| Chapter 171, Section 21) is amended to read:
|
0012| "61-17A-21. GROUNDS FOR REFUSAL TO ISSUE, RENEW, SUSPEND
|
0013| OR REVOKE A LICENSE.--
|
0014| A. The board shall, in accordance with the
|
0015| provisions of the Uniform Licensing Act, issue a fine or
|
0016| penalty, restrict, refuse to issue or renew or shall suspend or
|
0017| revoke a license for any one or more of the following causes:
|
0018| (1) the commission of any offense described in
|
0019| the Barbers and Cosmetologists Act;
|
0020| (2) the violation of any sanitary regulation
|
0021| promulgated by the board;
|
0022| (3) malpractice or incompetency;
|
0023| (4) advertising by means of knowingly false or
|
0024| deceptive statements;
|
0025| (5) habitual drunkenness or habitual addiction
|
0001| to the use of habit-forming drugs;
|
0002| (6) continuing to [be employed or
|
0003| practicing] practice in or be employed by an
|
0004| establishment, an enterprise, a school or an electrology
|
0005| clinic in which the sanitary regulations of the board, of the
|
0006| department of health or of any other lawfully constituted
|
0007| board, promulgated for the regulation of establishments,
|
0008| enterprises, schools or electrology clinics, are known by the
|
0009| licensee to be violated;
|
0010| (7) [notification of a licensee's] default
|
0011| of a licensee on a student loan;
|
0012| (8) gross continued negligence in observing
|
0013| the rules and regulations;
|
0014| (9) renting, loaning or allowing the use of
|
0015| the license to any [unlicensed] person not licensed under
|
0016| the provisions of the Barbers and Cosmetologists Act;
|
0017| (10) dishonesty or unfair or deceptive
|
0018| practices;
|
0019| (11) sexual, racial or religious harassment;

0020| (12) conduct of illegal activities in an

0021| establishment, enterprise, school or electrology clinic or by

0022| a licensee;

0023| (13) conviction of a crime involving moral

0024| turpitude; or
|
0025| (14) aiding, abetting or conspiring to evade

0001| or violate the provisions of the Barbers and Cosmetologists
|
0002| Act.
|
0003| B. Any license suspended or revoked shall be
|
0004| delivered to the board or any agent of the board upon demand."

0005| Section 16. Section 61-17A-25 NMSA 1978 (being Laws 1993,
|
0006| Chapter 171, Section 27) is amended to read:
|
0007| "61-17A-25. TERMINATION OF AGENCY LIFE--DELAYED
|
0008| REPEAL.--The board of barbers and cosmetologists is terminated
|
0009| on July 1, [1998] 2001 pursuant to the Sunset Act. The
|
0010| board shall continue to operate according to the provisions of
|
0011| the Barbers and Cosmetologists Act until July 1, [1999]
|
0012| 2002. Effective July 1, [1999] 2002, the Barbers and
|
0013| Cosmetologists Act is repealed."
|
0014| Section 17. TEMPORARY PROVISION.--Any money remaining in
|
0015| the tuition recovery fund upon the effective date of this 1997
|
0016| act shall be transferred to the barbers and cosmetologists
|
0017| fund.
|
0018| Section 18. REPEAL.--Section 61-17A-13 NMSA 1978 (being
|
0019| Laws 1993, Chapter 171, Section 13) is repealed.
