0011| RELATING TO COURTS; ENACTING A NEW SECTION OF THE NMSA 1978 TO

0012| REQUIRE MEDIATION AND ARBITRATION PURSUANT TO COURT RULES.

0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. MANDATORY MEDIATION AND ARBITRATION.--In a
|
0016| suit filed in a metropolitan or a district court in which a
|
0017| money judgment of no more than twenty-five thousand dollars
|
0018| ($25,000) is sought, excluding interest, costs and attorney
|
0019| fees, the court shall refer the dispute to settlement through
|
0020| mediation. If settlement is not reached after a reasonable
|
0021| period of time determined by the court, the court shall refer
|
0022| the case to arbitration. The supreme court may implement this
|
0023| provision by rules of court.
