0011| RELATING TO HEALTH; CHANGING REPORTING REQUIREMENTS IN CERTAIN
|
0012| CIRCUMSTANCES.
|

0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. Section 24-2B-6 NMSA 1978 (being Laws 1989,
|
0016| Chapter 227, Section 6) is amended to read:
|
0017| "24-2B-6. CONFIDENTIALITY.--No person or the person's
|
0018| agents or employees who require or administer the test shall
|
0019| disclose the identity of any person upon whom a test is
|
0020| performed or the result of such a test in a manner which
|
0021| permits identification of the subject of the test, except to
|
0022| the following persons:
|
0023| A. the subject of the test or the subject's legally
|
0024| authorized representative, guardian or legal custodian;
|
0025| B. any person designated in a legally effective
|
0001| release of the test results executed prior to or after the test
|
0002| by the subject of the test or the subject's legally authorized
|
0003| representative;
|
0004| C. an authorized agent, a credentialed or
|
0005| privileged physician or employee of a health facility or health
|
0006| care provider if the health care facility or health care pro-
|
0007|
|
0008| vider itself is authorized to obtain the test results, the
|
0009| agent or employee provides patient care or handles or processes
|
0010| specimens of body fluids or tissues and the agent or employee
|
0011| has a need to know such information;
|
0012| D. the department of health [and environment
|
0013| department and the centers for disease control of the United
|
0014| States public health service] in accordance with reporting
|
0015| requirements [for a diagnosed case of acquired immune
|
0016| deficiency syndrome] established by regulation;
|
0017| E. a health facility or health care provider which
|
0018| procures, processes, distributes or uses:
|
0019| (1) a human body part from a deceased person,
|
0020| with respect to medical information regarding that person;
|
0021| (2) semen provided prior to the effective date
|
0022| of the Human Immunodeficiency Virus Test Act for the purpose of
|
0023| artificial insemination;
|
0024| (3) blood or blood products for transfusion or
|
0025| injection; or
|
0001| (4) human body parts for transplant with
|
0002| respect to medical information regarding the donor or
|
0003| recipient;
|
0004| F. health facility staff committees or
|
0005| accreditation or oversight review organizations which are
|
0006| conducting program monitoring, program evaluation or service
|
0007| reviews, so long as any identity remains confidential;
|
0008| G. authorized medical or epidemiological
|
0009| researchers who may not further disclose any identifying
|
0010| characteristics or information; and
|
0011| H. for purposes of application or reapplication for
|
0012| insurance coverage, an insurer or reinsurer upon whose request
|
0013| the test was performed."
