0011| RELATING TO CRIMINAL LAW; CREATING A NEW CRIMINAL OFFENSE OF

0012| DISARMING A LAW ENFORCEMENT OFFICER OR CORRECTIONS OFFICER;
|
0013| PROVIDING A PENALTY; ENACTING A NEW SECTION OF THE CRIMINAL
|
0014| CODE.

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. A new section of the Criminal Code is enacted
|
0018| to read:
|
0019| "[NEW MATERIAL] DISARMING A LAW ENFORCEMENT OFFICER OR
|
0020| CORRECTIONS OFFICER.--
|
0021| A. Disarming a law enforcement officer or
|
0022| corrections officer consists of knowingly:
|
0023| (1) removing a firearm or weapon from the
|
0024| person of a law enforcement officer or corrections officer when
|
0025| the officer is acting within the scope of his duties; or
|
0001| (2) depriving a law enforcement officer or
|
0002| corrections officer of the use of a firearm or weapon when the
|
0003| officer is acting within the scope of his duties.
|
0004| B. The provisions of Subsection A of this act shall
|
0005| not apply when a law enforcement officer or corrections officer
|
0006| is engaged in felonious conduct.
|
0007| C. Whoever commits disarming a law enforcement
|
0008| officer or corrections officer is guilty of a fourth degree
|
0009| felony."
|
0010| Section 2. EFFECTIVE DATE.--The effective date of the
|
0011| provisions of this act is July 1, 1997.
