0011| CREATING THE WORKFORCE DEVELOPMENT BOARD; DEFINING ITS POWERS
|
0012| AND DUTIES.
|

|
0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. WORKFORCE DEVELOPMENT BOARD.--
|
0016| A. A workforce development board is created,
|
0017| consisting of twenty members appointed by the governor with the
|
0018| advice and consent of the senate and six ex-officio members.
|
0019| The ex-officio members are the lieutenant governor, the
|
0020| secretary of children, youth and families, the secretary of
|
0021| economic development, the secretary of labor, the secretary of
|
0022| human services and the superintendent of education. Five
|
0023| members shall be appointed by the governor with one member
|
0024| appointed from each of the following: local public education,
|
0025| a post-secondary institution of higher education; a secondary
|
0001| or post-secondary vocational educational institution and a
|
0002| community-based organization. These appointed members shall
|
0003| serve terms of two years. Six members shall be appointed by
|
0004| the governor from representatives of business and industry.
|
0005| The governor shall appoint four members representing organized
|
0006| labor. The governor shall consider recommendations from
|
0007| statewide labor organizations for the members representing
|
0008| organized labor. Members appointed by the governor to
|
0009| represent business and industry and organized labor shall serve
|
0010| terms of two years. Five members shall be appointed by the
|
0011| governor from among the following: local welfare agencies,
|
0012| public housing agencies, units of general local government or
|
0013| consortia of those units who shall be appointed from
|
0014| nominations made by the chief elected officials of the units or
|
0015| consortia; representatives of the state legislature;
|
0016| representatives of any state or local program that receives
|
0017| funding under an applicable federal human resources program
|
0018| that the governor determines to have a direct interest in the
|
0019| utilization of human resources within the state; and
|
0020| individuals who have special knowledge and qualifications with
|
0021| respect to special education and career development needs of
|
0022| hard-to-serve individuals.
|
0023| B. A vacancy on the board shall be filled in the
|
0024| same manner as regular appointments are made for the unexpired
|
0025| portion of the regular term.
|
0001| C. The lieutenant governor shall serve as the
|
0002| chairman of the board.
|
0003| D. The board shall meet at the call of the
|
0004| chairman.
|
0005| E. A majority of the members constitutes a quorum.
|
0006| F. Appointed members of the board are eligible for
|
0007| payment pursuant the Per Diem and Mileage Act.
|
0008| Section 2. DUTIES OF THE WORKFORCE DEVELOPMENT BOARD.--
|
0009| A. As used in this section "board" means the
|
0010| workforce development board.
|
0011| B. The board shall develop and coordinate the
|
0012| implementation of a ten-year comprehensive workforce
|
0013| development plan of specific goals, objectives and policies for
|
0014| the state. This plan shall be updated annually and revised as
|
0015| necessary. All state agencies involved in workforce
|
0016| development activities shall annually submit to the board for
|
0017| its review and potential inclusion in the plan their goals,
|
0018| objectives and policies. The plan shall include
|
0019| recommendations to the legislature and the governor on the
|
0020| modification, consolidation, initiation or elimination of
|
0021| workforce training and education programs in the state.
|
0022| C. The board shall prepare a five-year strategic
|
0023| plan for state workforce development to implement the specific
|
0024| comprehensive goals, objectives and policies of the state. All
|
0025| state agencies involved in workforce development activities and
|
0001| regional workforce advisory boards shall annually submit to the
|
0002| board for its review and potential inclusion in the strategic
|
0003| plan their strategic plans and programs. The five-year
|
0004| strategic plan for state workforce development shall be updated
|
0005| annually. The plan shall include recommendations to the
|
0006| legislature and the governor on the modification,
|
0007| consolidation, initiation or elimination of workforce training
|
0008| and education programs in the state.
|
0009| D. In addition to its responsibilities pursuant to
|
0010| Subsections B and C of this section, the board shall:
|
0011| (1) develop a method of evaluation for
|
0012| attainment of goals and objectives from pursuing the policies
|
0013| of the five-year and ten-year plans that shall include a system
|
0014| to measure program performance, identify accomplishments and
|
0015| evaluate programs to ensure goals and standards are met;
|
0016| (2) monitor the implementation and evaluate
|
0017| the effectiveness of the five-year and ten-year plans;
|
0018| (3) review the provision of services and use
|
0019| of funds and resources under applicable federal human resource
|
0020| programs and advise the governor on methods of coordinating the
|
0021| provision of services and use of funds and resources consistent
|
0022| with the laws and regulations governing those programs;
|
0023| (4) perform the duties and functions
|
0024| prescribed for existing state councils described under the laws
|
0025| relating to the applicable federal human resource programs;
|
0001| (5) provide policy advice for any federal act
|
0002| pertaining to workforce development that is not required by
|
0003| state or federal law to be provided by another body;
|
0004| (6) identify policies to reduce administrative
|
0005| and other barriers to efficient operation of the state's
|
0006| workforce development system, including among these policies
|
0007| provisions for waivers of statutory requirements and
|
0008| administrative rules and for implementation of one-stop access
|
0009| to workforce development services and school-to-work
|
0010| transition; and
|
0011| (7) upon enactment of new federal initiatives
|
0012| relating to workforce development, advise the governor and
|
0013| legislature on mechanisms for integrating the federal
|
0014| initiatives into the state's workforce development system and
|
0015| make recommendations on legislative or administrative measures
|
0016| necessary to streamline and coordinate state efforts to meet
|
0017| federal guidelines.
|
0018| Section 3. APPLICABLE FEDERAL HUMAN RESOURCES PROGRAM
|
0019| DEFINED.--
|
0020| A. As used in this section, "applicable federal
|
0021| human resources program" means any program receiving federal
|
0022| funds that the governor and the head of the state agency
|
0023| responsible for the administration of that program jointly
|
0024| agree to include within the jurisdiction of the workforce
|
0025| development board.
|
0001| B. With respect to a program authorized under the
|
0002| federal Carl D. Perkins Vocational and Applied Technology
|
0003| Education Act, applicable federal human resources program
|
0004| applies only to the program if, in addition to meeting the
|
0005| requirements of Subsection A of this section, the state
|
0006| advisory council on vocational education agrees to include the
|
0007| program under the jurisdiction of the board.
|
0008| C. Applicable federal human resources programs:
|
0009| (1) may include programs authorized pursuant
|
0010| to:
|
0011| (a) the federal Job Training Partnership
|
0012| Act;
|
0013| (b) the federal Carl D. Perkins
|
0014| Vocational and Applied Technology Education Act;
|
0015| (c) the federal Adult Education Act;
|
0016| (d) the federal Wagner-Peyser Act;
|
0017| (e) Part A of Title 4 of the federal
|
0018| Social Security Act; or
|
0019| (f) the employment program established
|
0020| under Section 6(3)(4) of the Food Stamp Act of 1977; and
|
0021| (2) shall not include programs authorized
|
0022| under the federal Rehabilitation Act of 1973.
|
0023| Section 4. FUNDING--PERSONNEL.--
|
0024| A. In order to carry out its functions, the
|
0025| workforce development board may:
|
0001| (1) use funds otherwise available for state
|
0002| councils under the applicable federal human resources programs
|
0003| consistent with the laws and regulations governing those
|
0004| programs; and
|
0005| (2) use funds, services, personnel, facilities
|
0006| and information provided by state and local public agencies,
|
0007| with the consent of those agencies.
|
0008| B. Staff support for the workforce development
|
0009| board shall be provided by the labor department.
|
0010| Section 5. EFFECTIVE DATE.--The effective date of the
|
0011| provisions of this act is July 1, 1997.
