0011| RELATING TO MOTOR VEHICLES; INCREASING THE LABORATORY FEE

0012| ASSESSED UPON CONVICTION OF DRIVING WHILE UNDER THE INFLUENCE

0013| OF INTOXICATING LIQUOR OR DRUGS.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

0016| Section 1. Section 31-12-7 NMSA 1978 (being Laws 1981,
|
0017| Chapter 367, Section 1, as amended) is amended to read:
|
0018| "31-12-7. MOTOR VEHICLES--INFLUENCE OF INTOXICATING
|
0019| LIQUOR OR DRUGS--FEE UPON CONVICTION.--Notwithstanding the
|
0020| provisions of Section 66-8-102 NMSA 1978 or any municipal
|
0021| ordinance that prohibits driving while under the influence of
|
0022| intoxicating liquor or drugs, a person convicted of a violation
|
0023| of Section 66-8-102 NMSA 1978 or a violation of a municipal
|
0024| ordinance that prohibits driving while under the influence of
|
0025| intoxicating liquor or drugs shall be assessed by the court, in
|
0001| addition to any other fee or fine:
|
0002| A. a fee of [thirty-five dollars ($35.00)]
|
0003| sixty-five dollars ($65.00) to defray the costs of chemical
|
0004| and other tests [utilized] used to determine the influence
|
0005| of liquor or drugs; and
|
0006| B. a fee of seventy-five dollars ($75.00) to fund
|
0007| comprehensive community programs for the prevention of driving
|
0008| while under the influence of intoxicating liquor or drugs and
|
0009| for other traffic safety purposes."
