0011| RELATING TO CRIME; ESTABLISHING PENALTIES RELATED TO THE VALUE

0012| OF A MOTOR VEHICLE IN CERTAIN CIRCUMSTANCES.
|

0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. Section 30-16-40 NMSA 1978 (being Laws 1973,
|
0016| Chapter 154, Section 1, as amended) is amended to read:
|
0017| "30-16-40. FRAUDULENT REFUSAL TO RETURN A LEASED VEHICLE
|
0018| OR OTHER PERSONAL PROPERTY--PENALTY--PRESUMPTION.--
|
0019| A. Any person who, after leasing a vehicle or other
|
0020| personal property under a written agreement [which] that
|
0021| provides for the return of the vehicle or personal property to
|
0022| a particular place at a particular time and who, with intent to
|
0023| defraud the lessor of the vehicle or personal property, fails
|
0024| to return the vehicle or personal property to the place within
|
0025| the time specified, is guilty:
|
0001| (1) of a fourth degree felony if the property
|
0002| [is a vehicle or has a value in excess of one hundred dollars
|
0003| ($100)] or vehicle has a value of less than two thousand five
|
0004| hundred dollars ($2,500);
|
0005| (2) of a third degree felony if the property
|
0006| or vehicle has a value of two thousand five hundred dollars
|
0007| ($2,500) or more but less than twenty thousand dollars
|
0008| ($20,000);
|
0009| (3) of a second degree felony if the vehicle
|
0010| has a value of twenty thousand dollars ($20,000) or more; and
|
0011| [(2)] (4) of a petty misdemeanor if the
|
0012| property is not a vehicle and has a value of one hundred
|
0013| dollars ($100) or less.
|
0014| B. Failure of the lessee to return the vehicle or
|
0015| personal property to the place specified within seventy-two
|
0016| hours after the mailing to him by certified mail at his
|
0017| address shown on the leasing agreement of a written demand to
|
0018| return the vehicle or personal property shall raise a
|
0019| rebuttable presumption that the failure to return the vehicle
|
0020| or personal property was with intent to defraud."
