Section 27-2-7 NMSA 1978 (being Laws 1973, | 0017| Chapter 376, Section 10, as amended) is amended to read: | 0018| "27-2-7. GENERAL ASSISTANCE PROGRAM--QUALIFICATIONS AND | 0019| PAYMENTS.-- | 0020| A. Subject to the availability of state funds, | 0021| public assistance shall be provided under a general assistance | 0022| program to or on behalf of an eligible [persons] applicant who | 0023| meets all eligibility conditions pursuant to Section 27-2-4 | 0024| NMSA 1978 and who: | 0025| [(1) are under eighteen years of age and meet | 0001| all eligibility conditions for aid to families with dependent | 0002| children except the relationship to the person with whom they | 0003| are living; or | 0004| (2) are over the age of eighteen and are | 0005| temporarily disabled, according to regulations of the board and | 0006| are not receiving aid to families with dependent children; or | 0007| (3) meet the qualifications under such other | 0008| regulations for the general assistance program as the board | 0009| shall establish from time to time. | 0010| B. General assistance program payments may be made | 0011| directly to the recipient or to the vendor of goods or services | 0012| provided to the recipient. The board may by regulation limit | 0013| the grants that are made to general assistance recipients. | 0014| C. Whenever the board makes an adjustment in the | 0015| standard of need for the aid to families with dependent | 0016| children program pursuant to Section 13-17-3 NMSA 1953, it | 0017| shall make a commensurate adjustment in the standard of need | 0018| for the general assistance program] | 0019| (1) is an unemancipated minor and lives with a | 0020| caretaker that is not related to the minor by blood or | 0021| marriage; | 0022| (2) is over sixty years of age and the | 0023| caretaker of an eligible applicant under the age of eighteen; | 0024| (3) is the parent of an unemancipated minor, | 0025| where the parent: | 0001| (a) suffers from a permanent or | 0002| temporary disability that prevents the parent from engaging in | 0003| work; | 0004| (b) is providing care for a totally | 0005| disabled adult in the family; | 0006| (c) is caring for an unemancipated minor | 0007| with a disability who requires special parental care that cannot | 0008| be provided through available day care services; | 0009| (d) has received assistance pursuant to | 0010| Title 4 of the federal act for more than sixty months; or | 0011| (e) is a lawfully resident noncitizen who | 0012| would be a person eligible for public assistance if the parent | 0013| were a citizen; or | 0014| (4) is over the age of eighteen and: | 0015| (a) is either permanently or temporarily | 0016| disabled, according to regulations of the department; | 0017| (b) is not otherwise receiving a grant of | 0018| public assistance pursuant to the Public Assistance Act or the | 0019| federal act, excluding food assistance or medical assistance; | 0020| (c) has applied for assistance based upon | 0021| his disability pursuant to Title 16 of the federal act; and | 0022| (d) has executed an agreement authorizing | 0023| the state to recoup public assistance paid pursuant to the general | 0024| assistance program from disability assistance the person | 0025| ultimately receives pursuant to Title 16 of the federal act. | 0001| B. General assistance program payments may be made | 0002| directly to the recipient or to the vendor of goods and services | 0003| provided to the recipient. The department may by regulation limit | 0004| the grants that are made to general assistance recipients. | 0005| C. The department may by regulation require recipients | 0006| of general assistance to engage in programs of vocational | 0007| rehabilitation or education or to seek work opportunities that are | 0008| appropriate for the recipient and are designed to assist | 0009| recipients to become self-sufficient. | 0010| D. Whenever the department makes an adjustment in the | 0011| standard of need pursuant to Section 27-2-3 NMSA 1978, it shall | 0012| make a commensurate adjustment in the standard of need for the | 0013| general assistance program." | 0014|  |
