0011| RELATING TO STATE EDUCATIONAL INSTITUTIONS; PROVIDING FOR

0012| TUITION WAIVERS AT CERTAIN EDUCATIONAL INSTITUTIONS FOR
|
0013| STUDENTS WHO WERE IN FOSTER CARE.
|

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. TUITION WAIVER AUTHORIZED--CERTAIN EDUCATIONAL
|
0017| INSTITUTIONS.--
|
0018| A. The board of regents of the university of New
|
0019| Mexico, New Mexico state university, New Mexico institute of
|
0020| mining and technology, western New Mexico university, eastern
|
0021| New Mexico university, New Mexico highlands university and New
|
0022| Mexico military institute and the governing boards of New
|
0023| Mexico junior college, community colleges and technical and
|
0024| vocational institutes shall waive tuition charges:
|
0025| (1) for a child who was in foster care at the
|
0001| time he reached the age of majority or was emancipated;
|
0002| provided the child is enrolled in the institution no later than
|
0003| the third anniversary of the date his foster care was
|
0004| terminated, and he remains in good standing during his
|
0005| attendance at the institution; or
|
0006| (2) for a child who enrolls in the institution
|
0007| while in foster care and remains in good standing during his
|
0008| attendance at the institution.
|
0009| B. For purposes of this section, "foster care"
|
0010| includes the following:
|
0011| (1) a foster home, licensed by the children,
|
0012| youth and families department or licensed by a private agency
|
0013| authorized by the children, youth and families department to
|
0014| issue licenses, that is maintained by an individual having the
|
0015| care and control, for periods exceeding twenty-four hours, of a
|
0016| child who is abused, neglected, dependent or homeless and who
|
0017| is not placed for adoption;
|
0018| (2) the home of a relative or guardian where a
|
0019| child in the custody of the children, youth and families
|
0020| department is placed; and
|
0021| (3) the semi-independent living program
|
0022| approved by the children, youth and families department.
|
0023| C. In determining budget and revenue calculations,
|
0024| the commission on higher education shall not take credit for
|
0025| tuition money a university does not receive as a result of a
|
0001| foster care tuition waiver.
