0011| RELATING TO COUNTY FUNDS; PERMITTING CERTAIN FUNDS TO BE USED

0012| FOR BURIAL OF INDIGENTS.

0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. Section 24-13-3 NMSA 1978 (being Laws 1939,
|
0016| Chapter 224, Section 3, as amended) is amended to read:
|
0017| "24-13-3. EXPENSES FOR BURIAL.--The expenses for the
|
0018| burial or cremation of an indigent person may be paid by the
|
0019| county out of the general fund or from the county indigent
|
0020| hospital claims fund in an amount up to six hundred dollars
|
0021| ($600) for the burial of any adult or minor."
|
0022| Section 2. Section 27-5-7.1 NMSA 1978 (being Laws 1993,
|
0023| Chapter 321, Section 16) is amended to read:
|
0024| "27-5-7.1. COUNTY INDIGENT HOSPITAL CLAIMS FUND--
|
0025| AUTHORIZED USES OF THE FUND.--
|
0001| A. The fund shall be used:
|
0002| (1) to meet the county's contribution for
|
0003| support of sole community provider payments as calculated by
|
0004| the department for that county; and
|
0005| (2) to pay all claims that have been approved
|
0006| by the board that are not matched with federal funds under the
|
0007| state medicaid program.
|
0008| B. The fund may be used to meet the county's
|
0009| obligation under Section 27-10-4 NMSA 1978.
|
0010| C. The fund may be used to pay the burial costs of
|
0011| indigent persons.
|
0012| [C.] D. Until June 30, 1996, the cash reserves
|
0013| from the fund may be used to meet the county's obligation under
|
0014| Section 27-10-4 NMSA 1978."
