0011| RELATING TO THE NATIONAL STATUARY HALL; CREATING A STATUARY
|
0012| HALL COMMISSION; HONORING POPAY; MAKING AN APPROPRIATION;
|
0013| DECLARING AN EMERGENCY.
|

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. COMMISSION CREATED.--The "statuary hall
|
0017| commission" is created. The commission shall be composed of no
|
0018| more than nine persons, the chairman of which shall be the
|
0019| governor and the membership of which shall include the state
|
0020| treasurer, the state cultural affairs officer, the executive
|
0021| director of the New Mexico office of Indian affairs and no
|
0022| fewer than four members appointed by the governor from a list
|
0023| of names that have been submitted to him by the Indian nations,
|
0024| tribes or pueblos in New Mexico, containing names of members of
|
0025| those Indian nations, tribes or pueblos who would be
|
0001| appropriate to serve on the commission. Terms of the members
|
0002| shall extend until a second statue from New Mexico is emplaced
|
0003| in the national statuary hall in Washington, D.C. The governor
|
0004| shall fill any vacancy on the statuary hall commission within
|
0005| three months from the date that the vacancy occurs in the same
|
0006| manner as original members were appointed.
|
0007| Section 2. DUTIES.--The statuary hall commission shall:
|
0008| A. meet at the call of the governor but shall meet
|
0009| no fewer than four times per year;
|
0010| B. determine the process necessary for New Mexico
|
0011| to have a second statue placed in the national statuary hall;
|
0012| C. develop procedures for the funding of the
|
0013| second statue and raise funds to commission the design,
|
0014| creation and transport of a statue to be placed in the national
|
0015| statuary hall through the creation of a foundation for the
|
0016| acceptance of gifts, donations, bequests and proceeds from
|
0017| appropriate fundraising events in accordance with the
|
0018| provisions of the act of July 2, 1864 (40 U.S.C. 187); and
|
0019| D. commission the design and creation of a statue
|
0020| of the illustrious San Juan pueblo Indian strategist and
|
0021| warrior Popay, who was renowned, respected and revered by the
|
0022| Native Americans of New Mexico as the leader of the pueblo
|
0023| revolt of 1680 and who would be the second Native American to
|
0024| be honored with placement of a statue in the national statuary
|
0025| hall.

0001| Section 3. APPROPRIATION.--Sixty thousand dollars
|
0002| ($60,000) is appropriated from the general fund to the office
|
0003| of cultural affairs for expenditure in fiscal years 1997 and
|
0004| 1998 for the purpose of paying mileage and per diem expenses
|
0005| pursuant to the Per Diem and Mileage Act to members of the
|
0006| statuary hall commission that are not official representatives
|
0007| of state agencies and to pay for operational expenses of the
|
0008| commission. Any unexpended or unencumbered balance remaining
|
0009| at the end of fiscal year 1998 shall revert to the general
|
0010| fund.

0011| Section 4. EMERGENCY.--It is necessary for the public
|
0012| peace, health and safety that this act take effect immediately.
