0011| RELATING TO JUVENILE JUSTICE; ESTABLISHING A BOOT CAMP PROGRAM

0012| FOR CERTAIN DELINQUENT OFFENDERS; ENACTING A NEW SECTION OF THE

0013| DELINQUENCY ACT.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. A new section of the Delinquency Act is
|
0017| enacted to read:
|
0018| "[NEW MATERIAL] BOOT CAMP PROGRAM--ADMINISTRATION--
|
0019| CRITERIA FOR ELIGIBLE PARTICIPANTS.--
|
0020| A. The department shall develop and implement a
|
0021| boot camp program for certain delinquent offenders pursuant to
|
0022| the provisions of this section. The boot camp program shall
|
0023| include substance abuse counseling and treatment programs,
|
0024| general education diploma preparatory classes, manual labor
|
0025| assignments, physical training activities and personal
|
0001| development training. The boot camp program shall be conducted
|
0002| in a strict disciplinary environment. The department shall
|
0003| require that participants in the boot camp program complete a
|
0004| structured, six-month program.
|
0005| B. Participation in the boot camp program shall be
|
0006| limited to certain delinquent offenders adjudicated on or after
|
0007| July 1, 1997. Individuals eligible to participate in the
|
0008| program are adjudicated delinquent offenders who are thirteen
|
0009| years of age or older.
|
0010| C. The department shall develop and adopt
|
0011| regulations to provide for screening of all adjudicated
|
0012| delinquent offenders for the purpose of determining eligibility
|
0013| to participate in the boot camp program. The regulations shall
|
0014| provide that the screening occurs within thirty days of an
|
0015| individual's adjudication as a delinquent offender. Subsequent
|
0016| to the screening, the department may recommend to the court
|
0017| that a delinquent offender be assigned to participate in the
|
0018| boot camp program.

0019| D. If the court accepts the department's
|
0020| recommendation, the delinquent offender shall be transferred to
|
0021| the custody of the department for the purpose of participating
|
0022| in the boot camp program.
|
0023| E. The department shall develop and adopt
|
0024| regulations regarding criteria for successful completion of the
|
0025| boot camp program. The regulations shall also provide for
|
0001| appropriate disposition of delinquent offenders who
|
0002| successfully complete the program and for those offenders who
|
0003| fail to successfully complete the program. The department
|
0004| shall notify the court in writing when a participant in the
|
0005| boot camp program successfully completes or fails to complete
|
0006| the program.
|
0007| F. The department may contract with a public or
|
0008| private entity for the lease of a facility to house a boot camp
|
0009| program. The boot camp program shall be operated and
|
0010| administered by the department."
