0011| RELATING TO PUBLIC EMPLOYEES; PROVIDING FOR SALARY PAYMENT WHEN
|
0012| ENGAGED AS A CERTIFIED DISASTER SERVICES VOLUNTEER.
|

0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. PUBLIC EMPLOYEES--SALARY PAYMENT--DISASTER
|
0016| WORK.--
|
0017| A. A public employee may be granted special
|
0018| disaster leave and if so shall be paid his regular salary, up
|
0019| to a maximum of eighty hours per pay period for up to thirty
|
0020| working days in any calendar year, while serving as a disaster
|
0021| services volunteer in the case of a serious disaster; provided:
|
0022| (1) the employee has been certified as a
|
0023| disaster services volunteer by a nationally recognized disaster
|
0024| relief organization;
|
0025| (2) a nationally recognized disaster relief
|
0001| organization requests the services of the employee; and
|
0002| (3) the employee receives the approval of his
|
0003| employer.
|
0004| B. The personnel board shall establish by
|
0005| regulation criteria to be used:
|
0006| (1) by state employers to approve or
|
0007| disapprove a special disaster leave request;
|
0008| (2) to ensure that a public employee has been
|
0009| certified as a disaster services volunteer; and
|
0010| (3) to ensure that the special disaster leave
|
0011| shall not be deducted from the employee's regular leave.
|
0012| C. For purposes of this section:
|
0013| (1) "public employee" means a regular,
|
0014| nonprobationary employee of the state or its political
|
0015| subdivisions; and
|
0016| (2) "serious disaster" means, but is not
|
0017| limited to, a catastrophe such as a tornado, flood, hurricane,
|
0018| blizzard or other calamity that results in widespread property
|
0019| damage, general disruption, personal injury and death, or any
|
0020| combination of them, and that is of such magnitude as to
|
0021| require assistance from outside the area immediately impacted
|
0022| by the catastrophe.
