0011| RELATING TO EDUCATION; ENACTING THE CLASSROOM PIGGY BANK ACT;

0012| PROVIDING MONEY FOR TEACHERS FOR INSTRUCTIONAL AND EDUCATIONAL

0013| ACTIVITIES; MAKING AN APPROPRIATION.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. A new section of the Public School Code is
|
0017| enacted to read:
|
0018| "[NEW MATERIAL] SHORT TITLE.--This act may be cited as
|
0019| the "Classroom Piggy Bank Act"."
|
0020| Section 2. A new section of the Public School Code is
|
0021| enacted to read:
|
0022| "[NEW MATERIAL] DEFINITIONS.--As used in the Classroom
|
0023| Piggy Bank Act:
|
0024| A. "educational activities" means instructional
|
0025| events occurring in or outside the classroom for the
|
0001| educational benefit of children;
|
0002| B. "fund" means the classroom piggy bank fund;
|
0003| C. "instructional supplies" means incidental items
|
0004| or equipment for use in a classroom setting for the benefit of
|
0005| children; and
|
0006| D. "teacher" means a certified school instructor
|
0007| who, as an employee of a school district, spends the majority
|
0008| of the work day providing instruction to children in a
|
0009| classroom setting."

0010| Section 3. A new section of the Public School Code is
|
0011| enacted to read:
|
0012| "[NEW MATERIAL] CLASSROOM PIGGY BANK FUND CREATED.--The
|
0013| "classroom piggy bank fund" is created in the state treasury.
|
0014| Money in the fund is appropriated to the department of
|
0015| education for the purpose of making distributions to school
|
0016| districts for distribution to teachers in the school districts
|
0017| pursuant to the provisions of the Classroom Piggy Bank Act.
|
0018| Money in the fund shall be distributed upon warrant of the
|
0019| department of finance and administration pursuant to vouchers
|
0020| signed by the state superintendent. Unexpended or unencumbered
|
0021| balances remaining in the fund at the end of any fiscal year
|
0022| shall revert to the general fund."
|
0023| Section 4. A new section of the Public School Code is
|
0024| enacted to read:
|
0025| "[NEW MATERIAL] DISTRIBUTION OF THE FUND.--Money in the
|
0001| fund shall be distributed annually at the commencement of the
|
0002| regular school year. The state superintendent shall distribute
|
0003| money in the fund in a pro rata share to each school district
|
0004| on the basis of the number of full-time teachers employed by
|
0005| the district. Money distributed to each school district shall
|
0006| be transferred to the principal of each school in the school
|
0007| district for equal distribution to each full-time teacher in
|
0008| the school district. Money distributed from the fund shall be
|
0009| in addition to and shall not supplant a distribution made
|
0010| pursuant to the Instructional Material Law."

0011| Section 5. A new section of the Public School Code is
|
0012| enacted to read:
|
0013| "[NEW MATERIAL] EXPENDITURE OF MONEY--RECEIPTS.--
|
0014| A. Money distributed from the fund shall be
|
0015| expended only for the purchase of instructional supplies or for
|
0016| educational activities. Distributions to individual teachers
|
0017| may, at the discretion of the teacher, be combined with
|
0018| distributions to other teachers at the same school to enable
|
0019| joint purchases and enhanced purchasing power. Money from the
|
0020| fund shall not be used for basic building needs or on non-
|
0021| instruction-related uses.
|
0022| B. A teacher expending money distributed from the
|
0023| fund shall provide detailed receipts for all expenditures to
|
0024| the principal of the school within thirty days of the
|
0025| expenditure.
|
0001| C. Money distributed to a principal or a teacher
|
0002| that remains unexpended at the end of the regular school year
|
0003| shall be remitted to the school district for remittance to the
|
0004| fund."

0005| Section 6. APPROPRIATION.--Three million dollars
|
0006| ($3,000,000) is appropriated from the general fund to the
|
0007| classroom piggy bank fund for expenditure in fiscal year 1998
|
0008| for the purpose of making distributions pursuant to the
|
0009| Classroom Piggy Bank Act. Any unexpended or unencumbered
|
0010| balance remaining at the end of fiscal year 1998 shall revert
|
0011| to the general fund.
