[NEW MATERIAL] SHORT TITLE.--Sections 1 | 0017| through 6 of this act may be cited as the "Harm Reduction Act". | 0018| Section 2. [NEW MATERIAL] PURPOSE.--The purpose of the | 0019| Harm Reduction Act is to: | 0020| A. prevent the transmission of the human | 0021| immunodeficiency virus, the hepatitis B virus and other | 0022| blood-borne diseases that occur when sterile needles are not | 0023| used during intravenous drug use; and | 0024| B. require intravenous drug users to seek substance | 0025| abuse treatment and ensure that participants receive individual | 0001| counseling and education to decrease the risk of transmission | 0002| of blood-borne diseases. | 0003| Section 3. [NEW MATERIAL] DEFINITIONS.--As used in the | 0004| Harm Reduction Act: | 0005| A. "department" means the department of health; | 0006| B. "participant" or "client" means an intravenous | 0007| drug user who exchanges a used hypodermic syringe, needle or | 0008| other object used to inject controlled substances or controlled | 0009| substance analogs into the human body for a sterile hypodermic | 0010| syringe in compliance with the procedures of the program; and | 0011| C. "program" means the harm reduction pilot program | 0012| for the purpose of sterile hypodermic syringe and needle | 0013| exchange. | 0014| Section 4. [NEW MATERIAL] PROGRAM CREATED--DEPARTMENT | 0015| RESPONSIBILITIES.-- | 0016| A. The department shall: | 0017| (1) establish and administer a harm reduction | 0018| pilot program for the purpose of sterile hypodermic syringe and | 0019| needle exchange; | 0020| (2) compile data to assist in planning and | 0021| evaluating efforts to combat the spread of blood-borne | 0022| diseases; and | 0023| (3) make an annual report to the legislative | 0024| health and human services committee by October 1 each year. | 0025| B. The department may contract with private | 0001| providers to operate the program. | 0002| Section 5. [NEW MATERIAL] PROGRAM.--The program shall | 0003| provide: | 0004| A. free sterile hypodermic syringes and needles in | 0005| exchange for used hypodermic syringes, needles or other objects | 0006| used to inject controlled substances or controlled substance | 0007| analogs into the human body; | 0008| B. education to participants on the transmission of | 0009| the human immunodeficiency virus and prevention measures; and | 0010| C. substance abuse treatment services for | 0011| participants. | 0012| Section 6. [NEW MATERIAL] CRIMINAL LIABILITY.-- | 0013| Exchange of sterile hypodermic syringes and needles under the | 0014| program shall not constitute an offense under the Controlled | 0015| Substances Act for a participant, employee of the department or | 0016| its designee. A person shall not be provided immunity from | 0017| prosecution if he violates a law prohibiting or regulating the | 0018| use, possession, dispensing, distribution or promotion of drug | 0019| paraphernalia if he is not participating in the program as a | 0020| client or as an employee or designee of the department. | 0021| Section 7. Section 30-31-25.1 NMSA 1978 (being Laws 1981, | 0022| Chapter 31, Section 2) is amended to read: | 0023| "30-31-25.1. POSSESSION, DELIVERY, MANUFACTURE OR | 0024| DELIVERY TO A MINOR OF DRUG PARAPHERNALIA PROHIBITED.-- | 0025| A. It is unlawful for any person to use or possess | 0001| with intent to use drug paraphernalia to plant, propagate, | 0002| cultivate, grow, harvest, manufacture, compound, convert, | 0003| produce, process, prepare, test, analyze, pack, repack, store, | 0004| contain, conceal, inject, ingest, inhale or otherwise introduce | 0005| into the human body a controlled substance in violation of the | 0006| Controlled Substances Act. The provisions of this subsection | 0007| do not apply to a person directly participating in the harm | 0008| reduction pilot program, pursuant to the provisions of the Harm | 0009| Reduction Act. | 0010| B. It is unlawful for any person to deliver, | 0011| possess with intent to deliver or manufacture with the intent | 0012| to deliver drug paraphernalia with knowledge, or under | 0013| circumstances where one reasonably should know, that it will be | 0014| used to plant, propagate, cultivate, grow, harvest, | 0015| manufacture, compound, convert, produce, process, prepare, | 0016| test, analyze, pack, repack, store, contain, conceal, inject, | 0017| ingest, inhale or otherwise introduce into the human body a | 0018| controlled substance in violation of the Controlled Substances | 0019| Act. The provisions of this subsection do not apply to a | 0020| person directly participating in the harm reduction pilot | 0021| program, pursuant to the provisions of the Harm Reduction Act. | 0022| C. Any person who violates this section with | 0023| respect to [(1)] Subsection A of this section is guilty of a | 0024| misdemeanor and upon conviction shall be punished by a fine of | 0025| not less than fifty dollars ($50.00) nor more than one hundred | 0001| dollars ($100) or by imprisonment for a definite term less than | 0002| one year, or both. [(2)] Any person who violates this | 0003| section with respect to Subsection B of this section is guilty | 0004| of a misdemeanor. | 0005| D. [NEW MATERIAL] PROGRAM CREATED--DEPARTMENT | 0020| RESPONSIBILITIES.-- | 0021| A. The department shall: | 0022| (1) establish and administer a harm reduction | 0023| program for the purpose of sterile hypodermic syringe and | 0024| needle exchange; | 0025| (2) compile data to assist in planning and | 0001| evaluating efforts to combat the spread of blood-borne | 0002| diseases; and | 0003| (3) make an annual report, including legislative | 0004| recommendations, to the legislative health and human services | 0005| committee by October 1 each year. | 0006| B. Within ten days of the effective date of the Harm | 0007| Reduction Act, the department shall appoint an advisory | 0008| committee, to include representation from: | 0009| (1) the office of the attorney general; | 0010| (2) the New Mexico state police division of the | 0011| department of public safety; | 0012| (3) the human immunodeficiency virus sexually | 0013| transmitted disease bureau of the department; | 0014| (4) the director of the epidemiology division of | 0015| the department or his designee; | 0016| (5) a medical officer of the public health division | 0017| of the department; and | 0018| (6) other persons or representatives as chosen by | 0019| the secretary of health to ensure a thorough and unbiased | 0020| evaluation of the program established under the Harm Reduction | 0021| Act. | 0022| C. The advisory committee shall: | 0023| (1) develop policies and procedures for evaluation | 0024| of the harm reduction program; | 0025| (2) develop criteria for data collection and | 0001| program evaluation; and | 0002| (3) meet as necessary to analyze data and monitor | 0003| and produce a report on the harm reduction program. | 0004| D. The department may contract with private providers to | 0005| operate the program. | 0006| Section 5. [NEW MATERIAL] PROGRAM.--The program shall | 0007| provide: | 0008| A. sterile hypodermic syringes and needles in exchange | 0009| for used hypodermic syringes, needles or other objects used to | 0010| inject controlled substances or controlled substance analogs into | 0011| the human body; | 0012| B. education to participants on the transmission of the | 0013| human immunodeficiency virus, hepatitis B and C and prevention | 0014| measures; and | 0015| C. referral to substance abuse treatment services for | 0016| participants. | 0017| Section 6. [NEW MATERIAL] CRIMINAL LIABILITY.--Exchange | 0018| of sterile hypodermic syringes and needles under the program shall | 0019| not constitute an offense under the Controlled Substances Act for | 0020| a participant, employee of the department or its designee. A | 0021| person shall not be provided immunity from prosecution if he | 0022| violates a law prohibiting or regulating the use, possession, | 0023| dispensing, distribution or promotion of drug paraphernalia if he | 0024| is not participating in the program as a client or as an employee | 0025| or designee of the department. | 0001| Section 7. Section 30-31-25.1 NMSA 1978 (being Laws 1981, | 0002| Chapter 31, Section 2) is amended to read: | 0003| "30-31-25.1. The provisions of this subsection do not apply to | 0012| a person at the time he is coming to or returning from an actual | 0013| syringe or needle exchange operated pursuant to the provisions of | 0014| the Harm Reduction Act. | 0015| B. It is unlawful for any person to deliver, possess | 0016| with intent to deliver or manufacture with the intent to deliver | 0017| drug paraphernalia with knowledge, or under circumstances where | 0018| one reasonably should know, that it will be used to plant, | 0019| propagate, cultivate, grow, harvest, manufacture, compound, | 0020| convert, produce, process, prepare, test, analyze, pack, repack, | 0021| store, contain, conceal, inject, ingest, inhale or otherwise | 0022| introduce into the human body a controlled substance in violation | 0023| of the Controlled Substances Act. The provisions of this | 0024| subsection do not apply to department of health employees or their | 0025| designees while they are directly and immediately engaged in | 0001| activities related to the harm reduction program authorized by the | 0002| Harm Reduction Act. | 0003| C. Any person who violates this section with respect to | 0004| [(1)] Subsection A of this section is guilty of a misdemeanor | 0005| and upon conviction shall be punished by a fine of not less than | 0006| fifty dollars ($50.00) nor more than one hundred dollars ($100) or | 0007| by imprisonment for a definite term less than one year, or both. | 0008| [(2)] Any person who violates this section with respect to | 0009| Subsection B of this section is guilty of a misdemeanor. | 0010| D.
