MACIAS | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| AN ACT | 0011| RELATING TO CRIMINAL LAW; INCREASING THE CRIMINAL PENALTY FOR | 0012| HOMICIDE BY VEHICLE WHILE UNDER THE INFLUENCE OF INTOXICATING | 0013| LIQUOR OR DRUGS; AMENDING A SECTION OF THE NMSA 1978. | 0014| | 0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0016| Section 1. Section 66-8-101 NMSA 1978 (being Laws 1978, | 0017| Chapter 35, Section 509, as amended) is amended to read: | 0018| "66-8-101. HOMICIDE BY VEHICLE--GREAT BODILY [INJURY] | 0019| HARM BY VEHICLE.-- | 0020| A. Homicide by vehicle is the killing of a human | 0021| being in the unlawful operation of a motor vehicle. | 0022| B. Great bodily [injury] harm by vehicle is the | 0023| injuring of a human being, to the extent defined in Section | 0024| 30-1-12 NMSA 1978, in the unlawful operation of a motor | 0025| vehicle. | 0001| C. Any person who commits homicide by vehicle | 0002| while under the influence of intoxicating liquor or while under | 0003| the influence of any drug or while violating Section 66-8-113 | 0004| NMSA 1978 is guilty of a third degree felony resulting in the | 0005| death of a human being and shall be sentenced pursuant to the | 0006| provisions of Section 31-18-15 NMSA 1978. A violation of | 0007| speeding laws as set forth in the Motor Vehicle Code shall not, | 0008| per se, be a basis for violation of Section 66-8-113 NMSA | 0009| 1978. | 0010| [C.] D. Any person who commits [homicide by | 0011| vehicle or] great bodily [injury] harm by vehicle while | 0012| under the influence of intoxicating liquor or while under the | 0013| influence of any drug or while violating Section 66-8-113 NMSA | 0014| 1978 is guilty of a third degree felony and shall be sentenced | 0015| pursuant to the provisions of Section 31-18-15 NMSA 1978 | 0016| [provided that]. A violation of speeding laws as set | 0017| forth in the Motor Vehicle Code shall not, per se, be a basis | 0018| for violation of Section | 0019| 66-8-113 NMSA 1978. | 0020| [D.] E. Any person who commits homicide by | 0021| vehicle or great bodily [injury] harm by vehicle while | 0022| under the influence of intoxicating liquor or while under the | 0023| influence of any drug, as provided in Subsection C or D of | 0024| this section, and who has incurred a prior DWI conviction | 0025| within ten years of the occurrence for which he is being | 0001| sentenced under this section shall have his basic sentence | 0002| increased by two years for each prior DWI conviction. | 0003| [E.] F. For the purposes of this section, | 0004| "prior DWI conviction" means: | 0005| (1) a prior conviction under Section 66-8-102 | 0006| NMSA 1978; or | 0007| (2) a prior conviction in New Mexico or any | 0008| other jurisdiction, territory or possession of the United | 0009| States when the criminal act is driving under the influence of | 0010| alcohol or drugs. | 0011| [F.] G. Any person who willfully operates a | 0012| motor vehicle in violation of Subsection C of Section 30-22-1 | 0013| NMSA 1978 and directly or indirectly causes the death of or | 0014| great bodily [injury] harm to a human being is guilty of a | 0015| third degree felony and shall be sentenced pursuant to the | 0016| provisions of Section 31-18-15 NMSA 1978." | 0017| Section 2.
