0011| RELATING TO PRIMARY CARE; AMENDING SECTIONS OF THE NMSA 1978
|
0012| PERTAINING TO SECURING LOANS FOR CAPITAL PROJECTS; REPEALING
|
0013| SECTIONS OF THE NMSA 1978.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. Section 24-1C-1 NMSA 1978 (being Laws 1994,
|
0017| Chapter 62, Section 7) is amended to read:
|
0018| "24-1C-1. SHORT TITLE.--[Sections 7 through 16 of this
|
0019| act] Chapter 24, Article 1C NMSA 1978 may be cited as the
|
0020| "Primary Care Capital Funding Act"."
|
0021| Section 2. Section 24-1C-6 NMSA 1978 (being Laws 1994,
|
0022| Chapter 62, Section 12) is amended to read:
|
0023| "24-1C-6. DEPARTMENT--AUTHORITY--POWERS AND DUTIES.--
|
0024| A. The department and the authority shall
|
0025| administer the loan programs and contracts for services
|
0001| established pursuant to the provisions of the Primary Care
|
0002| Capital Funding Act. The department and authority shall:
|
0003| (1) enter into joint powers agreements with
|
0004| each other or other appropriate public agencies to carry out
|
0005| the provisions of that act; and
|
0006| (2) apply to any appropriate federal, state or
|
0007| local governmental agency or private organization for grants
|
0008| and gifts to carry out the provisions of that act or to fund
|
0009| allied community-based health care programs.
|
0010| B. The department or authority may, instead of a
|
0011| loan, contract for services with an eligible entity to provide
|
0012| free or reduced fee primary care services for sick and
|
0013| medically indigent persons as reasonably adequate legal
|
0014| consideration for money from the fund to the entity so it may
|
0015| acquire or construct a capital project to provide the services.
|
0016| C. The department and authority may:
|
0017| (1) make and enter into contracts and
|
0018| agreements necessary to carry out their powers and duties
|
0019| pursuant to the provisions of the Primary Care Capital Funding
|
0020| Act; and
|
0021| (2) do all things necessary or appropriate to
|
0022| carry out the provisions of the Primary Care Capital Funding
|
0023| Act.
|
0024| D. The authority is responsible for all financial
|
0025| duties of the programs, including:
|
0001| (1) administering the fund;
|
0002| (2) accounting for all money received,
|
0003| controlled or disbursed for capital projects in accordance with
|
0004| the provisions of the Primary Care Capital Funding Act;
|
0005| (3) evaluating and approving loans and
|
0006| contracts for services, including determining financial
|
0007| capacity of an eligible entity;
|
0008| (4) enforcing contract provisions of loans and
|
0009| contracts for services, including the ability to sue to recover
|
0010| money or property owed the state;
|
0011| (5) determining interest rates and other
|
0012| financial aspects of a loan and relevant terms of a contract
|
0013| for services; and
|
0014| (6) performing other duties in accordance with
|
0015| the provisions of the Primary Care Capital Funding Act,
|
0016| regulations promulgated pursuant to that act or joint powers
|
0017| agreements entered into with the department.
|
0018| E. The department is responsible for programmatic
|
0019| duties, including:
|
0020| (1) defining sick and medically indigent
|
0021| persons for purposes of the Primary Care Capital Funding Act;
|
0022| (2) establishing priorities for loans and
|
0023| contracts for services;
|
0024| (3) determining the appropriateness of the
|
0025| capital project;
|
0001| (4) evaluating the capability of an applicant
|
0002| to provide and maintain primary care or hospice services;
|
0003| (5) selecting recipients of loans and persons
|
0004| with whom to contract for services;
|
0005| (6) determining that capital projects comply
|
0006| with all state and federal licensing requirements; and
|
0007| (7) contracting with an eligible entity to
|
0008| provide primary care services without charge or at a reduced
|
0009| fee for sick and medically indigent persons as defined by the
|
0010| department.
|
0011| F. The authority may make a loan to an eligible
|
0012| entity to acquire [or], construct, repair or otherwise
|
0013| improve a capital project, provided there is a finding:
|
0014| (1) by the department that the project will
|
0015| provide primary care services to sick and medically indigent
|
0016| persons as defined by the department; and
|
0017| (2) by the authority that there is adequate
|
0018| protection through the use of real property liens, title
|
0019| insurance, security interests in or pledges of accounts and
|
0020| other assets, loan covenants and warranties, restrictions on
|
0021| other encumbrances and pledges for the state funds extended
|
0022| for the loan."
|
0023| Section 3. Section 24-1C-9 NMSA 1978 (being Laws 1994,
|
0024| Chapter 62, Section 15) is amended to read:
|
0025| "24-1C-9. ELIGIBLE ENTITY--CHANGE IN STATUS.--If an
|
0001| eligible entity that has received a loan or contract for
|
0002| services for a capital project ceases to maintain its nonprofit
|
0003| status or ceases to deliver primary care services at the site
|
0004| of the capital project for twelve consecutive months, the state
|
0005| [shall have the following remedies at its option, subject to
|
0006| other liens having preference:
|
0007| A. order liquidation of the premises and recover
|
0008| any loan balance or amount due on the contract and any interest
|
0009| previously forgiven on the loan, imputed at the prevailing
|
0010| interest rate at the time of the loan; or
|
0011| B. foreclose on the property and convert it to
|
0012| state use or transfer title to another eligible entity] may
|
0013| pursue the remedies provided in the loan agreement or contract
|
0014| for services."
|
0015| Section 4. REPEAL.--Sections 24-1C-7 and 24-1C-8 NMSA
|
0016| 1978 (being Laws 1994, Chapter 62, Sections 13 and 14) are
|
0017| repealed.
|
