0011| RELATING TO PUBLIC SCHOOL TRANSPORTATION; AMENDING THE
|
0012| CALCULATION OF THE TRANSPORTATION ALLOCATION.
|

0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. Section 22-8-29.1 NMSA 1978 (being Laws 1995,
|
0016| Chapter 208, Section 10, as amended) is amended to read:
|
0017| "22-8-29.1. CALCULATION OF TRANSPORTATION ALLOCATION.--
|
0018| A. The department [of education] shall calculate
|
0019| the transportation allocation for each school district in the
|
0020| following manner:
|
0021| (1) group [local] school districts on the
|
0022| basis of the average square miles served per student
|
0023| transported in the prior year;
|
0024| (2) in each group, calculate the prior year's
|
0025| average operational expenditure per student transported in each
|
0001| district;
|
0002| (3) calculate the average for the group by
|
0003| taking the total prior year's expenditure for the group and
|
0004| dividing it by the number of students in the group;
|
0005| (4) multiply the group average operational
|
0006| expenditure per student by the number of students transported
|
0007| on the fortieth day of the current year. Designate the product
|
0008| "A";
|
0009| (5) add "A" to the mileage supplement. The
|
0010| sum of "A" and the mileage supplement is "B";
|
0011| (6) for the 1995-96 [and the 1996-97]
|
0012| through the 1999-2000 school years, "B" shall not be less
|
0013| than ninety-five percent or more than one hundred fifteen
|
0014| percent of the district's previous year's operational
|
0015| allocation, provided that if "B" is less than ninety-five
|
0016| percent, "B" is deemed to equal ninety-five percent and if "B"
|
0017| is greater than one hundred fifteen percent, "B" is deemed
|
0018| equal to one hundred fifteen percent. Calculate "B"
|
0019| accordingly; and
|
0020| (7) multiply "B" by the transportation
|
0021| distribution adjustment factor.
|
0022| [B. For the 1997-98, 1998-99 and 1999-2000 school
|
0023| years, the transportation allocation for each school district
|
0024| shall not be less than ninety-five percent or more than one
|
0025| hundred fifteen percent of the 1996-97 school year's
|
0001| transportation allocation.
|
0002| C.] B. For districts transporting [less]
|
0003| fewer than seventy-five students, the department [of
|
0004| education] may [utilize] use alternative calculation
|
0005| methods to determine the transportation allocation pursuant to
|
0006| regulation of the state board."
|
0007| Section 2. EFFECTIVE DATE.--The effective date of the
|
0008| provisions of this act is July 1, 1997.
