LYONS | 0005| | 0006| | 0007| | 0008| FOR THE LEGISLATIVE EDUCATION STUDY COMMITTEE | 0009| | 0010| AN ACT | 0011| RELATING TO PUBLIC SCHOOL TRANSPORTATION; AUTHORIZING THE USE | 0012| OF CERTAIN TRANSPORTATION FUNDS FOR OTHER TRANSPORTATION- | 0013| RELATED SERVICES. | 0014| | 0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0016| Section 1. Section 22-8-26 NMSA 1978 (being Laws 1967, | 0017| Chapter 16, Section 76, as amended) is amended to read: | 0018| "22-8-26. TRANSPORTATION DISTRIBUTION.-- | 0019| A. Money in the transportation distribution of the | 0020| public school fund shall be used only for the purpose of making | 0021| payments to each school district for the to and from school | 0022| transportation costs of students in grades kindergarten through | 0023| twelve attending public school within the school district and | 0024| of three- and four-year-old children who meet the state board | 0025| approved criteria and definition of developmentally disabled | 0001| and for transportation of students to and from their regular | 0002| attendance centers and the place where vocational education | 0003| programs are being offered. | 0004| B. In the event a school district's transportation | 0005| allocation exceeds the amount required to meet obligations to | 0006| provide to and from transportation, three- and four-year-old | 0007| developmentally disabled transportation and [vocation] | 0008| vocational education transportation, the district shall | 0009| [revert] use the remaining transportation funds [to the | 0010| transportation distribution in the department] for other | 0011| transportation-related services. The district shall submit a | 0012| report to the department regarding expenditures for other | 0013| transportation-related services pursuant to Section 22-8-29 | 0014| NMSA 1978. | 0015| C. In the event the sum of the proposed | 0016| transportation allocations to each school district exceeds the | 0017| amounts in the transportation distribution, the allocation to | 0018| each school district shall be reduced in the proportion that | 0019| the local school district allocation bears to the total | 0020| statewide transportation distribution. | 0021| D. Local school boards, with the approval of the | 0022| state transportation director, may provide additional | 0023| transportation services [pursuant to Section 22-16-2 NMSA | 0024| 1978] to meet established program needs." | 0025| Section 2. Section 22-8-29 NMSA 1978 (being Laws 1967, | 0001| Chapter 16, Section 78, as amended) is amended to read: | 0002| "22-8-29. TRANSPORTATION [DISTRIBUTIONS] | 0003| DISTRIBUTION--REPORTS--PAYMENTS.-- | 0004| A. Prior to November 15 of each year, each local | 0005| school board of a school district shall report to the state | 0006| transportation director, upon forms furnished by the state | 0007| transportation director, the following information concerning | 0008| the district's operation on the fortieth day of school: | 0009| (1) the number and designation of school bus | 0010| routes in operation in the school district; | 0011| (2) the number of miles traveled by each | 0012| school bus on each school bus route, showing the route mileage | 0013| in accordance with the type of road surface traveled; | 0014| (3) the number of students transported on the | 0015| fortieth day of school; | 0016| (4) the projected number of students to be | 0017| transported in the next school year; | 0018| (5) the percentage of unpaved or unimproved | 0019| roads [utilized] used by school buses in the school | 0020| district; [and] | 0021| (6) the seating capacity, age and mileage of | 0022| each bus [utilized] used in the district for student | 0023| transportation; and | 0024| (7) the prior year's expenditures for other | 0025| transportation-related services made from remaining | 0001| transportation funds. | 0002| B. Each local school board of a school district | 0003| maintaining a school bus route shall make further reports to | 0004| the state transportation director at other times specified by | 0005| the state transportation director. | 0006| C. The state transportation director shall certify | 0007| to the state superintendent that the allocations from the | 0008| transportation [distributions] distribution to each school | 0009| district are based upon the transportation distribution formula | 0010| established in the Public School Code. The allocations for the | 0011| first six months of a school year shall be based upon the | 0012| tentative transportation budget of the school district for the | 0013| current fiscal year. Allocations to a school district for the | 0014| remainder of the school year shall adjust the amount received | 0015| by the school district so that it equals the amount the school | 0016| district is entitled to receive for the entire school year | 0017| based upon the November 15 report and subject to audit and | 0018| verification. | 0019| D.
