0012| RELATING TO CRIMINAL LAW; MAKING IT UNLAWFUL FOR A PERSON TO

0013| POSSESS ANY VISUAL OR PRINT MEDIUM DEPICTING A PROHIBITED

0014| SEXUAL ACT THAT INVOLVES A CHILD; PROVIDING PENALTIES; AMENDING
|
0015| SECTIONS OF THE SEXUAL EXPLOITATION OF CHILDREN ACT.

0017| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0018| Section 1. Section 30-6A-1 NMSA 1978 (being Laws 1984,
|
0019| Chapter 92, Section 1) is amended to read:
|
0020| "30-6A-1. SHORT TITLE.--[Sections 1 through 4 of this
|
act] Chapter 30, Article 6A NMSA 1978 may be cited as the
|
0022| "Sexual Exploitation of Children Act"."
|
0023| Section 2. Section 30-6A-3 NMSA 1978 (being Laws 1984,
|
0024| Chapter 92, Section 3, as amended) is amended to read:
|
0025| "30-6A-3. SEXUAL EXPLOITATION OF CHILDREN.--
|
0001| A. It is unlawful for any person to intentionally
|
0002| possess any visual or print medium depicting any prohibited
|
0003| sexual act or simulation of such an act if that person knows or
|
0004| has reason to know that the medium depicts any prohibited
|
0005| sexual act or simulation of such act and if that person knows
|
0006| or has reason to know that one or more of the participants in
|
0007| that act is a child under eighteen years of age. Any person
|
0008| who violates this subsection is guilty of a fourth degree
|
0009| felony.
|
0010| [A.] B. It is unlawful for any person to
|
0011| intentionally distribute or possess with intent to distribute
|
0012| any visual or print medium depicting any prohibited sexual act
|
0013| or simulation of such an act if that person knows or has reason
|
0014| to know that the medium depicts any prohibited sexual act or
|
0015| simulation of such act and if that person knows or has reason
|
0016| to know that one or more of the participants in that act is a
|
0017| child under eighteen years of age. Any person who violates
|
0018| this subsection is guilty of a third degree felony.
|
0019| [B.] C. It is unlawful for any person to
|
0020| intentionally cause or permit a child under eighteen years of
|
0021| age to engage in any prohibited sexual act or simulation of
|
0022| such an act if that person knows, has reason to know or intends
|
0023| that the act may be recorded in any visual or print medium or
|
0024| performed publicly. Any person who violates this subsection is
|
0025| guilty of a third degree felony, unless the child is under the
|
0001| age of thirteen, in which event the person is guilty of a
|
0002| second degree felony.
|
0003| [C.] D. It is unlawful for any person to
|
0004| intentionally manufacture any visual or print medium depicting
|
0005| any prohibited sexual act or simulation of such an act if one
|
0006| or more of the participants in that act is a child under
|
0007| eighteen years of age. Any person who violates this subsection
|
0008| is guilty of a second degree felony.
|
0009| [D.] E. The penalties provided for in this
|
0010| section shall be in addition to those set out in Section 30-9-
|
0011| 11 NMSA 1978."
|
0012| Section 3. EFFECTIVE DATE.--The effective date of the
|
0013| provisions of this act is July 1, 1997.

0025| "30-6A-2. DEFINITIONS.--As used in the Sexual Exploitation

0001| of Children Act:

0003| A. "prohibited sexual act" means:
|

0005| (1) sexual intercourse, including genital-genital,
|
0006| oral-genital, anal-genital or oral-anal, whether between persons
|
0007| of the same or opposite sex;
|
0008|
|
0009| (2) bestiality;
|
0010|
|
0011| (3) masturbation;
|
0012|
|
0013| (4) sadomasochistic abuse for the purpose of
|
0014| sexual stimulation; or
|
0015|
|
0016| (5) lewd and sexually explicit exhibition with a
|
0017| focus on the genitals or pubic area of any person for the purpose
|
0018| of sexual stimulation. "Prohibited sexual act" does not include
|
0019| erotic clothed dancing or downloading visual or print medium from
|
0020| a computer;
|
0021|
|
0022| B. "visual or print medium" means:
|
0023|
|
0024| (1) any film, photograph, negative, slide,
|
0025| computer diskette, videotape, videodisc or any computer or
|
0001| electronically generated imagery; or
|
0002|
|
0003| (2) any book, magazine or other form of
|
0004| publication or photographic reproduction containing or
|
0005| incorporating any film, photograph, negative, slide, computer
|
0006| diskette, videotape, videodisc or any computer generated or
|
0007| electronically generated imagery;
|
0008|
|
0009| C. "performed publicly" means performed in a place
|
0010| which is open to or used by the public; and
|
0011|
|
0012| D. "manufacture" means the production, processing,
|
0013| copying by any means, printing, packaging or repackaging of any
|
0014| visual or print medium depicting any prohibited sexual act or
|
0015| simulation of such an act if one or more of the participants in
|
0016| that act is a child under eighteen years of age."".

0018| 2. Renumber the succeeding section accordingly.
