0011| RELATING TO PUBLIC ASSISTANCE; AMENDING SECTION 27-2-7 NMSA
|
0012| 1978 (BEING LAWS 1973, CHAPTER 376, SECTION 10, AS AMENDED).
|

0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. Section 27-2-7 NMSA 1978 (being Laws 1973,
|
0016| Chapter 376, Section 10, as amended) is amended to read:
|
0017| "27-2-7. GENERAL ASSISTANCE PROGRAM--QUALIFICATIONS AND
|
0018| PAYMENTS.--
|
0019| A. Subject to the availability of state funds,
|
0020| public assistance shall be provided under a general assistance
|
0021| program to or on behalf of an eligible [persons] person
|
0022| who meets all eligibility conditions pursuant to Section 27-2-
|
0023| 3 NMSA 1978 and who:
|
0024| [(1) are under eighteen years of age and meet
|
0025| all eligibility conditions for aid to families with dependent
|
0001| children except the relationship to the person with whom they
|
0002| are living; or
|
0003| (2) are over the age of eighteen and are
|
0004| temporarily disabled, according to regulations of the board and
|
0005| are not receiving aid to families with dependent children; or
|
0006| (3) meet the qualifications under such other
|
0007| regulations for the general assistance program as the board
|
0008| shall establish from time to time.
|
0009| B. General assistance program payments may be made
|
0010| directly to the recipient or to the vendor of goods or services
|
0011| provided to the recipient. The board may by regulation limit
|
0012| the grants that are made to general assistance recipients.
|
0013| C. Whenever the board makes an adjustment in the
|
0014| standard of need for the aid to families with dependent
|
0015| children program pursuant to Section 13-17-3 NMSA 1953, it
|
0016| shall make a commensurate adjustment in the standard of need
|
0017| for the general assistance program]
|
0018| (1) is under eighteen years of age and lives
|
0019| with a caretaker that is not a parent or stepparent;
|
0020| (2) is over sixty years of age and the
|
0021| caretaker of an eligible person under the age of eighteen;
|
0022| (3) is the parent of an eligible person under
|
0023| the age of eighteen years, where the parent:
|
0024| (a) suffers from a permanent or
|
0025| temporary disability that prevents the parent from engaging in
|
0001| work;
|
0002| (b) is providing care for a totally
|
0003| disabled adult in the family;
|
0004| (c) is caring for a child with a
|
0005| disability who requires special parental care that cannot be
|
0006| provided through available daycare services;
|
0007| (d) has received temporary assistance
|
0008| for needy families for more than sixty months; or
|
0009| (e) is a lawfully resident noncitizen
|
0010| who would be a person eligible for public assistance if the
|
0011| parent were a citizen; or
|
0012| (4) is over the age of eighteen and:
|
0013| (a) is either permanently or temporarily
|
0014| disabled, according to regulations of the department;
|
0015| (b) is not otherwise receiving a grant
|
0016| of public assistance pursuant to the Public Assistance Act or
|
0017| the Personal Responsibility and Work Opportunity Reconciliation
|
0018| Act of 1996, excluding food assistance or medical assistance;
|
0019| (c) has applied for assistance based
|
0020| upon his disability pursuant to the Personal Responsibility and
|
0021| Work Opportunity Reconciliation Act of 1996; and
|
0022| (d) has executed an agreement
|
0023| authorizing the state to recoup public assistance paid pursuant
|
0024| to the general assistance program from disability assistance
|
0025| the person ultimately receives pursuant to the Personal
|
0001| Responsibility and Work Opportunity Reconciliation Act of 1996.
|
0002| B. General assistance program payments may be made
|
0003| directly to the recipient or to the vendor of goods and
|
0004| services provided to the recipient. The department may by
|
0005| regulation limit the grants that are made to general assistance
|
0006| recipients.
|
0007| C. The department may by regulation require
|
0008| recipients of general assistance to engage in programs of
|
0009| vocational rehabilitation or education or to seek work
|
0010| opportunities that are appropriate for the recipient and are
|
0011| designed to assist recipients to become self-sufficient.
|
0012| D. Whenever the department makes an adjustment in
|
0013| the standard of need pursuant to Section 27-2-3 NMSA 1978, it
|
0014| shall make a commensurate adjustment in the standard of need
|
0015| for the general assistance program."
