0011| RELATING TO GOVERNMENTAL CONDUCT; AMENDING THE GOVERNMENTAL

0012| CONDUCT ACT AND THE LOBBYIST REGULATION ACT TO PROHIBIT GIFTS

0013| FROM LOBBYISTS.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. A new section of the Governmental Conduct Act
|
0017| is enacted to read:
|
0018| "[NEW MATERIAL] BAN ON GIFTS.--
|
0019| A. No legislator or public officer or employee
|
0020| shall knowingly accept any gift in excess of fifty dollars
|
0021| ($50.00) from any of the following: a lobbyist; a lobbyist's
|
0022| employee; or a lobbyist's employer.
|
0023| B. For purposes of this section:
|
0024| (1) "gift" means any money, thing of value or
|
0025| promise thereof whether cash or in kind. The term "gift" does
|
0001| not include a political campaign contribution or reimbursement,
|
0002| payment or compensation permitted in connection with an
|
0003| honorarium pursuant to the provisions of Section 10-16-4.1 NMSA
|
0004| 1978;
|
0005| (2) "lobbyist" has the same meaning as that
|
0006| term is defined in Subsection E of Section 2-11-2 NMSA 1978;
|
0007| and
|
0008| (3) "lobbyist's employer" has the same meaning
|
0009| as that term is defined in Subsection F of Section 2-11-2 NMSA
|
0010| 1978."

0011| Section 2. A new section of the Lobbyist Regulation Act
|
0012| is enacted to read:
|
0013| "[NEW MATERIAL] BAN ON GIFTS.--
|
0014| A. No lobbyist, lobbyist's employee or lobbyist's
|
0015| employer shall give a gift in excess of fifty dollars ($50.00)
|
0016| to a legislator or public officer or employee.
|
0017| B. For purposes of this section, "gift" means any
|
0018| money, thing of value or promise thereof whether cash or in
|
0019| kind. The term "gift" does not include a political campaign
|
0020| contribution or any reimbursement, payment or compensation
|
0021| permitted in connection with an honorarium pursuant to the
