0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. Effective July 1, 1998, Section 1-5-1 NMSA
|
0017| 1978 (being Laws 1969, Chapter 240, Section 103, as amended) is
|
0018| repealed and a new Section 1-5-1 NMSA 1978 is enacted to read:
|
0019| "1-5-1. [NEW MATERIAL] SHORT TITLE.--Chapter 1,
|
0020| Article 5 NMSA 1978 may be cited as the "Centralized Voter
|
0021| Registration System Act"."
|
0022| Section 2. Effective July 1, 1998, Section 1-5-2 NMSA
|
0023| 1978 (being Laws 1969, Chapter 240, Section 104, as amended) is
|
0024| repealed and a new Section 1-5-2 NMSA 1978 is enacted to read:
|
0025| "1-5-2. [NEW MATERIAL] DEFINITIONS.--As used in the
|
0001| Centralized Voter Registration System Act:
|
0002| A. "county" means any county in this state;
|
0003| B. "county register" means an official file of
|
0004| original certificates of registration of the county arranged in
|
0005| alphabetical order by voter surname;
|
0006| C. "duplicate master record" means an exact
|
0007| duplicate of all data stored on the centralized voter
|
0008| registration system database;
|
0009| D. "voter list" means a list of registered voters
|
0010| prepared by the county clerk for purposes of an election;
|
0011| E. "signature roster" means a voter list with space
|
0012| provided opposite each voter's name for the voter's signature
|
0013| or witnessed mark;
|
0014| F. "centralized voter registration system" means
|
0015| the computers and computer data maintained and operated by the
|
0016| secretary of state and the county clerk in each county;
|
0017| G. "voter record" means all information extracted
|
0018| from a voter's certificate of registration and transferred to
|
0019| the central voter registration system database by the county
|
0020| clerk and any additional information pertaining to that voter
|
0021| included by the county clerk in the system's database;
|
0022| H. "mailing labels" means printed labels used for
|
0023| mailing purposes of selected voters arranged in the order in
|
0024| which requested providing the names and addresses of voters
|
0025| from the centralized voter registration system;
|
0001| I. "special voter list" means a list of selected
|
0002| voters arranged in the order in which requested from the
|
0003| centralized voter registration system;
|
0004| J. "statistical data" means information derived
|
0005| from the centralized voter registration system;
|
0006| K. "voter data" means selected information derived
|
0007| from the centralized voter registration system;
|
0008| L. "file maintenance list" means a list that
|
0009| reflects additions, deletions or changes to any voter record in
|
0010| the centralized voter registration system;
|
0011| M. "precinct voter list" means a list of voters
|
0012| arranged in alphabetical order by voter surname within and for
|
0013| a precinct; and
|
0014| N. "county voter list" means a list of voters
|
0015| arranged in alphabetical order by voter surname within and for
|
0016| a county."
|
0017| Section 3. Effective July 1, 1998, Section 1-5-3 NMSA
|
0018| 1978 (being Laws 1969, Chapter 240, Section 105, as amended) is
|
0019| repealed and a new Section 1-5-3 NMSA 1978 is enacted to read:
|
0020| "1-5-3. [NEW MATERIAL] MANDATORY COMPLIANCE--SECRETARY
|
0021| OF STATE TO ADMINISTER.--
|
0022| A. Compliance with the Centralized Voter
|
0023| Registration System Act is mandatory and supplemental to the
|
0024| provisions of the Election Code.
|
0025| B. The secretary of state shall administer the
|
0001| Centralized Voter Registration System Act and shall prescribe
|
0002| any regulations, forms, procedures and instructions necessary
|
0003| for the orderly transition to and the efficient implementation
|
0004| of the provisions of the Centralized Voter Registration System
|
0005| Act.
|
0006| C. The secretary of state and each county clerk
|
0007| shall maintain records containing all requests by the public
|
0008| for special voter lists, mailing labels, statistical data,
|
0009| voter data, precinct voter lists and county voter lists. The
|
0010| records shall indicate the requesting party, the date of the
|
0011| request, the date of fulfilling the request, charges made and
|
0012| any other information required by the secretary of state.
|
0013| Requests for registration lists shall be fulfilled within a
|
0014| period of ten working days.
|
0015| D. All registration records required by the
|
0016| Election Code shall be included as part of and maintained by
|
0017| the centralized voter registration system."
|
0018| Section 4. Effective July 1, 1998, Section 1-5-4 NMSA
|
0019| 1978 (being Laws 1969, Chapter 240, Section 106) is repealed
|
0020| and a new Section 1-5-4 NMSA 1978 is enacted to read:
|
0021| "1-5-4. [NEW MATERIAL] COUNTY REGISTER--
|
0022| ESTABLISHMENT.--
|
0023| The county clerk shall establish and maintain a county
|
0024| register. The county register shall be filed in fire-resistant
|
0025| files and maintained in a secure manner in the office of the
|
0001| county clerk. The files containing the county register shall
|
0002| be arranged to provide ready and convenient access and shall be
|
0003| kept locked except when being used by authorized persons in
|
0004| accordance with the Election Code."
|
0005| Section 5. Effective July 1, 1998, Section 1-5-5 NMSA
|
0006| 1978 (being Laws 1969, Chapter 240, Section 107, as amended) is
|
0007| repealed and a new Section 1-5-5 NMSA 1978 is enacted to read:
|
0008| "1-5-5. [NEW MATERIAL] ENTRY OF DATA INTO CENTRALIZED
|
0009| VOTER REGISTRATION SYSTEM.--
|
0010| A. The county clerk, upon receipt and acceptance of
|
0011| a properly completed certificate of registration within the
|
0012| period prescribed for registration, shall immediately enter in
|
0013| the proper space thereon the precinct of the voter.
|
0014| B. The county clerk shall cause the registration
|
0015| information of every registered voter in the county to be
|
0016| entered into the centralized voter registration system in
|
0017| accordance with any rules or procedures prescribed by the
|
0018| secretary of state.
|
0019| C. After entry of data into the centralized voter
|
0020| registration system, the county clerk shall file the original
|
0021| certificate of registration alphabetically in the county
|
0022| register.
|
0023| D. A certificate of registration shall not be
|
0024| removed from the county register pursuant to a cancellation of
|
0025| registration until the county clerk has entered into the
|
0001| centralized voter registration system all deletions and
|
0002| changes."
|
0003| Section 6. Effective July 1, 1998, Section 1-5-6 NMSA
|
0004| 1978 (being Laws 1969, Chapter 240, Section 108, as amended) is
|
0005| repealed and a new Section 1-5-6 NMSA 1978 is enacted to read:
|
0006| "1-5-6. [NEW MATERIAL] VOTER LISTS--SIGNATURE
|
0007| ROSTERS.--The county clerk shall provide for computer generated
|
0008| voter lists and signature rosters for all precincts within the
|
0009| county from the centralized voter registration system. The
|
0010| voter lists and signature rosters shall be used at any election
|
0011| for which registration of voters is required."
|
0012| Section 7. Effective July 1, 1998, Section 1-5-7 NMSA
|
0013| 1978 (being Laws 1969, Chapter 240, Section 109, as amended) is
|
0014| repealed and a new Section 1-5-7 NMSA 1978 is enacted to read:
|
0015| "1-5-7. [NEW MATERIAL] VOTER LISTS--SIGNATURE ROSTERS-
|
0016| -CONTENT.--
|
0017| A. The voter lists and signature rosters for any
|
0018| precinct shall contain for each voter, as shown on his
|
0019| certificate of registration:
|
0020| (1) his name;
|
0021| (2) his gender;
|
0022| (3) his residence address;
|
0023| (4) his mailing address;
|
0024| (5) his social security number;
|
0025| (6) his year of birth;
|
0001| (7) his party affiliation, if any; and
|
0002| (8) his precinct of residence.
|
0003| B. In addition, the names on each voter list and
|
0004| signature roster shall be numbered consecutively beginning with
|
0005| the number "1".
|
0006| C. On each page of each voter list and on each
|
0007| signature roster there shall be printed the page number and the
|
0008| date and name of the election for which they are to be used."
|
0009| Section 8. Effective July 1, 1998, Section 1-5-8 NMSA
|
0010| 1978 (being Laws 1969, Chapter 240, Section 110, as amended) is
|
0011| repealed and a new Section 1-5-8 NMSA 1978 is enacted to read:
|
0012| "1-5-8. [NEW MATERIAL] SIGNATURE ROSTER--VOTER LISTS--
|
0013| DISTRIBUTION.--
|
0014| A. One copy of the signature roster shall be
|
0015| prepared for each precinct. On the cover of the signature
|
0016| roster shall be printed the words, "Copy for the County Clerk".
|
0017| Upon its preparation and certification as to its accuracy and
|
0018| completeness, the county clerk shall deliver the copy of the
|
0019| signature roster to the precinct board.
|
0020| B. The county clerk shall prepare three copies of
|
0021| the voter list for each precinct. Of the three copies
|
0022| prepared, one copy shall not include voter social security
|
0023| numbers. He shall deliver two of the copies to each precinct
|
0024| board. One copy of the voter list shall be retained by the
|
0025| county clerk for verification purposes on election day and one
|
0001| copy for the secretary of state shall be marked to verify those
|
0002| voters on the list who voted.
|
0003| C. Two copies of the county voter list, arranged in
|
0004| alphabetical order, shall be prepared for election day for
|
0005| verification purposes only."
|
0006| Section 9. Effective July 1, 1998, Section 1-5-9 NMSA
|
0007| 1978 (being Laws 1969, Chapter 240, Section 111) is repealed
|
0008| and a new Section 1-5-9 NMSA 1978 is enacted to read:
|
0009| "1-5-9. [NEW MATERIAL] SIGNATURE ROSTERS--
|
0010| CERTIFICATE.--Any certificate required by the Election Code for
|
0011| poll books shall be similarly required for signature rosters in
|
0012| substantially the same form to the extent it serves the same
|
0013| purpose."
|
0014| Section 10. Effective July 1, 1998, Section 1-5-10 NMSA
|
0015| 1978 (being Laws 1969, Chapter 240, Section 112, as amended) is
|
0016| repealed and a new Section 1-5-10 NMSA 1978 is enacted to read:
|
0017| "1-5-10. [NEW MATERIAL] VOTER LISTS--SIGNATURE
|
0018| ROSTERS--USE DURING ELECTION.--
|
0019| A. Each precinct board using voter lists shall post
|
0020| securely at or near the entrance of the polling place one copy
|
0021| of the voter list for use of the voters prior to voting. The
|
0022| posted copy shall not contain a listing of voter social
|
0023| security numbers.
|
0024| B. The presiding judge of the precinct board shall
|
0025| assign one election judge of the board to be in charge of one
|
0001| copy of the voter list which shall be used to confirm the
|
0002| registration and voting of each person offering to vote.
|
0003| C. The presiding judge of the precinct board shall
|
0004| assign one election clerk to be in charge of the signature
|
0005| roster.
|
0006| D. The judge assigned to the voter list used for
|
0007| confirmation of registration and voting shall determine that
|
0008| each person offering to vote is registered and, in the case of
|
0009| a primary election, that such voter is registered in a party
|
0010| designated on the primary election ballot. If the person's
|
0011| registration is confirmed by the presence of his name on the
|
0012| voter list or if the person presents a certificate under the
|
0013| seal and signature of the county clerk showing that he is
|
0014| entitled to vote in the election and to vote in that precinct,
|
0015| then the judge shall announce to the election clerks the list
|
0016| number and the name of the voter as shown on the voter list.
|
0017| E. The election clerk shall locate that list number
|
0018| and name on the signature roster and shall require the voter to
|
0019| sign his usual signature or, if unable to write, to make his
|
0020| mark opposite his printed name. If the voter makes his mark,
|
0021| it shall be witnessed by one of the judges of the precinct
|
0022| board.
|
0023| F. No voter shall be permitted to vote until he has
|
0024| properly signed his usual signature or made his mark in the
|
0025| signature roster.
|
0001| G. After the poll is closed, the election clerk in
|
0002| charge of a signature roster shall draw a single horizontal
|
0003| line in ink through each signature space in the signature
|
0004| roster where no signature or mark appears."
|
0005| Section 11. Effective July 1, 1998, Section 1-5-11 NMSA
|
0006| 1978 (being Laws 1969, Chapter 240, Section 113, as amended) is
|
0007| repealed and a new Section 1-5-11 NMSA 1978 is enacted to read:
|
0008| "1-5-11. [NEW MATERIAL] VOTER LISTS--SIGNATURE
|
0009| ROSTERS--DISPOSITION AFTER ELECTION.--
|
0010| A. After the polls are closed, the signature roster
|
0011| shall be properly certified by the precinct board and returned
|
0012| to the county clerk with the election returns destined for the
|
0013| county clerk. The voter list marked for the secretary of state
|
0014| shall be returned to the secretary of state with the election
|
0015| returns destined for the secretary of state.
|
0016| B. The signed and certified signature rosters used
|
0017| in any election shall be considered a part of the election
|
0018| returns and treated accordingly. They shall be preserved and
|
0019| finally disposed of in the same manner as provided in the
|
0020| Election Code for election returns.
|
0021| C. The punishment for willful destruction,
|
0022| defacement, unauthorized alteration or improper disposition of
|
0023| signature rosters used in an election shall be the same as for
|
0024| similar treatment of election returns."
|
0025| Section 12. Effective July 1, 1998, Section 1-5-12 NMSA
|
0001| 1978 (being Laws 1969, Chapter 240, Section 114, as amended) is
|
0002| repealed and a new Section 1-5-12 NMSA is enacted to read:
|
0003| "1-5-12. [NEW MATERIAL] VOTER'S NAME NOT ON LIST OR
|
0004| ROSTER.--
|
0005| A. If a voter's name does not appear on the voter
|
0006| list and signature roster for the precinct in which he offers
|
0007| to vote, the voter shall be permitted to vote in such precinct
|
0008| provided the voter meets the requirements specified in the
|
0009| Election Code and otherwise meets the fail-safe voting
|
0010| provisions of the National Voter Registration Act.
|
0011| B. The election clerks in charge of the signature
|
0012| rosters shall add the voter's name and address in ink to the
|
0013| signature roster on the line immediately following the last
|
0014| entered voter's name, and the voter shall be allowed to cast
|
0015| his ballot provided he has first signed or marked both rosters.
|
0016| C. The voting machine public counter number or the
|
0017| ballot number for the voter shall be entered on his certificate
|
0018| of eligibility or copy of his certificate of registration. The
|
0019| certificate of eligibility or voter's copy of his certificate
|
0020| of registration shall be retained by the precinct board and
|
0021| returned to the county clerk with the election returns.
|
0022| D. Such certificate of eligibility shall be valid
|
0023| for use only in the precinct and for the election and date
|
0024| specified thereon.
|
0025| E. In a primary election, a voter whose party
|
0001| affiliation is not shown on the certificate of eligibility or
|
0002| copy of his certificate of registration shall not be permitted
|
0003| to receive or cast a ballot. No voter shall be permitted to
|
0004| vote for a candidate of a party different from the party
|
0005| designation shown on his certificate of eligibility or the copy
|
0006| of his certificate of registration.
|
0007| F. No verbal authorization from the county clerk to
|
0008| allow a person to vote under this section shall be permitted."
|
0009| Section 13. Effective July 1, 1998, Section 1-5-14 NMSA
|
0010| 1978 (being Laws 1969, Chapter 240, Section 118, as amended) is
|
0011| repealed and a new Section 1-5-14 NMSA 1978 is enacted to read:
|
0012| "1-5-14. [NEW MATERIAL] FILE MAINTENANCE LIST.--
|
0013| A. On the first regular working day of each month
|
0014| the county clerk shall prepare a file maintenance list showing
|
0015| all additions, deletions or other changes for the preceding
|
0016| month.
|
0017| B. One copy of the list shall be stored by the
|
0018| county clerk for at least six years.
|
0019| C. The county clerk shall provide one copy of the
|
0020| file maintenance list to the county chairman of each of the
|
0021| major political parties in the county. The file maintenance
|
0022| list shall not include the voter's social security number,
|
0023| codes used to identify the agency where the voter registered,
|
0024| voter's day and month of birth or voter's telephone number, if
|
0025| prohibited by the voter."
|
0001| Section 14. Effective July 1, 1998, Section 1-5-15 NMSA
|
0002| 1978 (being Laws 1969, Chapter 240, Section 120, as amended) is
|
0003| repealed and a new Section 1-5-15 NMSA 1978 is enacted to read:
|
0004| "1-5-15. [NEW MATERIAL] VOTER REGISTRATION SYSTEM
|
0005| DATABASE--DUPLICATE.--
|
0006| A. The secretary of state shall provide by rule for
|
0007| the timely back-up of the centralized voter registration
|
0008| system's database and the production of a duplicate master
|
0009| record.
|
0010| B. In case of loss or damage to the centralized
|
0011| voter registration system, or any portion thereof, the
|
0012| duplicate master record shall be used to duplicate the system's
|
0013| database, or any portion thereof. No other use shall be made
|
0014| of the duplicate master record.
|
0015| C. The secretary of state and the county clerk
|
0016| shall ensure that the centralized voter records system and any
|
0017| duplicate master record thereof is protected against loss,
|
0018| damage, unauthorized access and unauthorized alteration.
|
0019| D. Any duplicate master record shall be stored in a
|
0020| fire-resistant safe or vault located at a place remote from,
|
0021| and which is considered a separate damage risk from, the place
|
0022| of storage or use of the centralized voter registration system.
|
0023| E. No information or data derived from the
|
0024| centralized voter registration system, or any portion thereof,
|
0025| or any duplicate master record, or any portion thereof, shall
|
0001| be stored or transported in any manner that will subject either
|
0002| or both to possible loss or damage from common or related
|
0003| perils."
|
0004| Section 15. Effective July 1, 1998, Section 1-5-19 NMSA
|
0005| 1978 (being Laws 1969, Chapter 240, Section 125, as amended) is
|
0006| repealed and a new Section 1-5-19 NMSA 1978 is enacted to read:
|
0007| "1-5-19. [NEW MATERIAL] REGISTRATION--INFORMATION
|
0008| REQUIRED.--
|
0009| A. The certificate of registration form shall
|
0010| require the following elements of information concerning the
|
0011| applicant for registration: name, gender, residence address,
|
0012| municipality, mailing address, county of former registration,
|
0013| social security number, date of birth, political party
|
0014| affiliation, if any, zip code, telephone number at the
|
0015| applicant's option and statement of qualification for voting.
|
0016| B. Provision shall be made for the usual signature
|
0017| or mark of the applicant, the signature of the county clerk,
|
0018| and for the dates of such signatures.
|
0019| C. The certificate of registration form may
|
0020| indicate whether it is completed by the applicant as a new
|
0021| registration, a change to the existing registration or a
|
0022| cancellation of an existing registration.
|
0023| D. The certificate of registration forms shall be
|
0024| serially numbered and shall be furnished promptly and in
|
0025| adequate supply by the secretary of state upon request by the
|
0001| county clerk."
|
0002| Section 16. Effective July 1, 1998, Section 1-5-20 NMSA
|
0003| 1978 (being Laws 1977, Chapter 222, Section 11, as amended) is
|
0004| repealed and a new Section 1-5-20 NMSA 1978 is enacted to read:
|
0005| "1-5-20. [NEW MATERIAL] FILING--REGISTRATION.--The
|
0006| secretary of state shall prescribe the method of filing and
|
0007| maintaining certificates of registration in any county."
|
0008| Section 17. Effective July 1, 1998, Section 1-5-22 NMSA
|
0009| 1978 (being Laws 1975, Chapter 255, Section 76) is repealed and
|
0010| a new Section 1-5-22 NMSA 1978 is enacted to read:
|
0011| "1-5-22. [NEW MATERIAL] UNLAWFUL DISPOSITION OF
|
0012| INFORMATION OR DATA--PENALTY.--
|
0013| A. Unlawful disposition of information or data
|
0014| derived from the centralized voter registration system consists
|
0015| of the willful selling, loaning or otherwise surrendering of
|
0016| any data derived from the centralized voter registration system
|
0017| or any duplicate master record, or a portion thereof, by any
|
0018| person for any purpose not authorized by the Centralized Voter
|
0019| Registration System Act or to any person not authorized by that
|
0020| act to have possession of data derived from the centralized
|
0021| voter registration system.
|
0022| B. Any person authorized by the Centralized Voter
|
0023| Registration System Act or any other provision of law to access
|
0024| or possess data derived from the centralized voter registration
|
0025| system who commits unlawful disposition of data derived from
|
0001| the centralized voter registration system database or duplicate
|
0002| master record, or any portion thereof, is guilty of a fourth
|
0003| degree felony."
|
0004| Section 18. Effective July 1, 1998, Section 1-5-23 NMSA
|
0005| 1978 (being Laws 1975, Chapter 255, Section 77) is repealed and
|
0006| a new Section 1-5-23 NMSA 1978 is enacted to read:
|
0007| "1-5-23. [NEW MATERIAL] UNLAWFUL DESTRUCTION OR
|
0008| ALTERATION OF VOTER REGISTRATION SYSTEM--PENALTY.--
|
0009| A. Unlawful destruction or alteration of the
|
0010| centralized voter registration system or duplicate master
|
0011| record, or any portion thereof, or file maintenance list, or
|
0012| any portion thereof, consists of the unauthorized destruction
|
0013| of, or the unauthorized alteration of, or the erasure of
|
0014| information from, or the rendering unusable, or any portion
|
0015| thereof, for their lawfully intended purpose by any person.
|
0016| B. Any person who commits unlawful destruction or
|
0017| alteration of the centralized voter registration system or
|
0018| duplicate master record, or any portion thereof, or file
|
0019| maintenance list, or any portion thereof, is guilty of a fourth
|
0020| degree felony."
|
0021| Section 19. Effective July 1, 1998, Section 1-5-24 NMSA
|
0022| 1978 (being Laws 1975, Chapter 255, Section 78, as amended) is
|
0023| repealed and a new Section 1-5-24 NMSA 1978 is enacted to read:
|
0024| "1-5-24. [NEW MATERIAL] REQUESTS FOR STATISTICAL DATA,
|
0025| VOTER DATA, MAILING LABELS OR SPECIAL VOTER LISTS.--
|
0001| A. The county clerk and secretary of state shall
|
0002| permit the release of any voter data, statistical data, mailing
|
0003| labels, special voter lists, precinct voter lists or county
|
0004| voter lists only upon written request by the requester of the
|
0005| data, labels or lists as provided in this section. All
|
0006| requesters shall be treated equally in regard to the charges
|
0007| and the furnishing of the requested data, labels or lists.
|
0008| B. In furnishing voter data or special voter lists,
|
0009| precinct voter lists and county voter lists, the county clerk
|
0010| and the secretary of state are prohibited from providing data
|
0011| or lists that include a voter's social security number, a code
|
0012| used to identify the agency where the voter registered, a
|
0013| voter's day and month of birth or the voter's telephone number,
|
0014| if release was not authorized by the voter.
|
0015| C. Each requester of voter data, mailing labels or
|
0016| special voter lists, precinct voter lists and county voter
|
0017| lists shall sign an affidavit that information contained in the
|
0018| voter data, mailing labels and special voter lists, precinct
|
0019| voter lists and county voter lists shall be used for
|
0020| governmental or election and election campaign purposes only
|
0021| and shall not be made available or used for commercial or any
|
0022| unlawful purposes.
|
0023| D. Each requester of statistical data shall sign an
|
0024| affidavit that such statistical data shall be used for
|
0025| information or research purposes only and shall not be made
|
0001| available or used for commercial or any unlawful purposes.
|
0002| E. The secretary of state shall prescribe the form
|
0003| of the affidavit."
|
0004| Section 20. Effective July 1, 1998, Section 1-5-25 NMSA
|
0005| 1978 (being Laws 1975, Chapter 255, Section 79) is repealed and
|
0006| a new Section 1-5-25 NMSA 1978 is enacted to read:
|
0007| "1-5-25. [NEW MATERIAL] UNLAWFUL USE OF STATISTICAL
|
0008| DATA--UNLAWFUL USE OF VOTER DATA, MAILING LABELS OR SPECIAL
|
0009| VOTER LISTS--PENALTIES.--
|
0010| A. Unlawful use of statistical data consists of the
|
0011| use of statistical data in such a manner as to derive
|
0012| information, the use or possession of which would be otherwise
|
0013| prohibited under the Centralized Voter Registration System Act.
|
0014| B. Unlawful use of voter data, mailing labels or
|
0015| special voter lists consists of the knowing and willful use of
|
0016| such information for purposes prohibited by the Centralized
|
0017| Voter Registration System Act.
|
0018| C. Any person or entity, or agent thereof, who
|
0019| commits unlawful use of statistical data, voter data, mailing
|
0020| labels or special voter lists is guilty of a fourth degree
|
0021| felony and upon conviction shall be fined ten dollars ($10.00)
|
0022| for each and every line of voter information that was
|
0023| unlawfully used.
|
0024| D. Each and every unlawful use of statistical data,
|
0025| voter data, mailing labels or special voter lists constitutes a
|
0001| separate offense."
|
0002| Section 21. Effective July 1, 1998, Section 1-5-27 NMSA
|
0003| 1978 (being Laws 1975, Chapter 255, Section 81, as amended) is
|
0004| repealed and a new Section 1-5-27 NMSA 1978 is enacted to read:
|
0005| "1-5-27. [NEW MATERIAL] CREATION OF CENTRALIZED VOTER
|
0006| REGISTRATION SYSTEM ADVISORY COMMITTEE.--
|
0007| A. There is created the "centralized voter
|
0008| registration system advisory committee" consisting of the
|
0009| director of the bureau of elections, the information systems
|
0010| manager from the office of the secretary of state and six
|
0011| members appointed by the secretary of state, as follows:
|
0012| (1) four county clerks selected from a list
|
0013| submitted by the recognized state association of county clerks;
|
0014| and
|
0015| (2) two registered voters.
|
0016| B. The director of the bureau of elections shall
|
0017| serve as chair of the advisory committee. No more than four of
|
0018| the eight appointed members shall be registered from the same
|
0019| political party."
|
0020| Section 22. Effective July 1, 1998, Section 1-5-28 NMSA
|
0021| 1978 (being Laws 1975, Chapter 255, Section 82) is repealed and
|
0022| a new Section 1-5-28 NMSA 1978 is enacted to read:
|
0023| "1-5-28. [NEW MATERIAL] DUTIES OF CENTRALIZED VOTER
|
0024| REGISTRATION SYSTEM ADVISORY COMMITTEE.--The centralized voter
|
0025| registration system advisory committee shall:
|
0001| A. recommend procedures for the orderly and timely
|
0002| conversion of voter registration data in the existing county
|
0003| database to the centralized voter registration system;
|
0004| B. review any uniform procedures proposed by the
|
0005| secretary of state for the implementation, maintenance and
|
0006| operation of the centralized voter registration system; and
|
0007| C. recommend changes or modifications to any
|
0008| uniform procedures or rules adopted by the secretary of state
|
0009| for the implementation, maintenance and operation of the
|
0010| centralized voter registration system."
|
0011| Section 23. Effective July 1, 1998, Section 1-5-29 NMSA
|
0012| 1978 (being Laws 1975, Chapter 255, Section 83, as amended) is
|
0013| repealed and a new Section 1-5-29 NMSA 1978 is enacted to read:
|
0014| "1-5-29. [NEW MATERIAL] CENTRALIZED VOTER REGISTRATION
|
0015| SYSTEM ADVISORY COMMITTEE--COMPENSATION--MEETINGS.--
|
0016| A. Members of the centralized voter registration
|
0017| system advisory committee, except the director of the bureau of
|
0018| elections and the information systems manager, shall be paid
|
0019| per diem and mileage as provided in the Per Diem and Mileage
|
0020| Act for nonsalaried state officers.
|
0021| B. No less than two meetings shall be called
|
0022| annually by the secretary of state."
|
0023| Section 24. Effective July 1, 1998, Section 1-5-30 NMSA
|
0024| 1978 (being Laws 1989, Chapter 298, Section 1) is repealed and
|
0025| a new Section 1-5-30 NMSA 1978 is enacted to read:
|
0001| "1-5-30. [NEW MATERIAL] SECRETARY OF STATE--
|
0002| ESTABLISHMENT OF CENTRALIZED VOTER REGISTRATION SYSTEM.--
|
0003| A. The secretary of state shall enter into a
|
0004| contract for the purchase of any hardware, software and
|
0005| consulting services necessary to establish and implement the
|
0006| centralized voter registration system on a statewide basis
|
0007| consistent with the provisions of the Procurement Code. The
|
0008| secretary of state shall supervise the implementation of the
|
0009| centralized voter registration system in each county.
|
0010| B. The secretary of state shall ensure that the
|
0011| centralized voter registration system includes all generally
|
0012| accepted industry standards for security and protection of the
|
0013| system's database. The secretary of state shall also ensure
|
0014| that any centralized voter registration system implemented
|
0015| provides the means for accurately converting the existing voter
|
0016| registration databases maintained by the county clerks to the
|
0017| centralized voter registration system.
|
0018| C. The centralized voter registration system shall:
|
0019| (1) link the secretary of state and all county
|
0020| clerks to a fully computerized centralized voter registration
|
0021| database;
|
0022| (2) permit a county clerk to add a voter's
|
0023| record to the centralized voter registration system database,
|
0024| change information in a voter record or delete a duplicate
|
0025| voter record or a voter record from the system's database upon
|
0001| the cancellation of a certificate of registration as provided
|
0002| by the Election Code;
|
0003| (3) permit a county clerk and the bureau of
|
0004| elections to access the system's database for review and search
|
0005| capabilities for any lawful purpose and the preparation of
|
0006| mailing labels, special voter lists, precinct voter lists and
|
0007| county voter lists; and
|
0008| (4) provide a means by which a county clerk
|
0009| may automatically assign a voter to his precinct for voting
|
0010| purposes when a street index exists for the entire county or
|
0011| any part thereof."
|
0012| Section 25. Section 1-5-31 NMSA 1978 (being Laws 1989,
|
0013| Chapter 298, Section 2) is repealed and a new Section 1-5-31
|
0014| NMSA 1978 is enacted to read:
|
0015| "1-5-31. [NEW MATERIAL] SECRETARY OF STATE--UNIFORM
|
0016| PROCEDURES FOR COUNTIES.--The secretary of state shall:
|
0017| A. adopt uniform rules and procedures for the
|
0018| implementation, maintenance and operation of the centralized
|
0019| voter registration system;
|
0020| B. prescribe forms compatible with the statewide
|
0021| centralized voter registration system; and
|
0022| C. ensure that training opportunities are available
|
0023| to each county clerk in the maintenance and operation of the
|
0024| centralized voter registration system."
|
0025| Section 26. APPROPRIATION.--Two million seven hundred
|
0001| fifty thousand dollars ($2,750,000) is appropriated from the
|
0002| general fund to the office of the secretary of state for
|
0003| expenditure in fiscal year 1998 for the purpose of implementing
|
0004| a statewide centralized voter registration system. Any
|
0005| unexpended or unencumbered balance remaining at the end of
|
0006| fiscal year 1998 shall revert to the general fund.
|
0007| Section 27. REPEAL.--Effective July 1, 1998, Sections
|
0008| 1-5-13, 1-5-16 through 1-5-18, 1-5-21 and 1-5-26 NMSA 1978
|
0009| (being Laws 1969, Chapter 240, Sections 115, 121, 122 and 124
|
0010| and Laws 1975, Chapter 255, Sections 75 and 80, as amended) are
|
0011| repealed.
