0011| RELATING TO MOTOR VEHICLES; PROVIDING FOR SALESPERSON LICENSING
|
0012| FEES; RESTRICTING CERTAIN SALES ACTIVITIES; PROVIDING LICENSING
|
0013| REQUIREMENTS; AMENDING AND ENACTING CERTAIN SECTIONS OF THE
|
0014| MOTOR VEHICLE CODE.
|

|
0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. Section 66-1-4.19 NMSA 1978 (being Laws 1990,
|
0018| Chapter 120, Section 20) is amended to read:
|
0019| "66-1-4.19. DEFINITIONS.--As used in the Motor Vehicle
|
0020| Code:
|
0021| A. "validating sticker" means the tab or sticker
|
0022| issued by the division to signify, upon a registration plate,
|
0023| renewed registration;
|
0024| B. "vehicle" means every device in, upon or by
|
0025| which any person or property is or may be transported or drawn
|
0001| upon a highway, including any frame, chassis or body of any
|
0002| vehicle or motor vehicle, except devices moved exclusively by
|
0003| human power or used exclusively upon stationary rails or
|
0004| tracks; [and]
|
0005| C. "vehicle salesperson" means any individual who,
|
0006| for any compensation, whether from a dealer or other person,
|
0007| buys, sells or exchanges or negotiates or attempts to negotiate
|
0008| a sale, lease or exchange of an interest in a motor vehicle
|
0009| required to be registered under the Motor Vehicle Code or
|
0010| induces or attempts to induce any other person to buy, lease or
|
0011| exchange an interest in such a vehicle. "Vehicle salesperson"
|
0012| does not include:
|
0013| (1) dealers, distributors or manufacturers;
|
0014| (2) receivers, trustees, administrators,
|
0015| executors, guardians or other persons appointed by or acting
|
0016| under judgment, decree or order of any court;
|
0017| (3) public officers while performing their
|
0018| duties as such officers;
|
0019| (4) persons making casual sales of their own
|
0020| vehicles;
|
0021| (5) finance companies, banks and other lending
|
0022| institutions making sales of repossessed vehicles;
|
0023| (6) licensed brokers under the Manufactured
|
0024| Housing Act who, for a fee, commission or other valuable
|
0025| consideration, engage in brokerage activities related to the
|
0001| sale, exchange or lease-purchase of pre-owned manufactured
|
0002| homes on sites installed for a consumer;
|
0003| (7) persons selling only motorcycles or
|
0004| snowmobiles;
|
0005| (8) persons arranging the lease of a vehicle
|
0006| for less than one hundred eighty days; or
|
0007| (9) persons whose principal duties in the
|
0008| business of a dealer do not involve inducements or
|
0009| solicitations to transfer an interest in a vehicle required to
|
0010| be registered under the Motor Vehicle Code or holding oneself
|
0011| out as assisting in such a transaction; and
|
0012| [C.] D. "vehicle-business number" means the
|
0013| distinctive registration number given by the division to any
|
0014| manufacturer, wrecker of vehicles or dealer."
|
0015| Section 2. Section 66-4-4 NMSA 1978 (being Laws 1978,
|
0016| Chapter 35, Section 217) is amended to read:
|
0017| "66-4-4. CRIMINAL OFFENDER'S CHARACTER EVALUATION.--The
|
0018| provisions of the Criminal Offender Employment Act [shall]
|
0019| govern any consideration of criminal records required or
|
0020| permitted by Sections [64-4-1 through 64-4-9 NMSA 1953] 66-
|
0021| 4-1 through 66-4-9 NMSA 1978; provided that no license to carry
|
0022| on the business of dealer shall be issued to a person or a
|
0023| corporation owned or controlled by a person convicted of a
|
0024| felony. The division shall have the authority to require the
|
0025| submission of information necessary for the enforcement of this
|
0001| section."
|
0002| Section 3. A new section of the Motor Vehicle Code is
|
0003| enacted to read:
|
0004| "[NEW MATERIAL] VEHICLE SALESPERSON--LICENSE REQUIRED.-
|
0005| -
|
0006| A. No person, unless licensed to do so by the
|
0007| division, shall carry on or conduct the activities of a vehicle
|
0008| salesperson.
|
0009| B. The applicant for a vehicle salesperson license
|
0010| shall submit to the director:
|
0011| (1) a completed application on a form
|
0012| prescribed by the director;
|
0013| (2) a fee of fifty dollars ($50.00) to be paid
|
0014| every two years from the date of the initial application;
|
0015| (3) two complete sets of fingerprints taken
|
0016| under the supervision of and certified to by an officer of the
|
0017| New Mexico state police, a county sheriff or a municipal chief
|
0018| of police, a consent form to undergo a federal bureau of
|
0019| investigation background check and payment for the cost of the
|
0020| federal bureau of investigation background check; and
|
0021| (4) a written statement by a licensed dealer
|
0022| by whom the applicant is or will be employed, certifying that
|
0023| the applicant has been accepted by the licensed dealer for
|
0024| employment as a vehicle salesperson."
|
0025| Section 4. A new section of the Motor Vehicle Code is
|
0001| enacted to read:
|
0002| "[NEW MATERIAL] VEHICLE SALESPERSON--QUALIFICATIONS.--
|
0003| No person shall be licensed as a vehicle salesperson who:
|
0004| A. does not have a valid New Mexico license to
|
0005| operate a motor vehicle;
|
0006| B. has had a license to operate a motor vehicle
|
0007| suspended twice within the five years immediately preceding
|
0008| licensure for operating a motor vehicle while under the
|
0009| influence of intoxicating liquor or drugs or for failure to
|
0010| submit to a test to determine the alcoholic content of his
|
0011| blood for the purpose of determining whether he was so
|
0012| operating a vehicle; or
|
0013| C. has been convicted of a felony."
|
0014| Section 5. A new section of the Motor Vehicle Code is
|
0015| enacted to read:
|
0016| "[NEW MATERIAL] EMPLOYMENT TERMINATION--LICENSE
|
0017| REISSUANCE.--
|
0018| A. A vehicle salesperson license shall be issued to
|
0019| the salesperson, but shall be kept in the physical possession
|
0020| of the dealer at all times, except when requested by a
|
0021| government official or a member of the public.
|
0022| B. Upon termination of employment of any vehicle
|
0023| salesperson, the dealer shall send notice of the termination,
|
0024| together with the salesperson's license, to the division within
|
0025| ten days of the termination. If the salesperson is going to
|
0001| work as a salesperson for another dealer, the individual may
|
0002| submit a new application, on a form prescribed by the division,
|
0003| but without fingerprints and with an application fee of ten
|
0004| dollars ($10.00). The division shall re-issue the new license
|
0005| within ten days of receiving the application."
|
0006| Section 6. A new section of the Motor Vehicle Code is
|
0007| enacted to read:
|
0008| "[NEW MATERIAL] TEMPORARY LICENSE.--Upon application,
|
0009| the division shall issue a temporary license to any individual
|
0010| applying for a permanent vehicle salesperson license, other
|
0011| than a reissuance. The temporary license shall be valid until
|
0012| the permanent license is issued, but in no case any longer than
|
0013| sixty days from issuance."
|
0014| Section 7. A new section of the Motor Vehicle Code is
|
0015| enacted to read:
|
0016| "[NEW MATERIAL] LICENSE SUSPENSION OR REVOCATION.--
|
0017| After notice and hearing, the division may suspend or revoke
|
0018| the license of any vehicle salesperson for:
|
0019| A. failure to meet the statutory requirements for
|
0020| the license; or
|
0021| B. violation of any statute or rule governing the
|
0022| sale of motor vehicles or requiring any disclosure in
|
0023| connection with the sale."
|
0024| Section 8. TEMPORARY PROVISION.--Any individual who was
|
0025| engaged on January 1, 1997 in activities that require a vehicle
|
0001| salesperson license after the effective date of this act may
|
0002| apply to the motor vehicle division of the taxation and revenue
|
0003| department for a license, notwithstanding the fact that the
|
0004| individual does not meet the requirements for licensure. The
|
0005| division shall issue a license, and requirements for future
|
0006| licensure shall be determined solely on the basis of
|
0007| circumstances occurring after the issuance.
