0011| RELATING TO AGRICULTURE; AMENDING AND ENACTING SECTIONS OF THE
|
0012| COTTON BOLL WEEVIL CONTROL ACT TO PROVIDE FOR BOLL WEEVIL
|
0013| CONTROL BY ORGANIC COTTON PRODUCERS.
|

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. Section 76-6A-1 NMSA 1978 (being Laws 1996,
|
0017| Chapter 77, Section 1) is amended to read:
|
0018| "76-6A-1. SHORT TITLE. [This act] Chapter 76, Article
|
0019| 6A NMSA 1978 may be cited as the "Cotton Boll Weevil Control
|
0020| Act"."
|
0021| Section 2. Section 76-6A-3 NMSA 1978 (being Laws 1996,
|
0022| Chapter 77, Section 3) is amended to read:
|
0023| "76-6A-3. DEFINITIONS.--As used in the Cotton Boll Weevil
|
0024| Control Act:
|
0025| A. "board" means the board of regents of New Mexico
|
0001| state university;
|
0002| B. "cotton boll weevil" means any life stage of the
|
0003| cotton insect Anthonomus grandis Boheman;
|
0004| C. "cotton boll weevil control committee" means the
|
0005| persons, not less than three nor more than seven, elected by a
|
0006| majority of the cotton producers in a designated cotton boll
|
0007| weevil control district;
|
0008| D. "cotton boll weevil control district" means a
|
0009| designated area duly established under the Cotton Boll Weevil
|
0010| Control Act wherein a program to suppress or eradicate the
|
0011| cotton boll weevil is administered;
|
0012| E. "cotton producer" means any person growing five
|
0013| or more acres of cotton plants. For the purposes of the Cotton
|
0014| Boll Weevil Control Act, only one person from any farm, sole
|
0015| proprietorship, corporation, partnership or any other legal
|
0016| business arrangement shall be eligible to vote to establish or
|
0017| dissolve a cotton boll weevil control district;
|
0018| F. "department" means the New Mexico department of
|
0019| agriculture; [and]
|
0020| G. "director" means the director of the New Mexico
|
0021| department of agriculture; and
|
0022| H. "organic cotton producer" means any person
|
0023| growing cotton who is certified by the organic commodity
|
0024| commission as a producer of organic or transitional cotton."
|
0025| Section 3. Section 76-6A-5 NMSA 1978 (being Laws 1996,
|
0001| Chapter 77, Section 5) is amended to read:
|
0002| "76-6A-5. COTTON BOLL WEEVIL CONTROL COMMITTEE--DUTIES
|
0003| AND POWERS.--
|
0004| A. [The local] A cotton boll weevil control
|
0005| committee shall prescribe control measures for any cotton
|
0006| planted within a cotton boll weevil control district. When
|
0007| prescribing control measures, the cotton boll weevil control
|
0008| committee shall make every effort to adhere to integrated pest
|
0009| management practices, to allow organic cotton producers to
|
0010| choose organic pest management practices that will allow them
|
0011| to maintain their organic certification and to adhere to the
|
0012| management goals of individual cotton producers consistent with
|
0013| the goal of complete eradication of the cotton boll weevil.
|
0014| B. [The] A cotton boll weevil control committee
|
0015| may adopt regulations to set the method for determining the
|
0016| yield per acre of cotton lands under the control of [the] a
|
0017| cotton producer for purposes of calculating the assessment
|
0018| amount due."
|
0019| Section 4. Section 76-6A-8 NMSA 1978 (being Laws 1996,
|
0020| Chapter 77, Section 8) is amended to read:
|
0021| "76-6A-8. HEARINGS.--Within sixty days after [the] a
|
0022| petition has been filed with the director and upon payment of
|
0023| the cost estimate, the director shall cause notices to be given
|
0024| of the proposed hearings in areas of the state where the cotton
|
0025| boll weevil is of economic importance. The notices of hearing
|
0001| shall be published [at least fourteen days prior to the date
|
0002| of hearing] in a newspaper of general circulation in the
|
0003| proposed cotton boll weevil control district, and shall be
|
0004| sent directly to the organic commodity commission, at least
|
0005| fourteen days prior to the date of the hearing."
|
0006| Section 5. Section 76-6A-11 NMSA 1978 (being Laws 1996,
|
0007| Chapter 77, Section 11) is amended to read:
|
0008| "76-6A-11. [LOCAL] COTTON BOLL WEEVIL CONTROL
|
0009| COMMITTEES--ADDITIONAL DUTIES AND POWERS.--
|
0010| A. [In the performance of this function, local]
|
0011| Cotton boll weevil control committees may:
|
0012| (1) conduct programs to suppress or eradicate
|
0013| [designated] cotton boll weevils within their [local]
|
0014| cotton boll weevil control [district] districts;
|
0015| (2) cooperate in the administration of the
|
0016| Cotton Boll Weevil Control Act through the use of state or
|
0017| federal personnel and facilities or both;
|
0018| (3) enter into contracts or cooperative
|
0019| agreements with [other agencies, including federal] state,
|
0020| federal or local agencies;
|
0021| (4) publish information and conduct seminars
|
0022| on the distribution and control of the cotton boll weevil; and
|
0023| (5) levy and collect a special assessment,
|
0024| based on cotton acreage or cotton yield per acre within the
|
0025| cotton boll weevil control [district] districts.
|
0001| B. [Local] Cotton boll weevil control committees
|
0002| shall provide a complete accounting of the funds collected
|
0003| through the special assessment to all participating cotton
|
0004| producers in the cotton boll weevil control [district]
|
0005| districts.
|
0006| C. The cotton boll weevil control committee shall
|
0007| send notice of the establishment of a cotton boll weevil
|
0008| control district and its defined boundaries to the organic
|
0009| commodity commission within fourteen days of its
|
0010| establishment."
|
0011| Section 6. A new section of the Cotton Boll Weevil
|
0012| Control Act is enacted to read:
|
0013| "[NEW MATERIAL] ORGANIC COTTON REGULATIONS.--
|
0014| A. Each organic cotton producer within an
|
0015| established cotton boll weevil control district shall notify
|
0016| the cotton boll weevil control committee in writing of the
|
0017| number of acres on which the organic cotton producer intends to
|
0018| plant organic cotton at least thirty days prior to planting.
|
0019| B. The cotton boll weevil committee shall require
|
0020| all organic producers to pay the assessment established for the
|
0021| cotton boll weevil control district in the same manner as
|
0022| producers of conventionally grown cotton in the cotton boll
|
0023| weevil control district.
|
0024| C. After crop planting, the cotton boll weevil
|
0025| control committee shall notify an organic cotton producer as to
|
0001| the boll weevil status of his cotton acres, as well as the boll
|
0002| weevil status of surrounding acres, as documented by the
|
0003| committee's normal boll weevil trapping program.
|
0004| D. The cotton boll weevil control committee shall
|
0005| confer with the organic cotton producer to determine measures
|
0006| that might be taken to attempt to keep all or a portion of the
|
0007| organic cotton producer's cotton acreage below trigger levels
|
0008| for required treatment. If the organic cotton producer chooses
|
0009| to use a nonconventional method, the cotton boll weevil control
|
0010| committee shall pay the costs of the nonconventional method
|
0011| used by the organic cotton producer. If boll weevil trigger
|
0012| levels are reached on the organic cotton producer's acres and
|
0013| boll weevil migration from outside these acres has been
|
0014| eliminated as a cause of these levels, then the organic cotton
|
0015| producer shall be allowed to harvest these acres, but shall not
|
0016| be allowed to grow cotton on the acreage for one year. If the
|
0017| organic cotton producer chooses to use conventional methods of
|
0018| treatment, the cotton boll weevil committee shall proceed
|
0019| accordingly."

0023| the district, who shall have all the powers of a committee
|
0024| member, to serve on the cotton boll weevil control committee.".
