0011| RELATING TO CRIMINAL LAW; CREATING A NEW CRIMINAL OFFENSE OF

0012| DOG THEFT; PROVIDING PENALTIES; ENACTING A NEW SECTION OF THE
|
0013| CRIMINAL CODE.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. A new section of the Criminal Code is enacted
|
0017| to read:
|
0018| "[NEW MATERIAL] DOG THEFT.--
|
0019| A. Dog theft consists of the stealing of a dog that
|
0020| belongs to another person.
|
0021| B. Whoever commits dog theft when the value of the
|
0022| dog stolen is one hundred dollars ($100) or less is guilty of a
|
0023| petty misdemeanor.
|
0024| C. Whoever commits dog theft when the value of the
|
0025| dog stolen is over one hundred dollars ($100) but not more than
|
0001| two hundred fifty dollars ($250) is guilty of a misdemeanor.
|
0002| D. Whoever commits dog theft when the value of the
|
0003| dog stolen is over two hundred fifty dollars ($250) is guilty
|
0004| of a fourth degree felony."
|
0005| Section 2. EFFECTIVE DATE.--The effective date of the
|
0006| provisions of this act is July 1, 1997.
