0011| RELATING TO ELECTIONS; CREATING A POLLING PLACE FOR MAIL BALLOT
|
0012| ELECTIONS; AMENDING SECTIONS OF THE MAIL BALLOT ELECTION ACT.
|

|
0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. Section 1-23-5 NMSA 1978 (being Laws 1987,
|
0016| Chapter 160, Section 5, as amended) is amended to read:
|
0017| "1-23-5. [NO] MAILING AND FORM OF BALLOTS--PRECINCT
|
0018| BOARD--VOTING IN PERSON AT DESIGNATED POLLING PLACE.--
|
0019| A. Upon the adoption of a resolution by the
|
0020| governing body to conduct an election by [an all-mailed]
|
0021| mail ballot, each registered voter of the local government
|
0022| shall be mailed an absentee ballot [along with a statement
|
0023| that there will be no polling place] for [the] that
|
0024| election. The voter shall not be required to file an
|
0025| application for the absentee ballot. The ballot shall be
|
0001| mailed to each voter no earlier than the thirty-fifth day prior
|
0002| to the election, and the mailing shall be completed by the
|
0003| fifth day before the election.
|
0004| B. The local government election official shall
|
0005| prescribe the form of the ballot and the number of envelopes
|
0006| used in returning the ballot to the designated election
|
0007| office. The ballot shall be returned in a sealed security
|
0008| envelope.
|
0009| C. The precinct board may convene no earlier than
|
0010| five days prior to the election to remove the sealed security
|
0011| envelopes from the outer envelopes and place the security
|
0012| sealed envelopes containing the ballots into a locked ballot
|
0013| box.
|
0014| D. A registered voter who does not receive a mailed
|
0015| absentee ballot shall be allowed to vote in the designated
|
0016| election office of the local government election official until
|
0017| 7:00 p.m. on election day. If the voter votes in person, the
|
0018| voter shall sign an affidavit affirming that he did not receive
|
0019| his ballot and will not vote by mail if the ballot is received
|
0020| after he has voted at the designated election office.
|
0021| E. At 7:00 p.m. on election day, the local
|
0022| government election official shall record the numbers of the
|
0023| unused ballots and shall publicly destroy all those unused
|
0024| ballots. The local government election official shall execute
|
0025| a certificate of destruction, which shall include the numbers
|
0001| on the destroyed ballots. The certificate shall be placed with
|
0002| the checklist of registered voters."
|
0003| Section 2. Section 1-23-6.1 NMSA 1978 (being Laws 1991,
|
0004| Chapter 105, Section 43) is amended to read:
|
0005| "1-23-6.1. CHECKLIST OF REGISTERED VOTERS FOR MAIL
|
0006| BALLOT ELECTION.--The [local government official] county
|
0007| clerk shall prepare a checklist of registered voters [in the
|
0008| county] eligible to vote in the mail ballot election. The
|
0009| checklist of registered voters shall be marked, indicating that
|
0010| the voter has returned his [all] mail ballot immediately upon
|
0011| receipt or returned it to the designated election office where
|
0012| he voted in person."
