0016| PERMIT THE NEW MEXICO PUBLIC UTILITY COMMISSION TO AWARD

0017| LITIGATION EXPENSES TO CERTAIN INTERVENORS.

0019| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0020| Section 1. Section 62-13-3 NMSA 1978 (being Laws 1941,
|
0021| Chapter 84, Section 82, as amended) is amended to read:
|
0022| "62-13-3. COSTS.--
|
0023| A. Except as provided in Subsection D of this
|
0024| section and as otherwise provided by law, in all proceedings
|
0025| before the commission and in the courts, each party to the
|
0001| controversy shall bear his own costs and no costs shall be
|
0002| taxed against either party.
|
0003| B. In any commission rate proceeding in which the
|
0004| utility seeks rates to recover adjusted test-year litigation
|
0005| expenses, there shall be no presumption that the litigation
|
0006| expenses are prudent. Nothing in this section shall be
|
0007| construed to create or imply a presumption of prudence for any
|
0008| utility expenditures not addressed in this section.
|
0009| C. As used in this section, "litigation expenses"
|
0010| means all [attorneys'] attorney fees, consulting fees and
|
0011| other costs of litigation, including in-house expenditures.
|
0012| D. The commission may award litigation expenses
|
0013| reasonably incurred by intervenors participating in proceedings
|
0014| before it who represent the residential, small commercial or
|
0015| irrigation consumers. The commission shall adopt rules and
|
0016| regulations governing the award of costs to intervenors
|
0017| pursuant to this subsection."

|
0011| that the public interest would be served, the commission may
|
0012| contract to pay the litigation costs of non-governmental
|
0013| intervenors to present evidence and legal argument, or otherwise
|
0014| intervene in proceedings before the commission, in support of the
|
0015| interests of residential, small commercial and irrigation
|
0016| consumers in commission proceedings. All such contracts shall be
|
0017| paid for with funds appropriated to the commission. The
|
0018| commission shall adopt rules and regulations governing its award
|
0019| of such intervenor contracts."".
