0012|     RELATING TO IRRIGATION DISTRICT LIABILITY; AMENDING THE TORT

0013|     CLAIMS ACT TO PROVIDE IMMUNITY FROM LIABILITY FOR IRRIGATION

0014|     DISTRICTS THAT ALLOW USE OF THEIR LAND FOR RECREATIONAL

0017|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0018|          Section 1.  A new section of the Tort Claims Act is
    |
0019|     enacted to read:
    |
0020|          "[NEW MATERIAL]  LIABILITY--USE OF IRRIGATION DISTRICT
    |
0021|     LAND FOR RECREATIONAL PURPOSES.--Nothing in the Tort Claims Act
    |
0022|     shall be construed as granting waiver of immunity for any
    |
0023|     damages arising out of the use of property owned or controlled
    |
0024|     by any irrigation district established pursuant to the
    |
0025|     provisions of Chapter 73, Article 9, 10 or 11 NMSA 1978, for
    |
0001|     hunting, fishing, trapping, camping, hiking, sightseeing or any
    |
0002|     other recreational use, where the irrigation district allows
    |
0003|     such use without charge or other consideration other than a
    |
0004|     consideration paid by the state, the federal government or any
    |
0005|     other governmental agency."
