0011| RELATING TO ECONOMIC DEVELOPMENT; CHANGING THE MEMBERSHIP OF
|
0012| THE ECONOMIC DEVELOPMENT COMMISSION.
|

0014| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0015| Section 1. Section 9-15-11 NMSA 1978 (being Laws 1988,
|
0016| Chapter 81, Section 5, as amended) is amended to read:
|
0017| "9-15-11. ECONOMIC DEVELOPMENT COMMISSION CREATED--
|
0018| MEMBERSHIP--ADMINISTRATIVELY ATTACHED TO THE DEPARTMENT.--
|
0019| A. The "economic development commission" is
|
0020| created. The commission shall be a planning commission
|
0021| administratively attached to the [economic development]
|
0022| department. The commission shall provide advice to the
|
0023| department on policy matters. The commission shall be
|
0024| responsible for the annual approval and update of the state's
|
0025| five-year economic development plan. The commission shall
|
0001| consist of [seven] eight members who shall be qualified
|
0002| electors of the state [of New Mexico], no more than four of
|
0003| whom at the time of their appointment shall be members of the
|
0004| same political party and at least one of whom shall be a Native
|
0005| American. Members shall be appointed by the governor and
|
0006| confirmed by the senate. [Two members shall be appointed from
|
0007| each of the three congressional districts. The seventh member
|
0008| shall be the governor's "science advisor", hereby named. The
|
0009| governor's science advisor shall advise the governor on matters
|
0010| relating to science and technology, technological innovation,
|
0011| technical excellence, technology-based new business
|
0012| development, research and development and other science and
|
0013| technology projects conducted at research institutes and
|
0014| institutions of higher education throughout the state, with
|
0015| emphasis on commercialization of such projects and technology
|
0016| transfer for economic development purposes.] Seven members
|
0017| shall be appointed from their respective planning districts,
|
0018| and the eighth member shall be a Native American and represent
|
0019| the interests of the Indian tribes and pueblos.
|
0020| B. Appointments shall be made for [seven-year]
|
0021| five-year terms expiring on January 1 of the appropriate
|
0022| year. Commission members shall serve staggered terms as
|
0023| determined by the governor at the time of their initial
|
0024| appointment. Annually, the governor shall designate a chairman
|
0025| of the commission from among the members.
|
0001| C. The commission shall meet at the call of the
|
0002| chairman, not less than once each quarter, and shall invite
|
0003| representatives of appropriate legislative committees, other
|
0004| state agencies and interested persons to its meetings for the
|
0005| purpose of information exchange and coordination.
|
0006| D. Commission members shall not vote by proxy. A
|
0007| majority of the members constitutes a quorum for the conduct of
|
0008| business.
|
0009| E. Members of the commission shall not be removed
|
0010| except for incompetence, neglect of duty or malfeasance in
|
0011| office; provided, however, no removal shall be made without
|
0012| notice of hearing and an opportunity to be heard having first
|
0013| been given the member being removed. The senate shall be given
|
0014| exclusive original jurisdiction over proceedings to remove
|
0015| members of the commission [under such rules as it may
|
0016| promulgate]. The senate's decision in connection with such
|
0017| matters shall be final. A vacancy in the membership of the
|
0018| commission occurring other than by expiration of term shall be
|
0019| filled in the same manner as the original appointment, but for
|
0020| the unexpired term only.
|
0021| F. Commission members shall not be paid, but shall
|
0022| receive per diem and mileage as provided in the Per Diem and
|
0023| Mileage Act."
