PARSONS | 0005| | 0006| | 0007| | 0008| | 0009| | 0010| AN ACT | 0011| RELATING TO ECONOMIC DEVELOPMENT; PROVIDING FOR THE | 0012| CONFIDENTIALITY OF PROPRIETARY INFORMATION OBTAINED BY THE | 0013| ECONOMIC DEVELOPMENT DEPARTMENT. | 0014| | 0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO: | 0016| Section 1. Section 9-15-10 NMSA 1978 (being Laws 1983, | 0017| Chapter 297, Section 10, as amended) is amended to read: | 0018| "9-15-10. ORGANIZATIONAL UNITS OF DEPARTMENT--POWERS AND | 0019| DUTIES SPECIFIED BY LAW--ACCESS TO INFORMATION.--Those | 0020| organizational units of the department and the officers of | 0021| those units specified by law shall have all of the powers and | 0022| duties enumerated in the specific laws involved. However, the | 0023| carrying out of those powers and duties shall be subject to the | 0024| direction and supervision of the secretary, and he shall retain | 0025| the final decision-making authority and responsibility for the | 0001| administration of any such laws as provided in Subsection B of | 0002| Section 9-15-6 NMSA 1978. The department shall have access to | 0003| all records, data and information of other state departments, | 0004| agencies and institutions, including its own organizational | 0005| units, not specifically held confidential by law. Any | 0006| information obtained by the department that is deemed by the | 0007| secretary to be proprietary technical or business information | 0008| shall be held in confidence. Proprietary technical or business | 0009| information shall not be deemed a public record pursuant to the | 0010| Public Records Act or be open to inspection pursuant to Section | 0011| 14-2-1 NMSA 1978.
