    |
0011|     RELATING TO ECONOMIC DEVELOPMENT; PROVIDING FOR THE
    |
0012|     CONFIDENTIALITY OF PROPRIETARY INFORMATION OBTAINED BY THE
    |
0013|     ECONOMIC DEVELOPMENT DEPARTMENT.

0015|     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
    |
0016|          Section 1.  Section 9-15-10 NMSA 1978 (being Laws 1983,
    |
0017|     Chapter 297, Section 10, as amended) is amended to read:
    |
0018|          "9-15-10.  ORGANIZATIONAL UNITS OF DEPARTMENT--POWERS AND
    |
0019|     DUTIES SPECIFIED BY LAW--ACCESS TO INFORMATION.--Those
    |
0020|     organizational units of the department and the officers of
    |
0021|     those units specified by law shall have all of the powers and
    |
0022|     duties enumerated in the specific laws involved.  However, the
    |
0023|     carrying out of those powers and duties shall be subject to the
    |
0024|     direction and supervision of the secretary, and he shall retain
    |
0025|     the final decision-making authority and responsibility for the
    |
0001|     administration of any such laws as provided in Subsection B of
    |
0002|     Section 9-15-6 NMSA 1978.  The department shall have access to
    |
0003|     all records, data and information of other state departments,
    |
0004|     agencies and institutions, including its own organizational
    |
0005|     units, not specifically held confidential by law. <u>Any
</u>    |
<u></u>0006| <u>    information obtained by the department that is deemed by the
</u>    |
<u></u>0007| <u>    secretary to be proprietary technical or business information
</u>    |
<u></u>0008| <u>    shall be held in confidence.  Proprietary technical or business
</u>    |
<u></u>0009| <u>    information shall not be deemed a public record pursuant to the
</u>    |
<u></u>0010| <u>    Public Records Act or be open to inspection pursuant to Section
</u>    |
<u></u>0011| <u>    14-2-1 NMSA 1978.  The department shall take such steps as are
</u>    |
<u></u>0012| <u>    necessary to safeguard the confidentiality of the
</u>    |
<u></u>0013| <u>    information.</u>"

    |
0012|   relocation or expansion of a business shall be deemed
    |
0013|   confidential and withheld from inspection pursuant to the
    |
0014|   Inspection of Public Records Act."".,

    |
