0012| SECTIONS OF THE NMSA 1978 PERTAINING TO SPACE

0013| COMMERCIALIZATION; BROADENING THE SCOPE OF SPACE
|
0014| COMMERCIALIZATION PROJECTS.

0016| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0017| Section 1. Section 9-15-43 NMSA 1978 (being Laws 1994,
|
0018| Chapter 127, Section 2, as amended) is amended to read:
|
0019| "9-15-43. DEFINITIONS.--As used in [the Spaceport
|
0020| Development Act] Sections 9-15-43 through 9-15-47 NMSA 1978:
|
0021| A. "commission" means the [spaceport] space
|
0022| commission;
|
0023| [B. "department" means the economic development
|
0024| department;
|
0025| C.] B. "director" means the director of the
|
0001| [office for] space commercialization division;
|
0002| C. "division" means the space commercialization
|
0003| division;
|
0004| D. "secretary" means the secretary of economic
|
0005| development; [and]
|
0006| E. "space" means any location beyond altitudes of
|
0007| sixty thousand feet above the earth's mean sea level; and
|
0008| [E.] F. "spaceport" means an installation and
|
0009| related facilities [utilized] used for the launching,
|
0010| landing, recovery, servicing and monitoring of vehicles capable
|
0011| of entering or returning from space."
|
0012| Section 2. Section 9-15-44 NMSA 1978 (being Laws 1994,
|
0013| Chapter 127, Section 3, as amended) is amended to read:
|
0014| "9-15-44. [OFFICE FOR] SPACE COMMERCIALIZATION
|
0015| DIVISION CREATED--DUTIES OF DIRECTOR.--
|
0016| A. The "[office for] space commercialization
|
0017| division" is created as a division in the economic
|
0018| development department.
|
0019| B. The duties of the [office for space
|
0020| commercialization] division shall be discharged by a
|
0021| director, who shall be hired by the secretary.
|
0022| C. The director shall:
|
0023| (1) employ such other staff as is necessary to
|
0024| carry out the work of the [office for space
|
0025| commercialization] division and the commission and the
|
0001| purposes of [the Spaceport Development Act] Sections 9-15-43
|
0002| through 9-15-47 NMSA 1978;
|
0003| (2) discharge the responsibilities of the
|
0004| [office for space commercialization] division in accordance
|
0005| with the policies established and approved by the secretary;
|
0006| (3) administer federally funded grants for the
|
0007| purpose of determining the feasibility of developing and
|
0008| operating a regional spaceport and other space
|
0009| development-related activities in the state;
|
0010| (4) manage all aspects of the spaceport
|
0011| program;
|
0012| (5) coordinate the promotion and marketing of
|
0013| space-related resources of New Mexico and a regional spaceport;
|
0014| (6) serve as the interface between New Mexico
|
0015| and national and international users of the regional spaceport;
|
0016| (7) schedule user mission support with other
|
0017| elements of the regional spaceport;
|
0018| (8) develop a comprehensive inventory of New
|
0019| Mexico's space-related assets;
|
0020| (9) cooperate with the commission in
|
0021| performing tasks necessary to establish the criteria for
|
0022| overflight; and
|
0023| (10) support the commission in executing the
|
0024| tasks approved by the secretary."
|
0025| Section 3. Section 9-15-45 NMSA 1978 (being Laws 1994,
|
0001| Chapter 127, Section 4, as amended) is amended to read:
|
0002| "9-15-45. COMMISSION CREATED--MEMBERSHIP.--
|
0003| A. The "[spaceport] space commission" is
|
0004| created. The commission is administratively attached to the
|
0005| department.
|
0006| B. The commission is composed of up to eleven
|
0007| voting members. Three members shall be ex officio and [four]
|
0008| all others shall be appointed by the governor. The ex-
|
0009| officio members are the secretary, the [secretary of finance
|
0010| and administration] governor's science adviser and the
|
0011| lieutenant governor. In selecting the appointed members of the
|
0012| commission, the governor shall appoint at least three members
|
0013| knowledgeable of [the] government and commercial space
|
0014| [industry] activities. One member shall be a resident of
|
0015| Sierra county, one member shall be a representative of a
|
0016| federal space development project in the state and one member
|
0017| shall be a representative of one of the state's national
|
0018| laboratories.
|
0019| C. Appointed members of the commission shall serve
|
0020| for terms of three years; provided, when making his initial
|
0021| appointments, the governor shall appoint one member to a term
|
0022| of one year, two members to terms of two years and [three]
|
0023| two members to terms of three years.
|
0024| D. The governor shall appoint a chairman of the
|
0025| commission from among the appointed members. Other necessary
|
0001| officers shall be elected by the commission from among its
|
0002| membership.
|
0003| E. Commission members shall meet at the call of the
|
0004| chairman, not less than four times a year. Meetings shall be
|
0005| conducted in different geographic locations in the state on an
|
0006| alternating basis.
|
0007| F. Members of the commission appointed by the
|
0008| governor [of the state of New Mexico] shall be reimbursed for
|
0009| per diem and mileage pursuant to the Per Diem and Mileage Act,
|
0010| but shall not receive any other compensation, perquisite or
|
0011| allowance."
|
0012| Section 4. Section 9-15-46 NMSA 1978 (being Laws 1994,
|
0013| Chapter 127, Section 5, as amended) is amended to read:
|
0014| "9-15-46. COMMISSION--POWERS--DUTIES.--The commission
|
0015| shall:
|
0016| A. in cooperation with the [office for space
|
0017| commercialization] division, promote [spaceport] the
|
0018| development of a spaceport and [space-related] other space
|
0019| development-related activities in the state;
|
0020| B. advise the secretary on methods for soliciting
|
0021| and accepting, on behalf of the state, federal, state, local
|
0022| and private funds for the purpose of developing, constructing,
|
0023| maintaining and operating a regional spaceport and other space
|
0024| development-related projects;
|
0025| C. act in an advisory capacity to the secretary on
|
0001| matters that pertain to the development and operation of [the
|
0002| regional spaceport] space development-related projects;
|
0003| D. advise the secretary on methods for providing
|
0004| for the development, construction and acceptance of a regional
|
0005| spaceport; and
|
0006| E. report annually to the governor and the
|
0007| legislature on the status of the [regional spaceport and other
|
0008| space-related] space development-related activities and
|
0009| projects undertaken by the commission."
|
0010| Section 5. REPEAL.--Section 9-15-42 NMSA 1978 (being Laws
|
0011| 1994, Chapter 127, Section 1) is repealed.
