0011| RELATING TO MUNICIPALITIES; AUTHORIZING CONDEMNATION OF
|
0012| ELECTRIC FACILITIES; AMENDING SECTIONS OF THE NMSA 1978;
|
0013| DECLARING AN EMERGENCY.
|

|
0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:
|
0016| Section 1. Section 3-23-3 NMSA 1978 (being Laws 1965,
|
0017| Chapter 300, Section 14-22-3, as amended) is amended to read:
|
0018| "3-23-3. MUNICIPAL UTILITY--APPROVAL OF NEW MEXICO PUBLIC
|
0019| UTILITY COMMISSION.--
|
0020| A. If the acquisition of a utility is to be
|
0021| financed from funds received from the issuance and sale of
|
0022| revenue bonds, the price of the acquisition of the utility
|
0023| shall be approved by the New Mexico public utility commission
|
0024| and the commission shall require:
|
0025| (1) a determination by appraisal or otherwise
|
0001| of the true value of the utility to be purchased; or
|
0002| (2) an engineer's estimate of the cost of the
|
0003| utility to be constructed.
|
0004| B. No revenue bonds shall be issued for the
|
0005| acquisition of such a utility until the New Mexico public
|
0006| utility commission has approved the issue and its amount, date
|
0007| of issuance, maturity, rate of interest and general provisions.
|
0008| C. The provisions of Subsections A and B of this
|
0009| section shall not apply to the condemnation by a municipality
|
0010| having a population of twenty-five thousand or more persons
|
0011| according to the 1990 federal decennial census of [either]
|
0012| electricity facilities as authorized by Chapter 3, Article 24
|
0013| NMSA 1978, sewer facilities as authorized by Chapter 3,
|
0014| Article 26 NMSA 1978 or water facilities as authorized by
|
0015| Chapter 3, Article 27 NMSA 1978."
|
0016| Section 2. Section 3-24-1 NMSA 1978 (being Laws 1965,
|
0017| Chapter 300, Section 14-23-1, as amended) is amended to read:
|
0018| "3-24-1. ELECTRIC UTILITY--MUNICIPALITY MAY ACQUIRE AND
|
0019| OPERATE CERTAIN MUNICIPALITIES MAY ACQUIRE BY CONTRACT OR
|
0020| CONDEMNATION.--
|
0021| A. Any municipality may, by ordinance, acquire,
|
0022| operate and maintain an electric utility for the generation and
|
0023| distribution of electricity to persons residing within its
|
0024| service area. The service area of a municipality includes:
|
0025| (1) territory within the municipality;
|
0001| (2) territory within five miles of the
|
0002| boundary of the municipality in the case of any municipality
|
0003| heretofore acquiring or operating any municipal electric
|
0004| utility or part thereof in the territory within five miles of
|
0005| the boundary of the municipality;
|
0006| (3) the sale of electricity to the United
|
0007| States government, the state of New Mexico or any department or
|
0008| agency of these governments; and
|
0009| (4) as further provided in Section 3-24-8 NMSA
|
0010| 1978.
|
0011| B. No municipality may sell electric power and
|
0012| energy on a retail basis except as provided in Subsection A of
|
0013| this section.
|
0014| C. The acquisition of any electric utility facility
|
0015| beyond the municipal boundary shall be financed only by the
|
0016| sale of revenue bonds.
|
0017| D. Any municipality that owns a generating facility
|
0018| or an interest in a jointly owned generating facility may sell
|
0019| surplus electric power and energy on a wholesale basis either
|
0020| within or outside its service area. Any contract or agreement
|
0021| to sell surplus electric power and energy may be entered into
|
0022| on a public bid basis, a competitive basis or a negotiated
|
0023| basis, as the municipality may determine; provided, however,
|
0024| that subject to the sale or other interchange of power and
|
0025| energy with a joint participant or a co-member of a power pool
|
0001| necessary or convenient to the economical operation of a
|
0002| generating facility or a jointly owned generating facility or
|
0003| contractual requirements of a power pool in which the
|
0004| municipality is a member, such surplus electric power and
|
0005| energy shall be subject to a preference right to purchase by:
|
0006| (1) first, municipalities that own electric
|
0007| facilities on July 1, 1979;
|
0008| (2) second, public electric utilities,
|
0009| investor-owned utilities and electric cooperatives subject to
|
0010| general or limited regulation by the New Mexico public utility
|
0011| commission and the United States of America or any of its
|
0012| departments or agencies; and
|
0013| (3) any other person or entity.
|
0014| E. Municipalities located within a class A county
|
0015| and having a population of more than sixty thousand, but less
|
0016| than one hundred thousand according to the 1990 federal
|
0017| decennial census, may acquire, maintain, contract for and
|
0018| condemn for use as a municipal utility privately owned electric
|
0019| facilities used or to be used for the furnishing and supply of
|
0020| electricity to the municipality or inhabitants within its
|
0021| service area. The service area of a municipality authorized
|
0022| to acquire, maintain, contract for or condemn private
|
0023| facilities pursuant to this subsection includes customers
|
0024| located in:
|
0025| (1) territory within the municipality;
|
0001| (2) territory within five miles of the
|
0002| boundary of the municipality in the case of any municipality
|
0003| heretofore acquiring or operating any municipal electric
|
0004| utility or part thereof in the territory within five miles of
|
0005| the boundary of the municipality;
|
0006| (3) the sale of electricity to the United
|
0007| States government, the state or any department or agency of
|
0008| these governments; and
|
0009| (4) as further provided in Section 3-24-8 NMSA
|
0010| 1978.
|
0011| F. Condemnation authorized in this section shall be
|
0012| conducted in the manner of proceedings provided by the Eminent
|
0013| Domain Code."
|
0014| Section 3. Section 42A-3-1 NMSA 1978 (being Laws 1981,
|
0015| Chapter 125, Section 33) is amended to read:
|
0016| "42A-3-1. STATE, COUNTY, MUNICIPALITY OR SCHOOL DISTRICT-
|
0017| -APPROPRIATION OF PROPERTY--NATURE OF INTEREST.--
|
0018| A. Property may also be condemned by the state, any
|
0019| county, municipality or school district for the public use of
|
0020| the state, county, municipality or school district for:
|
0021| (1) public buildings and grounds;
|
0022| (2) canals, aqueducts, reservoirs, tunnels,
|
0023| flumes, ditches, conduits for conducting or storing water for
|
0024| drainage, the raising of banks of streams and the removing of
|
0025| obstructions;
|
0001| (3) roads, streets, alleys and thoroughfares;
|
0002| (4) public parks and playgrounds;
|
0003| (5) ferries, bridges, electric railroads or
|
0004| other thoroughfares or passways for vehicles;
|
0005| (6) canals, ditches, flumes, aqueducts and
|
0006| conduits for irrigation;
|
0007| (7) electric lines;
|
0008| (8) electric utility plants, properties and
|
0009| facilities consistent with the authority granted in Chapter 3,
|
0010| Article 24 NMSA 1978;
|
0011| [(8)] (9) the production of sand, gravel,
|
0012| caliche and rock used or needed for building, surfacing or
|
0013| maintaining streets, alleys, highways or other public grounds
|
0014| or thoroughfares; and
|
0015| [(9)] 10 public airports or landing fields
|
0016| incident to the operation of aircraft.
|
0017| B. No land shall be condemned for the production of
|
0018| sand, gravel, caliche or rock [which] that is in the
|
0019| possession or ownership of a person, firm or corporation
|
0020| engaged at the time the proceeding is brought in the actual
|
0021| production of such material from such land sought to be
|
0022| condemned. Nor shall any land be condemned for municipal pur-
|
0023|
|
0024| poses [which] that may be shown by the owner or lessee to
|
0025| have a content of precious metal sufficient to produce the
|
0001| mineral in paying quantities.
|
0002| C. Unless the petition to condemn specifically
|
0003| provides for a transfer of less than the fee, all real property
|
0004| acquired pursuant to this section shall be acquired and held in
|
0005| fee simple absolute."
|
0006| Section 4. EMERGENCY.--It is necessary for the public
|
0007| peace, health and safety that this act take effect immediately.

0015| 1. On page 5, between lines 9 and 10, insert the following

0018| "F. A municipality that acquires, maintains, contracts

0019| for or condemns privately owned electric facilities for use as a
|
0020| municipal utility pursuant to the provisions of Subsection E of
|
0021| this section shall:
|
0022|
|
0023| (1) not use revenues earned from the electric
|
0024| facilities for any purposes other than those directly related to
|
0025| the furnishing and supply of electricity to the municipality or
|
0001| inhabitants within the service area;
|
0002|
|
0003| (2) not restrict use of the electric facilities or
|
0004| distribution system to any person authorized to use the
|
0005| facilities or distribution system pursuant to state law; and
|
0006|
|
0007| (3) adopt a shared payment policy for line
|
0008| extensions, with public input, that is fair and equitable,
|
0009| requiring reasonable contributions from the persons who will
|
0010| directly benefit from the line extension and not imposing an
|
0011| unreasonable burden on the municipality or inhabitants within the
|
0012| service area that do not directly benefit from the line
|
0013| extension.".

|
0015| 2. Reletter the succeeding subsection accordingly and
|
0016| adjust cross-references to correspond with these amendments.
