0011| RELATING TO TAXATION; PROVIDING FOR DISTRIBUTION OF GROSS

0012| RECEIPTS TAX TO CERTAIN INDIAN TRIBES AND PUEBLOS; CREATING THE

0013| INDIAN TOURISM FUND; MAKING AN APPROPRIATION.

0015| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

0016| Section 1. A new section of the Tax Administration Act is
|
0017| enacted to read:
|
0018| "[NEW MATERIAL] DISTRIBUTION--INDIAN TOURISM FUND.--A
|
0019| distribution pursuant to Section 7-1-6.1 NMSA 1978 shall be
|
0020| made to the Indian tourism fund in an amount equal to one-
|
0021| sixteenth percent of gross receipts, exclusive of penalties and
|
0022| interest."
|
0023| Section 2. [NEW MATERIAL] INDIAN TOURISM FUND--
|
0024| CREATED--DISTRIBUTION--USE.--
|
0025| A. The "Indian tourism fund" is created in the
|
0001| state treasury. Income from investment of the fund shall be
|
0002| credited to the fund. Money in the fund shall not revert to
|
0003| the general fund at the end of any fiscal year. The fund shall
|
0004| be administered by the New Mexico office of Indian affairs.
|
0005| Disbursements from the fund shall be made on warrant drawn by
|
0006| the secretary of finance and administration pursuant to
|
0007| vouchers signed by the director of the office or his authorized
|
0008| representative.
|
0009| B. Money in the fund shall be distributed annually
|
0010| to nongaming Indian tribes and pueblos in the percentage the
|
0011| tribe's or pueblo's population bears to the total population of
|
0012| all nongaming Indian tribes and pueblos.
|
0013| C. The distribution shall be used by the nongaming
|
0014| tribes and pueblos for tourism-related activities and projects
|
0015| or infrastructure development.
|
0016| Section 3. EFFECTIVE DATE.--The effective date of the
|
0017| provisions of this act is July 1, 1997.
